Case No: SUP-161-02 Applicant: Mennonite Church Project: Change of Use—convention center to church Location: 701 N. Indiana Ave. The CFD has already completed a building permit "change of use"plan review on this application. Prior to submitting the plan review I was advised that the Applicant had pulled their building permit request. This facility is not able to meet the UFC standards for minimum required fire flow or fire hydrant distances in proximity to the structure. To mitigate the problem will require the installation of two (2) fire hydrants (one off-site and one on-site), or, a single fire hydrant in conjunction with a fire sprinkler system. I have attached the plan review to these comments for additional information. 1 10k./ Minimum Standards 1997 Uniform Fire Code (UFC) Date: April 17, 2002 To: Evergreen Heights Mennonite Center, Applicant From: Douglas Brown, Assistant Chief/Fire Marshal Subject: Plan Review for Change of Use 701 N. Indiana Avenue/Permit#30199 THE FOLLOWING CONDITIONS ARE TO BE AGREED UPON PRIOR TO THE ISSUANCE OF A BUILDING PERMIT. ANY OUTSTANDING ISSUES WILL BE REQUIRED TO BE REVIEWED AND APPROVED BEFORE A CERTIFICATE OF OCCUPANCY IS GRANTED. Project Summary: Proposed Use: Assembly occupancy to a church Building size: Approx. 5,000 SF Building height: Single story Separation: All four sides Occupancy classification: A-3 Type of Construction: Type V-N Required Fire Flow: 2,000 GPM (1,500 - if fire sprinkled) General Notes: This is a plan review for a change of use from a convention center to a church. As part of the change of use plan review the structure and facilities must be brought up to current fire code requirements. Consequently there are several areas of concern for fire protection purposes that are noted below. Some of the requirements may seem questionable in magnitude and expense, but that is because this structure has been an existing non-compliant structure for a considerable period of time. In order for this plan review to be accurate and complete, the Applicant is requested to submit the following documents: • A detailed, "to-scale", floor plans for the building(s) that show all interior and exterior walls and doors, show seating plans and aisles, and identify the use of each room or area. • A"to-scale" site plan (larger and more accurate than the one submitted) showing all buildings, roadways, sidewalks, fences, and walls. 2 Please note that any deviation from the conditions set forth in this plan review requires further analysis and the approval of the Fire Marshal. New conditions or requirements may be imposed as the result of any changes. All conditions noted in this plan review pertain to this project, to and through its completion and intended use. Upon or nearing completion of construction, a Final Inspection will be required. The CFD will approve and sign the certificate of occupancy only upon full compliance, or mutually agreed upon mitigation, regarding any and all correction items. Itemized Conditions: Premises Identification—(UFC Sec. 901) 1. This existing building will retain its address of 701 N. Indiana Avenue. 2. Address numerals (701) shall be posted high on the side of the building facing N. Illinois Avenue towards the north end of the main building. The numerals shall be a minimum of 12" tall and must contrast distinctly with their background. 3. The address shall also be placed distinctly on any monument signage by the entrance driveway in contrasting numerals at least 4"tall. Access—(UFC Sec. 902) 1. The access driveways are inadequate as shown. The turnaround at the end of the westerly driveway is undersized for current standards (100' diameter or hammerhead with 120 feet across at the T). The driveway is not at least 20' wide, the required minimum driveway width for a fire lane. 2. All driveways are considered fire lanes. There shall be no parking permitted along driveways. Curbing shall be painted bright red with a durable paint and stenciled with the legend"No Parking—Fire Lane" in 3"tall white block lettering at 10' intervals or fraction thereof as needed or applicable. If curbing is not provided, approved Fire Lane signage is required at 30' intervals. 3.If gated or controlled access will be provided(gate, cable or chain across the driveway) then the locking device shall be as approved by the CFD. 4. A CFD approved Supra Lock Box is required for this building and will probably be located next to the main driveway entrance on a pedestal or stanchion. The exact location of the lock box will be approved by the Fire Marshal. The lock box shall be of sufficient size to 3 accommodate two sets of master keys to all door locks in the facility. (NOTE: An authorization/ order form for the lock box must first be obtained from the Fire Marshal.) Water Supply and Hydrants—(UFC Section 903 and Appendix III-A) 1. The minimum required fire flow for this building is 2,000 GPM. Such a flow would need to be supplied through a minimum of two (2) fire hydrants capable of supplying at least 1,000 GPM each and located no more than 350 feet apart. Currently there are NO fire hydrants within 700 feet of this building. There is an older, sub-standard (two - 2-1/2" outlets only) fire hydrant located downhill at Marble Front Road and Indiana Ave. and there is a fire hydrant located at Indiana Ave. and Lincoln Street. Both of these fire hydrants are an unacceptable distance from this building and are about 800 feet apart. Therefore, the Applicant is required to provide the required fire hydrants capable of providing at least 1,000 GPM and within an acceptable distance from the building. (NOTE: This requirement may be made easier to meet considering that there is a city water tank and water main on the adjoining lot to the north.) However, if it is cost prohibitive to install the required two fire hydrants, then the following would be an acceptable alternative to mitigate the fire hazard. The Applicant would need to install a single fire hydrant on Indiana Avenue by the driveway entrance and install a NFPA 13 automatic fire sprinkler system in the building. Installation of the fire sprinkler system would provide a credit that would discount the fire flow to 1,500 GPM provided by a single fire hydrant. Places of Assembly/Exiting—(UFC Article 25) 1. Exiting requirements would be dependent upon acceptance of floor plans and shall be as specified by the Building Official. 2. Illuminated exit signage and emergency lighting shall be provided to all exit ways. Fire Protection Systems—(UFC Article 10) 1. An NFPA 13 compliant automatic fire sprinkler system is required for this building unless the minimum required fire flow is met by fire hydrants. Plans for a sprinkler system shall be submitted to the Idaho State Fire Marshal's office for review and approval. 2. The location of the Fire Department Connection (FDC) will be approved by the Fire Marshal. 4 3. A PIV for the water supply line for the sprinkler system shall either be installed in the parkway, or, a wall mounted PIV may be used. The PIV shall be equipped with a tamper switch that is tied into the alarm system and shall be locked. 4. The exterior fire alarm bell for the sprinkler system shall be a 10"model and shall have signage on or near it stating"Sprinkler Alarm Bell—If ringing call 9-1-1." In addition, the CFD requires that an exterior red strobe light be provided in conjunction with the fire alarm bell. 5. Plans for all components of the fire alarm system (flow switch and tampers) shall be submitted to the CFD Fire Marshal for separate review and approval. All fire alarm components shall be to NFPA 72 standards and are subject to acceptance tests. Fire Extinguishers—(UFC Sec. 1002) 1. This building will require numerous 2A:10BC rated fire extinguishers every seventy-five feet (75') of travel distance. Extinguisher locations will be noted on floor plans, once submitted. All fire extinguisher locations will be determined and approved by the Fire Marshal upon or near final inspection. 2. Fire extinguishers must be mounted between 3' and 5' above floor level in a visible and readily accessible location. Signage indicating their location shall be located at least three feet above them. 3. There may be a requirement for fire extinguishers in the yard area depending on the use and activity in those areas. General Fire Safety and Miscellaneous Conditions: 1. Any and all hazardous materials shall not exceed the maximum allowable limits established in Articles 79 and 80 of the UFC. MSDS's shall be kept of all hazardous materials used. Hazardous materials identification signage may also be required. 2. If there is any remodel work involved, the building and site shall be kept reasonably clean and free from accumulations of debris and combustibles. 3. During construction it is highly recommended that the construction site is fenced, illuminated at night and/or a security guard utilized as a deterrent to vandalism/ arson. 4. Smoking is absolutely prohibited in the building during construction. 5 5. The general contractor shall be provided a copy of this plan review by the architect and a copy of this plan review shall be kept on-site during remodel work. 6. All exterior fire appliances (fire hydrants, PTV,FDC, alarm bell) shall be painted bright red and cleaned prior to final. Date: April 23, 2002 The Engineering Department has received the above referenced request for a Special Use Permit and provides the following comments: 1. The existing property is connected to City water, but may be subject to additional connection fees if the proposed use increases demand on the City's water system. The need for any additional fees will be reviewed during the building permit process. 2. The property is not connected to City sewer. The nearest sewer line is located in Marble Front Street and connecting to it does not appear to be feasible. The City does not object to using the existing septic system as long as it is approved by Southwest District Health for its intended use. 3. Any additional impervious area created by modifications to the existing structure and/or grounds must be dealt with in accordance with the City's Storm Water Management Policy. 4. The existing prescriptive right-of-way is 25 feet. However, we would eventually like to see Airport Avenue extended from its terminus by Manchester Park to the Southgate Subdivision to improve traffic circulation in this area for emergency response. Case No: SUP-161A-02 (Appeal) Applicant: Evergreen Heights Mennonite Church,Inc. Project: Change of Use- from special events center to a church Location: 701 N. Indiana The CFD routinely plan reviewed and submitted conditions for the Applicant's request for a change of use on this facility on April 17, 2002. Since that time we have received three requests for information on fire codes and plan review processes from the law firm of White Peterson. Mr. Steve Hasson of the Caldwell Community Development Department responded on our behalf to the written request for information that was submitted on May 3, 2002. In the two other instances I have provided hard copies of Uniform Fire Code articles relating to the spacing of fire hydrants and also verbally responded to questions on how we process change of use applications. I believe we have cooperated with the Applicant's legal representatives to the best of our ability to do so. IR, < 5 The thrust of the appeal by the Applicant contests the fact that the building and facility in question, the former Evergreen Heights special event center at 701 N. Indiana, was an existing non-conforming (with current fire code standards) facility that, because of the change of use, is now being conditioned to correct several fire code deficiencies. It appears that the Applicant entered into an agreement to use the property and facility without checking with the fire department whether it was up to code or not for the use proposed. Once the change of use was applied for it triggered a plan review by city staff, including the fire department. This is currently one of very few ways that we are able to get non-conforming structures into compliance with current code. When that structure or facility is to be used as an assembly occupancy(50 or more person occupant load), it is all the more important that we ensure that the place conforms with current codes and standards due to the potential for a large loss of life incident. hi the course of our plan review (copy below) we noted, among several other items, that this facility did not have adequate water to meet its minimum required fire flow due to the distance to hydrants. More correctly, there are no fire hydrants within the prescribed distances from this facility that can be used to credit toward meeting the fire flow. I did notice one error I made in the plan review. That involves the spacing required between fire hydrants which is actually 450 feet and not 350 feet, as shown. However, that does not seem to be a significant error because the existing fire hydrants are over 800 feet apart. As of this writing I have had no requests from the Applicant's to discuss their concerns or to review options or ways to mitigate the conditions. Also, the Applicant's, to the best of my knowledge, have not complied with our request to submit accurate and complete plans, specifically: • A detailed, "to-scale", floor plans for the building(s) that show all interior and exterior walls and doors, show seating plans and aisles, and identify the use of each room or area. • A "to-scale" site plan (larger and more accurate than the one submitted) showing all buildings, roadways, sidewalks, fences, and walls. In summary, my recommendation to the City Council would be to uphold the conditions required in the plan review and to encourage the Applicant's to meet and confer with the Fire Marshal to further explore what may be done to meet the intent of the code. My reason for this request is that by allowing a facility that was previously not in conformance with the codes, to be officially reviewed for conformance, but then waiving all or portions of what is required for compliance, could place the city in a position of liability. The appeal references condition 9.3 of the Order of Decision. The Engineering Department requested dedication of right-of-way in accordance with City Code and the Functional Classification Map. According to the County Assessor's map, the existing right-of-way is 25-ft prescriptive use. Since the roadway is classified as a Collector, dedication of 30-ft of right-of-way was required. The Engineering Department requests that the right-of-way dedication of 30-ft remain as a condition of the Special Use Permit. Indiana this morning. We posted it with notices (red tags) on the doors serving the assembly areas. The notices state that they are in violation of Caldwell codes for operating a church in that facility and to discontinue such use. We documented the posting with numerous digital photographs. I am relatively sure we will be hearing from William Gigray III very soon. I gave Mark Hilty a heads up on this at the Landscape Ordinance Workshop last night. Indiana. There is a new sign in front stating that this is a Mennonite Church with church services at 10:40am on Sunday. I observed 13 cars in the parking lot. There were several people dressed "for church" who I observed going into and out of the assembly room portion of the complex. I took several digital photographs to document the situation. This change of use was conditioned during a plan review. The occupants have not complied with the fire department requirements. Attorney Bill Gigray represents the occupants and had filed an appeal and then withdrew his appeal. Steve - what's your pleasure on this? Mr. Gigray knows better. Thanks, Doug 1
