The Engineering Department provides the following comments on the above referenced Special
Use Permit for improvements to the El Rey Dance Hall at 3623 Lake Avenue:
1. The existing property currently is not connected to either City sewer or water services. Both of
these services are available in Lake Avenue. This department recommends that this facility be
required to connect to City sewer and water systems. Fees to connect to City services shall be
assessed at the time of building permit issuance.
2. Lake Ave. is currently designated as a Minor Arterial street. A deed to the City of Caldwell for
40 feet of right-of-way along the entire Lake Ave. frontage will be required.
3. This department recommends that street improvements be required along Lake Avenue
frontage, including curb, gutter, sidewalk, and street widening, all constructed to City
standards.
4. Storm water drainage from street improvements and any additional impervious area created by
modifications to the existing structure and/or grounds shall be retained on-site in accordance
with the City's Storm Water Management Policy. A copy of this policy is available upon
request. The engineer of record shall provide calculations, which indicate that the assumptions
in his storm drainage plan comply with the storm drainage policy.
5. The sign at the entrance currently impairs the view of vehicles leaving the property to see
oncoming traffic from the South. It is recommended that this sign be relocated.

June 6, 2002 Meeting
The Caldwell Fire Department (CFD) offers the following comments regarding the following cases
to come before the Caldwell Hearing Examiner on June 6, 2002:
Case No: SUP-162-02
Applicant: Albino Ortega
Project: El Rey Ballroom
Location: 3623 Lake Avenue
The El Rey Ballroom has been the subject of a lengthy and extensive SUP plan review by the
CFD and city staff just last year. The last SUP made a list of specific recommendations of
necessary fire protection requirements (on file in Community Development). That SUP lapsed
because the Applicant failed to complete any of the requirements within the specified timelines.
This Applicant, Mr. Ortega, has not met with the Fire Marshal to address any of the issues
previously identified for correction. Mr. Ortega's application letter fails to mention whether
there will be alcohol consumed on the premises or not. As we have found out from several other
similar venues, many of these activities also involve the consumption of alcohol. The issue of
alcohol consumption is a critical factor because the El Rey Ballroom is over 5,000 SF in size and
thereby requires an automatic fire sprinkler system if alcohol is consumed.
Since the lapse of the previous SUP on this facility, the CFD has been approached on two
separate occasions to grant a special request by the previous Applicants to hold PAL/DARE
boxing matches in that facility. The CFD agreed to the first one after being told it was a"one
time only"request and expressly prohibiting the consumption of alcohol. Just a couple weeks ago
we received a second request for an identical event. Reluctantly we gave our approval when the
event promoter informed us that they had already advertised the event and people were coming
from all over the state. There will be no other similar requests granted for this facility.
At this time the CFD requests that the SUP be denied on the basis for which it lapsed last time—
no proof of compliance with a lengthy list of code-mandated fire protection requirements. I
would encourage Mr. Ortega to schedule a meeting with the Fire Marshal and city staff to go
over exactly what he proposes and the requirements that apply.

SUBJECT: Meeting Regarding the El Rey Ballroom—3623 Lake Avenue
This memo is a follow up to a meeting held at Caldwell City Hall on 6/25/02. The meeting
involved Sylvester Castaneda, Laura Castaneda's, Victor Sanchez, Steve Hasson, and myself.
The CFD has gone on record via previous Special Use Permit (SUP) action with a list of fire
code requirements that are tied to this change of use. That list is a part of the SUP package.
The CFD went over the various requirements with Mr. Castaneda, who is the new owner of the
property. Mr. Castaneda advised that he would get all of the requirements completed within
ninety(90) days of the signing of the order on the SUP. He said that it may take somewhat
longer to get the parking lot paved and improved. I advised Mr. Castaneda that once the required
improvements were completed we would approve him to open the facility to the public.
I also requested,per the SUP conditions, that Mr. Castaneda provide us with an accurate and
engineered set of plans depicting the site and the floor-plan for the building. He said that he
would do so.
Among the conditions:
• Post address on building and out by Lake Avenue.
• Install a fire hydrant that will flow at least 1,500 GPM.
• Install a complete automatic fire sprinkler system in the building per NFPA 13 standards.
• Install a complete evacuation fire alarm system per NFPA 72 standards.
• Re-calculation of the occupant load by the Building Official and posting of same.
• Provide all-weather access roadway(20' minimum width) from Lake Avenue to the front
of the building. Provide turnaround area or ability. Post fire lane signage.
• Meet all other fire code regulations for the facility as directed.

It should be noted that a full plan review is required as part of the remodel permit that is required
for the repair and improvement work on this building. All conditions in that plan review will
become binding and will reflect the results of a new fire inspection of the facility.
The CFD has agreed with Mr. Castaneda that our final inspection of the remodel work for the
building permit will also serve as our inspection for a beer license. Successful passage of that
inspection will result in our signing the C of 0 and the Beer & Wine License.
Mr. Castaneda has informed us that Olson & Associates will be his architect firm for this project
and we look forward to working with them.

Subject: Dance Hall on Lake Ave.
I meet with Mr. Castina concerning the dance hall. I gave him these guidelines;
1. There must be a separate room for where alcohol is served where minors are not
allowed.
2. He must meet all state and local requirements.
3. He should have sufficient security to cover checking ID's, preventing trouble, and
patrolling the parking lot.
4. The parking lot must be well lit.
5. He must cooperate with police officers on any situation that occurs.
6. He needs to respect and work with people living in the area so as to not cause
them problems of any kind.

FYI - I was informed today by Adam Garcia, the architect representing the new owners of
the El Rey Ballroom (at 3623 Lake Avenue) , that that facility is undergoing a name change
to El Tropical Event Center. So if you see or hear that name, now you'll know what it is.
Adam said that plans and work are proceeding to improve the facility under their special
use permit. He brought by a set of fire alarm system plans for my review. He indicated
that the plans for the fire hydrant have been delayed due to grading and runoff water
concerns with the parking area. He is negotiating with the irrigation company to drain
surface water into their canal.
The passionate purple building that used to be the El Rey Ballroom now is a light green
color on the outside. The illegal ticket booth that was by the courtyard gate has been
torn down. This facility is still closed from holding public events pending a lengthy
list of correction items.
Adam said they want to put a gate across the driveway and place a ticket booth there - to
make folks pay their admission before they even park. I told him that any changes like
than need further review by city staff.
The new owners are "Royejello" who also owns the Tacos Michoacan Restaurant on 5th and he
has a partner named Jose Plencia.
