At the request of the Planning and Zoning Department, SUP-173-02 is being inspected
to verify compliance with conditions. Relevant conditions are as follows:
8.7. The construction of an ADA ramp is required
8.8. As a part of the building permitting process, the Applicant shall
provide a detailed landscaping/fencing plan that shall be approved
by the Community Development Director and City Forester.
8.10. The Applicant shall obtain a sign permit prior to installing any
sign at the site in accordance with Section 10-02-06 of Caldwell
Zoning Ordinance No. 1451.
8.12. The Applicant shall provide off-street parking equal to one
space for every eight children, plus one additional space for each
employee. Accordingly, the Applicant will provide a parking plan
demonstrating at least 25 off-street parking spaces. The
Applicant will also furnish a site plan showing that the on street
or off street drop off and pick point is not located on Cleveland
Boulevard.
8.16. The fence construction must comply with setback and height
restriction requirements. The Applicant will make the fence site
obscuring except along the alley frontage. The fence must be
replaced within six months of the signed Order of Decision or by
April 25, 2003.

A site inspection was conducted and it was found that the fence is not sight obscuring. I
spoke with Anne Marie and this Special Use permit has not been inspected since it was
approved, we are not going to make them replace the fence with vinyl of wood, nor
would the Historic Preservation Commission approve that.
