For the record, though, it should be noted that during the Change of Use Permit process regarding this facility, the CFD did issue a rather extensive number of conditions relating to fire protection and life safety. All of the CFD's conditions noted in the CUP plan review convey to this SUP along with our conditional approval of same as previously noted. Case No: SUP-198-03 Applicant: Crestline, LC Project: International Mini-Storage Location: 6617 Cleveland Blvd. The CFD has no objections to issuance of a SUP for this project and has met with the Applicant's and city staff to learn about the project in general. This project began in 1998 and was reviewed by the CFD a couple years ago when it was re-proposed. Comments, concessions and or conditions set forth by the previous Fire Marshal, Mr. Joe Silva, are hereby rescinded pending a new plan review using the latest plans for current code compliance. A major concern regarding this project is that it fails to provide secondary access for emergency vehicles due to the extreme"flag shape" and landlocked features of the property. The nature of the proposed use, as a mini-storage facility, reduces the risk to human life somewhat versus the level of risk that would be encountered at a development that is used primarily for habitation by persons. As just one means of mitigation for the lack of secondary access, the CFD will recommend the use of an over-sized access roadway to service this facility. The CFD's specific conditions of approval will be later identified and submitted in a full plan review of this project. Such plan review will include roadway and fire lane identification, fire hydrant locations, fire separation/walls, building identification (numbering system), fire extinguisher locations, hazardous materials storage prohibitions, gate access, etc. Memorandum To: Steve Hasson From: Ben Weymouth, Assistant City Engineer Re: Case No. SUP-205-03 Date: December 19, 2003 The Engineering Department provides the following comments concerning a Special Use Permit request by Brenda Cameron for approval to allow a group home for women and children in an R- 3 (multiple-family high density residential) zone. 1. Right-of-way on 14th, 16th, and Elgin Street are adequate and meet current City standards. 2. The existing infrastructure along 14th, 16th, and Elgin Street meets City standards. 3. Both domestic water and sanitary sewer are available to the site. The applicant will be required to connect to City services if not already connected. 4. Any new construction will require that all traffic control for the project meet the requirements of the Manual on Uniform Traffic Control Devices (M.U.T.C.D.) and the City Engineer. The contractor shall provide a traffic control plan to the City Engineer for review prior to any construction within the right-of-way. 5. Any new construction will require the applicant to comply with A.C.H.D. (Ada County Highway District) access spacing and alignment requirements at a minimum. 6. Prior to commencement of construction in any dedicated right-of-way, the City Engineer staff is to be notified. Appropriate City personnel are to be notified in advance of all required inspections. 7. Provision is to be made for the disposal of stormwater drainage that may occur from the addition of impervious surfaces in accordance with the City Stormwater Management Policy. A copy of this policy is available upon request. 8. Irrigation water for any and all landscaping shall be obtained from applicable Irrigation District sources. City municipal water may be used if the criteria specified in the Landscape Ordinance Section 10-07-12 are met. 9. Appropriately licensed public works contractors shall perform all construction of dedicated facilities. SWDH has an interest in two units of the facility, the day F care unit and the food service unit. Before the day care can be approved, it will require an inspection from SWDH and will have to obtain a license and pay the necessary fees. The food unit will probably need to obtain a permit from SWDH, submit a plan of the facility, undergo a pre-opening and regular inspection and pay a $65 license fee. . Although the proposed new use is very similar to the existing or last use of the building the Fire and Building Depts. performed an inspection and have dicovered some deficiencies. We have gone over the deficiencies with the manager of Hopes Door and are confident that the necessary corrections will be made in a timely manner, and prior to the issuance of the required Certificate of Occupancy. She was called because no one could find a phone number for Brenda Cameron. She stated she went there and that a water pipe had broke on the third floor. She stated there was considerable damage,part of a ceiling has collapsed plus major destruction of the second and third floors and there was several inches of water standing in the basement. Numerous conditions were placed upon them. One of those conditions pertained to the old (circa 1977) automatic fire sprinkler system. We have required that they have a state licensed fire sprinkler company "certify" that the system is in an operable and NFPA 13 compliant condition. This morning I received a phone call from Mr. Larren Bailey at Viking Sprinkler Company. He said they have been contacted about certifying the system at that facility. (This is a little odd because I had a phone call from Shilo Sprinkler Co. a few weeks ago indicating they were looking at certifying the system.) Mr. Bailey indicated that they (Viking) have"some issues" regarding the system. He itemized several concerns including: the system was not connected to the fire alarm system (un-monitored), no water flow alarm bell, an inspectors test valve was plugged and could not flow water, there is scale in the system, a bunch of sprinkler heads have been recalled and must be replaced, etc. The thrust of Mr. Bailey's comments were that numerous expensive fixes were in order before they would feel comfortable in certifying the system. (Possibly Shilo Sprinkler reached the same conclusions and Hope's Door said no to the repairs?) Since this project is on a constrained budget, this dilemma could jeopardize them receiving certification of the fire sprinkler system. That would place the CFD in the position of denying them to open for business - unless, and until, they fix the fire sprinkler system problems. Because this is a "good cause" project to serve the community, it casts us (CFD) in the position of being the spoiler if we do not allow them to open. Since the city is already under attack from a handful of dissidents who believe the city is too harsh on new businesses, this could be more ammo for that camp. I want to get this out in the open, ahead of any potential critical news articles slamming the CFD and the City for not allowing a battered women's shelter to open its doors. This could get real messy. I am waiting for a written report on what is wrong with the system from Viking Sprinkler. They, too, are concerned about liability if they certify a marginal system. It is then my intention to call an administrative meeting with all the stakeholders to identify the problems and discuss solutions. This would involve setting priorities and timelines for compliance such that we MAY be able to phase in the some of the improvements to spread out the economic impact on the project. However, I have reservations about doing that in this situation. Here is why . . . The reality is that battered women's shelters are not a revenue producing venue. They need large and constant infusions of donated funds and grant money to stay in business. Therefore they are often forced to seek out older (but affordable) buildings, that may not be code compliant, in which to set up shop (as is the case here). They often have very tight budgets with few funds for capital improvements and/or safety considerations. For the record, I am very hesitant to approve phased improvements. Too often such facilities will seek endless"extensions" in which to complete the safety work, because they usually don't have the money to do the work. This places the City and the fire department in the difficult and very unpopular position of shutting down the facility for non-compliance-AFTER they are allowed to"conditionally" open and operate. Can you imagine the public outcry of putting dozens of battered women and their kids out on the street in the middle of winter??? I just wanted to give everyone a "heads up"on this situation which doesn't seem to be getting much better. This was one of the potentially high cost items they needed to provide. I also just received the revised plans for the fire alarm system which are now waiting their second plan review, to verify corrections and issue approval. This was the other high cost item they needed to bring up to code. This will be expedited. The last time I was out there (March 18) they still had not posted an address on the building. I allowed Brenda to have people there on that date for about three hours for the Chamber's After Hours function. I served as "fire watch" during that time. While I was there Brenda related something to me about having to change their address, because the City (Mr. Hasson) was requiring it. But when I asked Steve about this he said that was bogus. They have made some progress but still have numerous items to finish. I have concerns over their proposed fencing arrangement, especially the vehicle access gates. The plans for this aspect keep changing, so I need to review what she finally submits and will then comment accordingly. Like Darrell, I'm just waiting to be asked to do a final inspection . . . whenever. He stated that Brenda Cameron has yet to call in for a final inspection. He noted that she is aware of the need for the final inspection and that she cannot open her doors to business until this is handled. I called Brenda Cameron to get an update on her progress. She stated they are working to meet the conditions as stated in the Order of Decision. She asked if they needed a building permit to install a fence on the site. I stated that they will not need a building permit, however, we would like to see a diagram as to the location of the fence before installation. She confirmed that she would bring in such a diagram. She stated that her proposed date for completion of the conditions would be approximately mid-May and she would then contact the Building Department for an inspection. They passed everything on their list, that is until we got down to the last item - backup power supply to the exit lights and emergency area lighting. First, what was labeled as main breaker did not shut off the power. After tripping a half a dozen switches the power finally shut off. (They have been advised to fix this and clearly label "which" switch really is the main breaker for their building). With the power off it was discovered that none of the illuminated exit signs had battery back-up power to them. Also, over 80% of the battery back-up emergency area light units failed to operate. It is possible this may be attributable to recent storm-induced power outages that may have drawn down the old batteries, to a point where they could not be recharged. These lighting problems are serious life safety issues and must be corrected to get CFD approval on their C of O. Brenda is aware of this and is working to fix the problem. I also inspected their new fence line, per Darrell's request (and P&Z's issue), which has been installed along both the canal and around the play area. They had a couple of problems on the ends of the fence where the fencing transitions back onto their property, but they are working on fixing those. I also told them they should clear the foot-tall dead grass from both sides of their fence line so an errant bottlerocket on the 4th doesn't burn up their new wood fence. I've told Brenda to call me back as soon as they have the lights working properly. Dan Romero of their Board of Directors accompanied Brenda and I on the inspection. I understand that they have an open house scheduled for next week and would like to secure the C of 0 prior to this date. In talking with Brenda, she stated that the Fire Marshall is scheduled to inspect the property on Tuesday, June 29, at 9:00 a.m. Is it possible that the Building Department could inspect at the same time? The only issue that the P&Z Department would have is the fence. I previously gave this information to Darrell concerning the location of the fence (they have installed it already). As some of you may already be aware, there is a potential problem arising regarding the Hope's Door Shelter at 720 N. 16th Avenue. The CFD has been contacted by Mountain Alarm Company advising us that Hope's Door has failed to make a sizeable payment for the fire alarm system work they performed in order for Hope's Door to open a couple of months ago. Mountain Alarm advised us that they have contacted Ms. Brenda Cameron at Hope's Door and that they intend to remove their alarm equipment from that facility next Tuesday, Sept. 14 if the bill is not settled. According to Mountain Alarm this is apparently after numerous attempts by them to secure payment and assurances from Ms. Cameron that the bill would be paid. That is Mountain Alarm's side of the story, I have yet to discuss this with Ms. Cameron, though I have heard from a Board Member of Hope's Door that this is a matter of civil litigation between Hope's Door and Mountain Alarm over billing. Attorneys are involved and legal remedies will no doubt eventually be forthcoming. However, if the fire alarm system equipment is removed or the system rendered inoperative, then Hope's Door would no longer be in compliance with the CFD's conditions of approval for that facility and would be in violation of Caldwell Municipal Code, Section 8-13, which adopts the International Fire Code statutes pertaining to fire alarm system requirements. I am hopeful that this matter will be resolved before next Tuesday. However, if it is not, it potentially places us as a fire department (and a city) in the unenviable position of closing down a shelter for abused spouses and their children.
