At the request of the Planning and Zoning Department, SUP-281-06 is being inspected
to verify compliance with conditions. Relevant conditions are as follows:
8.6. A building permit or change in use permit shall be
obtained within 12 months from the date of signing the
Order of Decision or the Applicant, or future assigns having
an interest in the subject property, shall request a six-month
extension from the Community Development Director. No
further extensions shall be granted. Any new uses at the
site are subject to the appropriate City agency review.
8.11. The Applicant shall obtain a sign permit prior to installing any
sign at the site in accordance with Section 10-02-06 of
Caldwell Zoning Ordinance No. 1451.
8.12. External lighting shall not reflect onto adjacent property.
8.13. The applicant shall secure the facility with a six (6)-foot
privacy fence along the interior property lines designated on
the site plan.
Upon further investigation, it was found that in January of 2008, Bart Swanson
conducted an investigation to verify compliance with the conditions of the special use
permit. After a drawn out process with City agencies to review a change in use permit
application, Mr. Swanson observed that the subject location did not have any evidence
of business activity being conducted and property appeared to be vacant.

Failure to comply with conditions set forth in issued and approved Special
Use Permit No. SUP-281-06 relating to the conversion of a dwelling into an
office in a R-2 Combined Residential Zone. Inspect for compliance

No record of a Certificate of Occupancy, Change in occupancy Permit, or
technical permits associated with the project. SWA

Site Inspection was conducted (Photos 01 & 02). Contact was made with
subject business owner Don Ingram. He was advised of the Certificate of
Occupancy, Change in occupancy Permit violation and other SUP
observed non-compliance conditions and he would be receiving a related
Notice of Violation stipulating required corrective action. I was later
advised by Planning Staff, that the business location and related activities
are no longer subject to the SUP. The location was re-zoned from
residential to a City Center Zone which allows for the business without a
SUP. A Certificate of Occupancy is still required. Don Ingram was advised
of such by Planning Staff. SWA

A check was made with the Building Safety Department and it was found
that there has been no application for a Certificate of Occupancy. A Notice
of Violation was issued directing that the Certificate of Occupancy be
obtained on or before 04-01-2008. SWA

Per Planning & Zoning staff, a Change in Use permit application (Permit
No. BC-08-689) was submitted by Don Ingram. Case will be monitored for
compliance. SWA

approvals have been received from Engineering, Fire, and Planning &
Zoning. Building Plan Review is still pending. The Pre C of 0 review from

I contacted the Building Department and was advised that required
information from the business owner to complete the Building Plan Review
was not submitted. I conducted a site inspection at the subject location and
did not find any evidence that any related business is being conducted out
of the structure. There was no one there and it appeared vacant. No
evidence of a violation. CASE CLOSED SWA

Dear Mr. Ingram:
Our last letter was May 29, 2007 and we have not received a response concerning the conditions
attached to your Special Use Permit. Incidentally, these conditions are standards within the City
Zoning Ordinance irrespective of the Special Use Permit.
In the case of your Safe Start Driver's Education office there remain the following list of tasks to be
performed.
1. An Occupancy Permit is required and may be applied for at the City Building Department. This
triggers inspections of the structure by the building officials and the fire department to determine
specific code issues applicable to buildings where the public has access. These usually are in relation
to safety concerns and will also cover handicap issues.
2. The proposed r ear parking lot and driveway need to be hard surfaced.
3. Privacy fencing is required where the automobile parking and movement will otherwise be
exposed to adjacent residential structures.
Please undertake the required improvements and let us know you have finished the requirements by
filing a Building Department Change of Occupancy form. If you have questions please contact me or

Dear Mr. Ingram:
This office has been doing "catch-up" on communication to various of our customers on outstanding
matters that were attached to their Special Use Permit.
In the case of your Safe Start Driver's Education office there remain the following list of tasks to be
performed.
1. Before occupying the building, Caldwell requires that an "Occupancy" permit be applied for through
the City Building Department. This triggers inspections of the structure by the building officials and the
fire department to determine specific code issues applicable to your building. These usually are in

parking lot as shown on the site plan in order to meet the requirements of the Zoning Ordinance, Section
10-02-05 OFF-STREET PARKING AND LOADING STANDARDS AND REQUIREMENTS.
