HomeMy WebLinkAboutORD 3042BILL NO. 16 ORDINANCE NO. 3042 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE M-1 (LIGHT INDUSTRIAL) ZONE AND A -D (AIRPORT DISTRICT); DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN -16-03 (East Caldwell Annexation) at a public hearing held March 21, 2016. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as M-1 (Light Industrial) and A -D ( Airport District): A -D Zone Reference Statutory Warranty Deed Instrument No. 200649399 A portion of the SW '/ SE'/ and the SE'/ SE % of Section 25, Township 4 North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, more particularly described as follows: BEGINNING at the SE corner of the SW '/a SE % (East 1116`h corner) of said Section 25; thence North 00°38'18" East, 170.94 feet coincident with the east line of said SW'/a SE'/ of Section 25; thence North 44°16'18" West, 537.25 feet; thence South 45°43'42" West, 60.00 feel; thence North 44016'18" West, 1121.29 feet to the north line of said SW % SE 1/4 of Section 25; thence South 89°36'14" West, 28.85 feet coincident with said north line of the SW '/a SE % of Section 25 to the east line of Srneed Parkway; thence South 00°40'26" West, 621.55 feet coincident with the east line of said Srneed Parkway; thence South 44° 16'16" East, 975.71 feet to the south line of said SW '/ SE 1/4 of Section 25; thence North 89°36'47" East, 553.89 feet coincident with said south line of the SW '/ SE '/ of Section 25 to the POINT OF BEGINNING. Said parcel contains 15.76 acres, more or less. M-1 Zone Reference Warranty Deed Instrument No. 2014040413 A portion of the SE % SE '/ of Section 25, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho more particularly described as follows: BEGINNING at the SW corner of said SE '/ SE % of Section 25; thence North 004'40" East, 436.00 feet along the west line of the said SE '/ SE '/ of Section 25; thence North 89"02'40" East, 400 feet parallel with the south line of said SE '/ SE '/ of Section 25; thence South 0"04 '40" West, 436.00 feet parallel SCOAL ED with said west line of the SE'/ SE'/ of Section 25 to said South line; thence South 89002'40"' West, 400 feet along said south line to the POINT OF BEGINNING. Said parcel contains 4.00 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as M-1 (Light Industrial) and A -D (Airport District). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215.
