BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, Canyon County, State of Idaho: Section I. "T"hat pursuant to the authority set forth in Idaho Code § 50-318 and in the Caldwell City Code at § 05-07-08(2), and upon the request of the Caldwell Mapping Department, that certain right-of- way known as "Muller f,ane" from N. Florida Avenue tel Aviation Way, a portion of which is shown on the plat of Montecito park No, 3, recorded in Canyon C.OlLulty, Idaho as Instrument No. 200606389 in Book 37 of Plats at Page 15, and "Muller Road" cast of Aviation Way, as shown on the plat 1'(.)r Voyage Crossing Subdivision No. 1, recorded in Canyon County, Idaho as Instrument No. 2016004947 in Book 45 of Plats at Page 4, shall be changed to "Muller Drive" in order to comply with the preferences set forth in Caldwell City Code § 05-07-04(3). Section 2: Notice to all affected parties will be mailed out after passage of this ordinance and by March 25, 2016, with an effective date oflune 24, 2016. Section 3: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes oftlic ordinance before the declaration of partial invalidity. Section 4: All ordinances, resolutions. orders and parts thereof in conflict herewith are repealed, rescinded and annulled. When Phase 3 of Montecito Park was platted in 2006, the east end of Mul ter L,ane was re-routed around a future commercial property and along the southern border of said Phase 3 where it now intersects Aviation. Way. Recently, Voyage Crossing was platted and extended Muller further to the east, but listed the suffix of Muller as "Road". According to Section 05-07-04(3) of the Caldwell City Code, a "Lane" is a street suffix designated for a "private street not dedicated to or rnaintained by the city", while a "Road" is defined as a "designated street which extends through both urban and rural areas". Since "M(,,Jl.l.,ER" is mairitained by the City and does not extend through rural areas, it is proposed to change the suffix to "Drive", which is defined as a "street generally meandering is an cast -west direction".
