I have previously spoken to Mr. Bitner concerning the obtaining of an alcohol beverage license with the City of
Caldwell. He would apply for a license through my office and the State of Idaho.
In talking with the State Alcohol Beverage Control Office today, there usually is NOT a difficulty in obtaining a
State License for indoor sales of wine if the applicant passes the protocol; however, the representative did share
with me that the applications for downtown "patio" sales are reviewed by the Lieutenant on a case-by-case
basis. She shared with me that they have had some denials in the downtown Boise area when the request
concerning the patio sales are on "sidewalks" or public areas which are owned entirely by the City.
She suggested that Mr. Bitner and City Staff make an appointment with the ABC Lieutenant for a review of the
site in question and be working hand-in-hand with them simultaneously to working with the City of Caldwell. I
would like to be included in this onsite- meeting as well if you and Mr. Bitner pursue this avenue.

General Notes:
This is a complicated plan review from the standpoint that we are not dealing with a
single, stand-alone building. This building, known as 217 S. Kimball Ave., shares a
property line with an adjoining building at 215 S. Kimball Ave. There appears to be some
kind of wall between the two buildings, except that it has partially penetrated and opened
up between the buildings. For the sake of calculating the fire area, the open area of both
buildings must be counted under such circumstances to determine fire flow.

Both buildings currently are considered B occupancies. Both have what appears to be a
"shared" art gallery, while 215 S. Kimball Ave. also has a small tax preparation area in it,
which is most likely an accessory use, yet is still considered a B occupancy group.
The Applicants have indicated that they desire to have an occupant load in excess of 50
persons for the added use of wine tasting, although the exact occupant load is to be
determined by the Building Official.
The occupant load plays a major factor in determining specific requirements for these
two buildings (215 and 217 S. Kimball Ave.) because they are "co joined" by nature of
the opening between them. Caution must be taken by those responsible for the building,
by lease or by ownership, to ensure that the posted occupant loads do not exceed the
numbers established by the Building Official and signage posted per the CFD's
requirements.
Itemized Conditions of Approval:
Premises Identification—(IFC Sec. 505)
1. This particular building will continue having an address of 217 S. Kimball Ave.
2. The numbers 217 shall be posted in the front of the building facing Kimball Avenue.
The address numbers shall be a minimum of six inches (6") tall and must contrast
distinctly against the background. They must be clearly visible and distinguishable.
3. It is highly recommended that the address be illuminated to enhance visibility of it
during hours of darkness.
4. If there are any rear doors to the building they shall have the appropriate address(es)
posted on it in four-inch tall numbers for the areas which those doors serve.
Access—(IFC Sec. 503, 504 and 506,Appendix D)
1. Access roadways are generally adequate as provided. These consist of public streets
and alleyways. A degree of access to the front of the building may be challenging due to
diagonal on-street parking in front of the business. No tables, chairs or benches are
allowed on the sidewalk in front of the building that would impede ingress or egress from
within the building.
2. A CFD approved Key Box is highly recommended for this building but is not required.
If used, it must be located near the main entrance. The key box shall be mounted in a
visible and accessible location six (6') feet above grade level. The key box will contain
two complete sets of keys, properly labeled, for all exterior doors to the building. (If a
key box is desired, then it is the Applicant's responsibility to obtain the application form
for the box from the CFD Fire Marshal, to order and to install the box.)

Water Supply and Hydrants—(IFC Section 508 and Appendix B and C)
1. This building has adequate existing fire hydrants nearby that should provide most of
the minimum required water supply of 1,500 GPM for a two-hour flow duration.
Fire Protection Systems—(IFC Chapter 9)
1. A NFPA 13 compliant automatic fire sprinkler system is highly recommended but is
not required for this occupancy, as currently proposed for the uses stated.
2. A NFPA 72 compliant fire alarm system is highly recommended, as a means for early
notification of a potential fire condition, but is not required for this building as currently
proposed for the uses stated.
Fire Extinguishers—(IFC Sec. 906)
1. Fire extinguisher(s) are required for this building. Extinguishers shall be of a
2A:10BC rating (5# ABC). One extinguisher shall be installed upstairs in the mezzanine
area. A second extinguisher shall be installed downstairs, preferably near the front door.
2. Fire extinguishers must be mounted between 3' and 5' above floor level in a visible
and readily accessible location. If their visibility is obstructed or reduced, then signage
indicating their location shall be located above them.
General Fire Safety and Miscellaneous Conditions:
1. Exits, aisles, exit signage and emergency illumination shall comply with all applicable
provisions within the IBC (and the IFC) as specified in Chapter 10: Means of Egress.
2. Any fire and life safety systems and/or components are subject to field-testing to
ensure proper installation and operation.
3. The Occupant Load for this building must be posted in a conspicuous place near the
main exit doorway. (NOTE: The CFD will provide the occupant load certificate to the
Applicant who shall install it in a suitable picture frame and mount it near the main
entrance in plain sight.)
If in doubt about any fire or life safety considerations, please contact the CFD for a
consultation and review of the situation for a ruling and/or determination of options.
Any modifications or changes from the approved plans and these itemized
conditions of approval will require further review and approval of the Fire Marshal.
New conditions or requirements may be imposed as the result of any changes. All
conditions noted in this plan review pertain to this project, to and through its
completion and intended use.

Upon or nearing completion of construction, a Final Inspection is required. The
CFD will approve and sign the certificate of occupancy only upon full compliance,
or mutually agreed upon mitigation, regarding any and all correction items.
