TO: Caldwell Planning and Zoning Commission
This letter is regarding Case No. SUP-355-12 a request by Raquel
Reyes to exceed the maximum number of two allowed roosters on
property located at 4808 NezPerce Rd., Caldwell, Idaho. I live within
300 feet of Ms. Reyes and her chickens. These chickens are fighting
chickens and it is my understanding that it is against the law to fight
chickens. It is also my understanding that Ms. Reyes sells these
chickens.
In the summertime we spend a lot of time outside on our porch.
These chickens are very invasive of our peace and quiet.
Sometimes you can't hear the person sitting across from you
because of the noise from the chickens.
When we bought this place, there was a Declaration of Restrictions
that said "no commercial chicken yard or similar facility be
maintained thereon and no more than three animals of one category
may be maintained there on." It goes on to say, " No grantee of any
lot will use such lot in a manner which will result in any pollution or
putrification of the air, ground on or adjacent to the lot nor in any
manner resulting in any similar public nuisance."
Ms. Reyes has many more chickens than three and they make an
awful lot of noise, smell really bad and look worse.
I hope that you will not allow this business to continue.
Sincerely,
Marlene Fullerton
