HomeMy WebLinkAboutORD 3044BILL No. 18 ORDINANCE No. 3044 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING CHAPTER 12, ARTICLES 1, 5, 7, AND 13, SO AS TO PROVIDE THAT THE BUILDING OFFICIAL MAY REVOKE PERMITS ISSUED IN ERROR OR FOR OTHER CAUSE, AND PROVIDING CLARITY AS TO THE DEFINITION OF A "REGISTERED DESIGN PROFESSIONAL," AS THAT TERM. IS USED IN THE VARIOUS INTERNATIONAL CODES ADOPTED UNDER CHAPTER 12, AND PROVIDING FOR EXCEPTIONS WHERE PREPARATION OF CONSTRUCTION DOCUMENTS BY A REGISTERED DESIGN PROFESSIONAL IS NOT REQUIRED; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. NOW,THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon., State of Idaho: Section 1: That Chapter 12, Article 01, Section 12-01-15, of the Caldwell City Code, pertaining to permit requirements tinder the International Building, International Residential and International Energy Conservation Codes, is hereby amended by the addition of a new subsection (5), relating to the revocation of permits, as follows: 12-01-15: PERMIT REQUIREMENTS; PERMIT REVOCATION: L5L The buildin:r official r77a revoke an ermit issued in error an c rmit issued cin the basis of incorrect information or upon learninaf' work which has been performed in violation of this code or ;my other law c>fthe state of Idaho. Section 2: That Chapter 12, Article 01, Section 12-01-21, of the Caldwell City Code, pertaining to amendments to the International Building, International Residential and International Energy Conservation Codes, is hereby amended by the addition of two new definitions, clarifying the meaning of the phrase "Registered Design Professional," and by the enumerated amendment to IBC Section 10T regarding "Submittal Documents," as follows: 12-01-21: AMENDMENTS TO THE INTERNATIONAL BUILDING CODE, INTERNATIONAL RESIDENTIAL CODE, AND INTER- NATIONAL ENERGY CONSERVATION CODE: SCANNED PAGE - I IBC Section 202, definition for "Registered Design Professional," is amended to read as follows: An individual who is registered or licensed to practice their respective design profession as defined by the statutory requirements of the professional registration laws of the state of Idaho. For purposes of this definition, the term "design profession" shall be limited to the practices of architecture and engineering. IRC Section R202, definition for "Registered Design Professional," is amended to read as follows: An individual who is registered or licensed to practice their respective design profession as defined by the statutory requirements of the professional registration laws of the state of Idaho. For purposes of this definition, the term "design profession" shall be limited to the practices of architecture and engineering. IBC Section 107.1. Submittal documents. Submittal documents consisting_of construction documents, statement of special inspections, geotechnical report and other data shall be submitted in two or more sets with each permit application. The construction documents shall be prepared by a rggistered design professional as defined in this code (§12-01-21). Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional. Exceptions: The following may be exempt from the requirements above depending on the exact nature of the work, subject to the building official's authority to require additional construction documents to be prepared by registered design professional where special conditions exist: 1. Tenant Improvements, change in use/occupancy, and alterations less than 1,500 square feet and not exceeding two (2) stories in height, involving. a B, M, S1, S2, F1, and F2 occupancy classification, excluding F1 occupancies used for the manufacturing of furniture and woodworking facilities, and occupancies storing flammable and/or combustible materials. 2. Minor Interior non-structural remodels less than 2,500 square feet involving a B, M, A, S1, S2, F1, F2, I, and R occupancy group. 3. Group R-3 and U occupancies not exceeding three (3) stories in height. 4. Wood pole structures not exceeding 1000 square feet, 10' max. Bent Spacing and/or a 10' eave height. 5. Group R dwelling units not exceeding two (2) units. PAGE - 2 Section 2: That Chapter 12, Article 05, Section 12-05-05, of the Caldwell City Code, pertaining to permit requirements for work governed by the Idaho State Plumbing Code, is hereby amended by the addition of a new subsection (3), relating to the revocation of permits, as follows: 12-05-05: PERMIT FEES; PERMIT REVOCATION: (3) The building official may revoke any hermit issued in error, any permit issued on the basis of incorrect information or upon learning of work which has been performed in violation of this code or any other law of the state of Idaho Upon revocation the permit holder shall cease all work until such time that a new permit has been issued or written notification of reactivation of the nullified permit has been received. Section 3: That Chapter 12, Article 07, Section 12-07-07, of the Caldwell City Code, pertaining to permit requirements for work governed by the National Electrical Code, is hereby amended by the addition of a new subsection (3), relating to the revocation of permits, as follows: 12-07-07: PERMIT FEES; PERMIT REVOCATION: (3) The building official may revoke any permit issued in error, any permit issued on the basis of incorrect information or upon learning of work which has been performed in violation of this code or any other law of the state of Idaho Upon revocation the permit holder shall cease all work until such time that a new permit has been issued or written notification of reactivation of the nullified permit has been received. Section 4: That Chapter 12, Article 13, Section 12-13-02, of the Caldwell City Code, pertaining to amendments to the International Mechanical Code and International Fuel Gas Code, is hereby amended by the addition of two new definitions, clarifying the meaning of the phrase "Registered Design Professional," as that phrase is used in said codes, as follows: IMC Section 202, definition for "Registered Design Professional," is amended to read as follows: An individual who is registered or licensed to practice their respective desmon profession as defined by the statutory requirements of the professional registration laws of the state of Idaho. For pumoses of this definition the term "design profession" shall be limited to the practices of PAGE - 3 architecture and engineering, IMC Section 903 "Factory Built Fireplaces" add new section to read as follows: Section 903-4 Provisions for mitigating indoor air pollutants emitted by unvented gas fireplaces. Unvented gas fireplaces shall not be permitted without the installation of a supplemental whole -house ventilation strategy, which will serve to provide a non -passive outside air source to the living space during the time of fireplace operation. Such a strategy may be provided through the installation of an approved air-to-air heat exchanger, or an engineered ventilation system designed to mitigate those combustion by-products emitted by the unvented gas burning appliance. IFGC Section 202, definition for "Registered Design Professional," is amended to read as follows: An individual who is registered or licensed to practice their rejective design profession as defined by the statutory requirements of the professional registration laws of the state of Idaho. For purposes of this definition the term "design profession" shall be limited to the practices of architecture and engineering. Section 5: That Chapter 12, Article 13, Section 12-13-06, of the Caldwell City Code, pertaining to permit requirements for work governed by the International Mechanical Code and/or International Fuel Gas Code, is hereby amended by the addition of a new subsection (3), relating to the revocation of permits, as follows: 12-13-06: PERMIT FEES; PERMIT REVOCATION: (3) The building_ official may revoke any permit issued in error, any permit issued on the basis of incorrect information or upon learning of work which has been performed in violation of this code or any other law of the state of Idaho Upon revocation the permit holder shall cease all work until such time that a new permit has been issued or written notification of reactivation of the nullified permit has been received. Section 6: This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 7: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall PAGE - 4 continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Sections 1 through 5: Amends Chapter 12, Articles 1, 5, 7, and 13, so as to provide that the building official may revoke permits issued under the various building codes in error or for other cause, clarifies the definition of a "registered design professional," and provides for exceptions where preparation of construction documents by a registered design professional is not required. Sections 6 through 8: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and orders. Ordinance No. 3044 provides an effective date, which shall be on the 14th day of March, 2016. Ordinance No. 3044 was passed by the Council and approved by the Mayor on the 7th day of March, 2016.
