BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, Canyon County, State of Idaho: Section 1: That pursuant to the authority set forth in Idaho Code § 50-318 and in the Caldwell City Code at § 05-07-08(2), and upon the request of the Caldwell Mapping Department, that certain right-of- way ight-ofway platted as "Cocoa Beach. Way" in Sawgrass Village Subdivision No. 1, recorded in Canyon County, Idaho as Instrument No. 2008020311 in Book 41 of Plats at Page 27, shall be changed to "Cocoa Beach Street" in order to comply with the preferences set forth in Caldwell City Code § 05-07-04(3). Section 2: Since the platted lots that would utilize "Cocoa Beach" as their address are not yet developed, the effective date of this change shall be immediate upon passage of this ordinance. Section 3: This ordinance is hereby declared to be severable. if any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4: All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed, rescinded and annulled. U vU e°i 102 DI►I to]7:19111110 To: Mayor Nancolas and Members of Council From: Have Marston, Mapping Superintendent RE: Change the Official Street Name Suffix for Cocoa Beach from Way to Street Hate: January 18, 2016 Requested Action: Approve the attached ordinance The right-of-way known as "COCOA BEACH" as shown on the official plat for Sawgrass Village Subdivision No. 1 has the suffix of "WAY". However, according to Section 05-07-04(3) of the Caldwell City Code, a "WAY" is a street suffix designated for a "street generally meandering in a north -south direction", while a "STREET" is defined as an "east -west street generally running in a straight line". Since "COCOA BEACH" is a straight line east -west street, the street suffix should be officially changed to the suffix of "STREET". No address changes are required since the lots that would utilize "COCOA BEACH" (Lots 3 & 4, Block 7) for access have not yet been developed.. Staff recommends approval of the attached Ordinance.
