ORDINANCE NO.3021
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 12, ARTICLE 1, SECTION 12-01-01 OF THE CALDWELL CITY CODE BY
IMPLEMENTING ADDITIONAL AMENDMENTS TO THE INTERNATIONAL
BUILDING,RESIDENTIAL AND ENERGY CONSERVATION CODES,AS REQUIRED
BY STATE LAW; PROVIDING FOR AN EFFECTIVE DATE OF JANUARY 1, 2016;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES,
RESOLUTIONS,ORDERS AND PARTS THEREOF,IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of
Canyon, State of Idaho:
Section 1. That Chapter 12, Article 1, Section 12-01-21, of the Caldwell City Code,
relating to the adoption of Amendments to the International Building Code, International
Residential Code and International Energy Conservation Code, as per the requirements of Idaho
Code and IDAPA § 07.03.01.004.01,be amended as follows:
12-01-21: AMENDMENTS TO THE INTERNATIONAL BUILDING
CODE, INTERNATIONAL RESIDENTIAL CODE, AND
INTERNATIONAL ENERGY CONSERVATION CODE:
Delete exception No. 1 contained under IRC Section R101.2, "Scope".
Delete exception No 2 contained under IRC Section R101.2, "Scone," and
replace with the following; Owner-occupied lodaing houses with five(5)or fewer
guestrooms shall be permitted to be constructed in accordance with the
International Residential Code for One-and Two-family Dwellings.

IRC Section R302.6, "Dwelling/Garage Fire Separation" is amended to read as
follows: The private garage shall be separated from the residence and its attic area by means of
minimum 518 inch type X gypsum board applied to garage side.
Delete IRC Section R303.4 and replace with the following: R303.4 Mechanical
Ventilation. Dwelling units shall be provided with whole-house mechanical ventilation in
accordance with Section M1507.3.
IMC Section M1507.3.1 System Design. Add the followinp, to the end of the section:
Outdoor air shall be ducted predominantly horizontal to avoid chimney effect. Outdoor air ducts
will contain an accessible back draft damper and be designed to have an open cross section of
tweet 20 square inches er one thousand 1 000 scivare feet of conditioned s pace,

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.3021
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER
12, ARTICLE 1, SECTION 12-01-01 OF THE CALDWELL CITY CODE BY ADOPTING
ADDITIONAL AMENDMENTS TO THE INTERNATIONAL BUILDING, INTERNATIONAL
RESIDENTIAL AND INTERNATIONAL ENERGY CONSERVATION CODES,AS REQUIRED
BY STATE LAW; PROVIDING FOR AN EFFECTIVE DATE OF JANUARY 1, 2016;
PROVIDING FOR SEVERABILITY;AND REPEALING ALL ORDINANCES,RESOLUTIONS,
ORDERS AND PARTS THEREOF,IN CONFLICT HEREWITH.
Section 1: Amends Chapter 12,Article 1, Section 12-01-01 of the Caldwell City Code, so as to adopt
additional amendments to the international Building Code, International Residential Code and
International Energy Conservation Code, as per the requirements of Idaho Code and IDAPA §
07.03.01.004.01.
Sections 2 through 4:Provides that this ordinance shall be in full force and effect from and after January
1,2016,provides for severability,and repeals conflicting ordinances,resolutions and orders.
Ordinance No.3020 provides an effective date,which shall be January 1,2016. Ordinance No. 3021 was
passed by the Council and approved by the Mayor on the 16d'day of November,2015. The full text of
the Ordinance is available at Caldwell City Hall, 621 E. Cleveland Blvd.,Caldwell, Idaho 53605. The
Mayor and City Council approved the foregoing summary on the 16'h day of November, 2015, for
publication on the 23`d day of November,2015,pursuant to Idaho Code 50-901 A.
