REGULAR MEETING
November 2,2015
7:00 P.M.
Mayor Nancolas welcomed those in attendance. Pastor Phil Whitbeck,Associate Pastor of the Deer Flat Free
Methodist Church provided the invocation.The Mayor led the audience in the Pledge of Allegiance to the Flag.
The Roll of the City Council was called by the City Clerk with the following members present:Callsen,Pollard,
Biggers,Feucht,Ozuna,and Hopper.
CONFLICT OF INTEREST DECLARATION
None.
SPECIAL PRESENTATIONS
The Mayor acknowledged Cheryl Adams,American Government teacher at Caldwell High School. Each
of the students in attendance stood and introduced themselves.
The Mayor encouraged everyone to vote in the General Election tomorrow,November 3rd. He stated that
registration is available at the polls if needed.
ADDITIONS OR DELETIONS TO THE AGENDA
MOVED by Hopper, SECONDED by Biggers to amend the agenda by moving Item 911 from under the
Consent Calendar to New Business as part of the Finance Report.

AUDIENCE PARTICIPATION
Cynthia Ripke-Kutsagoitz,322 W.Logan Street,Apt. 103,presented articles and information for Council
to review concerning promoting growth and development in Caldwell.
CONSENT CALENDAR:
1. Approve acceptance of the minutes of the Regular City Council Meeting held on October 19,
2015;the Youth Master Plan Committee Meeting held on August 25,2015 and the Indian Creek
Plaza Committee Meeting held on October 13,2015;
2. Approve acceptance of the 2016 Planning & Zoning Commission and Hearing Examiner
Meeting Calendar;
3. Approve acceptance of the 2016 City Council Meeting Calendar;
4. Approve the Order of Decision for Case No.ZON-15-06(Giuliani Rezone);
5. Approve the Order of Decision for Case No.SUB-15-F04(Castle Peak No.3 Final Plat);
6. Approve Resolution No. 178-15 authorizing the purchase of a new Jacobsen 9016 area mower
for the Parks Department from RMT Equipment in the amount of$79,995 through the National
Joint Powers Alliance Association;
7. Approve Resolution No. 179-15 authorizing the purchase of a breathing air compressor for the
Fire Department in the amount of$18,958.65 from North West Fire Equipment,Inc.;
8. Approve Resolution No. 180-15 awarding the construction contract for a parking lot located at
406 Main Street to Precision Grading in the amount of$40,778.38 with the use of impact fees.
9. Approve Resolution No. 181-15 accepting the Third Restated and Amended Joint Powers
Agreement and Articles of Reformation and Organization of the Community Planning
Association of Southwest Idaho(COMPASS);
10. Approve request to change the City of Caldwell contact information for the Idaho Local
Government Investment Pool to Carol Mitchell,Caldwell Deputy Treasurer;
11. Approve request from the Finance Department to advance$110,000 to the Golf Fund from the
General Fund for activity period of February 2015 — September 2015. [Moved to New
Business-Finance Report]

NO.ANN-15-03(VOYAGE CROSSING ANNEXATION)WITH A REQUEST TO WAIVE THE
RULES, PASS ON THE FIRST READING. [THIS ACTION IS TAKEN TO CORRECT A
TYPOGRAPHICAL ERROR IN THE ORIGINAL ORDINANCE APPROVED JUNE 19 2015])
The Mayor read the ordinance by title only:
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO,AND THAT
BOOK 56 PAGE 134
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL,IDAHO,AS PART OF THE
R-2(MEDIUM DENSITY RESIDENTIAL)ZONE;DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,CANYON
COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING
DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL,
IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN
CONFLICT HEREWITH;AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A
CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH

NEW BUSINESS
(CONSIDER DECISION REGARDING THE APPEAL TO THE "INTENT OF ABATEMENT
NOTICE" FROM THE CALDWELL PLANNING & ZONING DEPARTMENT CONCERNING
THE REMOVAL OF TREES/SHRUBBERY LOCATED WITHIN THE VISION TRIANGLE FOR
THE PROPERTY LOCATED AT 814 TRAILSIDE DRIVE, CALDWELL, IDAHO. THE CITY
COUNCIL SHALL AFFIRM,WITHDRAW,OR MODIFY THE ORDER TO ABATE)
The Mayor explained the appeal process concerning staff's determination regarding a code enforcement
case.
Jarom Wagoner,Code Enforcement Department at 621 Cleveland Blvd.,acknowledged being sworn in and
provided the staff report. He explained the code enforcement process and the nature of the complaint
concerning obstructing the vision triangle at 814 Trailside Drive. The proper process had been followed
concerning notification of the abatement process.
NOTE: The appellant had requested a translator for her native Polish language. Technical difficulties
occurred with attempting to connect with the translator via phone.
MOVED by Pollard,SECONDED by Feucht to continue the public hearing to November 16,2015 at 7:00
p.m.directing the City Clerk to find an on-site translator who can interpret in Polish for the appellant.

(PUBLIC HEARING [LEGISLATIVE]: CASE NO. OA-15-04: A REQUEST BY THE CITY OF
CALDWELL PLANNING AND ZONING DEPARTMENT TO AMEND PORTIONS OF
CHAPTER 10,THE ZONING ORDINANCE,OF CITY CODE)
Jarom Wagoner,621 Cleveland Blvd.,provided the staff report and outlined the contents of the proposed
ordinance.
In response to questions from Councilman Feucht, Mr. Wagoner responded that a twenty-five foot
landscape buffer area would be required along principal arterial roadways.
Discussion followed concerning provisions of multiple signage at commercial sites.
MOVED by Pollard,SECONDED by Hopper to continue the public hearing to the next City Council to be
held on November 16,2015 with consideration of tonight's comments made by City Council.

IRRIGATION DISTRICT AND TO GENERAL PUBLIC AND PRIVATE DEVELOPMENT WITH

THE RULES, PASS ON THE FIRST READING, AND APPROVE THE SUMMARY FOR
PUBLICATION)
Brent Orton, 621 Cleveland Blvd., provided the staff report and outlined the contents of the ordinance
noting that the amendments are mandated by the State of Idaho.
Aaron Seable noted that page#2 was inadvertently excluded in the agenda packet.

held on November 16,2015.

(FINANCE AND HUMAN RESOURCE REPORTS)
(REQUEST FROM THE FINANCE DEPARTMENT TO ADVANCE$110,000 TO THE GOLF
FUND FROM THE GENERAL FUND FOR ACTIVITY PERIOD OF FEBRUARY 2015 —
SEPTEMBER 2015)
E1Jay Waite, Caldwell Finance Director at 411 Blaine Street, presented information concerning the
request to advance$110,000 to the Golf Fund from the General Fund. Mr.Waite noted that golf pass
sales have decreased.
MOVED by Feucht,SECONDED by Hopper to approve the transfer of funds as requested.

Councilman Biggers reported that the Finance Committee has reviewed current accounts payable in the
amount of $473,939.35 for the period ending October 28, 2015 and net payroll in the amount of
$357,573.32 for the longevity pay on October 16,2015 and pay period ended October 17,2015.
MOVED by Biggers, SECONDED by Callsen that accounts payable in the amount of $473,939.35
represented by check numbers 112547 through 112705 and payroll for the total amount of$357,573.32
represented by check numbers 28935 through 29049 and payroll direct deposits, be accepted, payment
approved,and vouchers filed in the office of the City Clerk.

(COUNCIL COMMENTS)
Everyone was encouraged to vote.
Councilman Feucht brought an update concerning the"No Shave November"campaign for cancer awareness.
Councilman Biggers provided an update concerning the remodeling of Veterans Memorial Hall and results of
Home Depot personnel on site with materials on October 29 and 30 due to a recent grant award. The Veterans
Day Memorial Service will be held at the site on November 11 th at 11:00 p.m.

(MAYOR'S COMMENTS)
The Mayor reported that the Canyon County on Aging Agency is looking to possibly relocate within the Sky
Ranch Business Park.
Appreciation was expressed to Caldwell Policy Department for the successful Halloween Party at O'Connor
Event Center held on October 30th. Total attendance was approximately 1,200 children and over 2,000 with
adults and children.
The Idaho Legislative session will begin soon. A legislative issue from the City of Caldwell will be proposed
concerning inactive cemetery deeds which have been on file for over 50 years old. Aaron Seable noted that he
recently presented to the AIC Legislative Committee concerning this matter and the proposed legislation was
unanimously supported by the board.
The Mayor and members of the Mayors Youth Advisory Council will be attending National League of Cities
Conference in Nashville,Tennessee this week.

The Mayor provided a report concerning a recent offer received for the golf surplus property(Machen property
site)of$10,000 per surveyed acre. E1Jay Waite commented that he has been in discussion with the potential
buyers. Details are still be researched concerning a necessary access road. A meeting will be set up with staff
and the prospective buyers to work out the details.
