HomeMy WebLinkAboutORD 3013 BILL No. ORDINANCE No. 301 AN ORDINANCE DETERMININ THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS of THE CITY of CALDWELL, COUNTY of CANYON, STATE of IDAHO, AND THAT SAID LANDS SHOULD BE REZONED ONED To THE M-1, {LIGHT INDUSTRIAL)iAL) Z DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST of THE CITY of CALDI ELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR To AMEND SAID PROPERTY TY oN THE OFFICIAL MAPS of THE CITY of CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, O DERS OR PARTS THEREOF iN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL of THE CITY of CALDWELL, COUNTY of CANYON, STATE of IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. -1 -0 5 (315 N 5ch Ave Rezone) at a public hearing held, September 15, 2015. Section 2. Tine parcel is within tine City of Caldwell, Idaho and tine applicant has requested that said following described property should be rezoned to -1 (Light Industrial)zone: parcel that is a portion of the SE 1 N W 1/4 of Section 22, Township 4 [North, Flange 3 Vilest, Boise Meridian, Canyon Counter, Idaho, being more particularly described as follows: Lots 13, 14, & 15 in Block "B" of Golden Gate Addition to Caldwell, Canyon Counter, Idaho, according to the official plat thereof, filed in Book 2 of Plats at Page 78, of said counter AND Lot 13, Block "B" of Caldwell, Idaho, according to the revised map filed in Book 1 of Plats at Page 20, records of Canyon Counter, Idaho. The above panel contains 0.21 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldweli, Idaho as M-1 (Light Industrial . Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approvai and publication, according to laver. A parcel that is a portion of the SE Y4 NW , of Section 22, Township 4 North, Flange 3 Invest, Boise Meridian, Canyon County, Idaho, being more particularly described as follows- Lots 133 14P & 15 in Block °Bu of Golden Gate Adoption to Caldwell, Canyon County, Idaho, according to the official plat thereof, filed in Book 2 of Plats at Page 78, of said county AND Lot 13, Block 'Dp of Caldwell, Idaho, according to the revised map filed in Book 1 of Plats at Page 20, records of Canyon County, Idaho. The above parcel contains 0.21 acres, more or less. The ordinance includes a provision to amend the official maps of the City by designating the above- described property as M-1 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 281x'day of September M5, Ordinance No. 3013 was passed by the Council and approved by the Mayor on the 2151 day of September 2015.
