HomeMy WebLinkAbout2015-07-20 City Council Minutes BOOK 56 PAGE 90 SPECIAL MEETING CITY COUNCIL WORKSHOP July 20,2015 6:00 p.m. (DISCUSSION CONCERNING THE MARKETING PLAN FOR DESTINATION CALDWELL AND RECEIVE A REPORT FROM THE DOWNTOWN PLAZA TASK FORCE CONCERNING THE PLAZA RESEARCH TRIP TO RAPID CITY,SOUTH DAKOTA) Keri-Smith Sigman presented information concerning the recent trip by members of the Destination Caldwell and Plaza Task Force to Rapid City, South Dakota to view their downtown plaza operation. Rapid City is 70,000 in population and spent approximately$7 million to build the downtown plaza in 2011. Ms.Sigman emphasized the need for community participation with this process as well as the City and/or Urban Renewal investing in the project. Destination Caldwell and the Downtown Plaza Task Force requested that City Council officially designate the site of the former Kings building as the plaza location. The workshop dismissed at 7:00 p.m. No decisions were made or action taken. REGULAR MEETING July 20,2015 7:00 P.M. The Mayor welcomed those in attendance. Pastor Freddie Lane of the Caldwell Christian Center provided the invocation. The Mayor led the audience in the Pledge of Allegiance to the Flag. The Roll of the City Council was called by the City Clerk with the following members present:Callsen,Pollard, Biggers,Feucht,Ozuna,and Hopper(via phone). CONFLICT OF INTEREST DECLARATION None. SPECIAL PRESENTATIONS None. ADDITIONS OR DELETIONS TO THE AGENDA MOVED by Callsen,SECONDED by Biggers to amend the agenda by adding an Executive Session pursuant to Idaho Code, Section 74-206, Subsection (a) for the purpose of discussing the hiring of a public officer, employee,staff member or individual agent. MOTION CARRIED AUDIENCE PARTICIPATION None. CONSENT CALENDAR: 1. Approve acceptance of the minutes of the Regular City Council Meeting held on July 6, 2015;the Special City Council Meetings held on July 7,2015 and July 14,2015;the Caldwell Pathways and Bike Routes Committee Meeting held on April 28,2015;the Library Board Meeting held on June 4, 2015; the Traffic Commission meeting held on July 6, 2015; and the Hearing Examiner Meeting held on June 9,2015; 2. Approve Resolution No. 114-15 authorizing the execution of the Consent to Use Agreement with the U.S. Department of Interior —Bureau of Reclamation for the purpose of suspending fiber optic conduit casings in and across the Notus Canal/Linden Road Bridge located approximately 75'west of Aviation Way; 3. Approve Resolution No. 115-15 authorizing the acceptance of a Deferral Agreement for public improvement construction with Guadalupe J. Rivas at property frontage located 510 and 512 Oak Street; 4. Approve Resolution No. 116-15 ratifying the execution of the Memorandum of Understanding between the City of Caldwell, City of Nampa, and Canyon County for the 2015 Byrne Justice Assistance Grant(JAG)Program CFDA#16.738; 5. Approve Resolution No.113-15 authorizing the execution of a Lessor's Consent Estoppel Certificate and Agreement with Tabor Construction,Inc.and Idaho Mutual Trust for 5515 Aviation Way,9904 and 9914 at the Caldwell Industrial Airport; 6. Approve Resolution No. 117-15 authorizing the execution of the School Resource Officer Contract with the Caldwell School District for FY-2015-16; 7. Approve request from Caldwell Grocery Outlet for a Beer&Wine License for the business located at 4907 Cleveland Blvd.; 8. Approve a Resolution No. 118-15 authorizing a contract with Garland Roofing for replacement of the Carnegie Library/Veterans Memorial Hall Roof, 9. Approve Resolution No. 119-15 increasing Sanitation Fees pursuant to the Republic Services Contract to offset fuel tax increases and legislative actions reducing benefits to fuel efficient vehicles effective retroactively to July 1,2015. Those voting no: none. MOTION CARRIED OLD BUSINESS (CONTINUED: PUBLIC HEARING [QUASI-JUDICIAL]: CASE NUMBER ANN-15-02 A REQUEST BY THE IDAHO CONFERENCE OF SEVENTH-DAY ADVENTISTS, INC. FOR ANNEXATION OF APPROXIMATELY 42 ACRES INTO THE CITY OF CALDWELL WITH A ZONING DESIGNATION OF H-C (HIGHWAY CORRIDOR) AND A DEVELOPMENT AGREEMENT FOR THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF MONTANA AVENUE AND HWY.55 IN CALDWELL,IDAHO) MOVED by Feucht, SECONDED by Pollard to continue the public hearing to the next Regularly Scheduled City Council Meeting to be held on August 3,2015 at 7:00 p.m. MOTION CARRIED NEW BUSINESS (PUBLIC HEARING AND AUCTION: REAL PROPERTY KNOWN AS 315 NORTH 5TH AVENUE WHICH WAS DECLARED AS SURPLUS PROPERTY BY THE CALDWELL CITY COUNCIL ON JUNE 239 2015 AND BEING PROPOSED FOR SALE IMMEDIATELY AFTER SAID HEARING AT THE OPENING BID PRICE OF $45,000 BASED ON COMPARABLE PROPERTY EVALUATIONS) The Mayor declared the public hearing and auction open.He stated that the property had been declared as surplus property several years ago,but in order to be transparent in such dealings,it was determined to again bring the item before City Council to clarify the intent of selling the parcel. The Mayor explained the public auction process for surplus property. No bids were received. He noted that City Council may choose to move forward with city staff considering alternate bids submitted to City Hall after the close of the public auction. MOVED by Callsen,SECONDED by Feucht to close the public hearing and auction. MOTION CARRIED MOVED by Ozuna,SECONDED by Biggers to direct staff to begin the negotiation process to dispose of the property located at 315 North 5th Avenue either through a realtor or City staff. MOTION CARRIED (PUBLIC HEARING AND AUCTION: REAL PROPERTY OF APPROXIMATELY 168 ACRES LOCATED NORTH OF CALDWELL OFF OLD HIGHWAY 30 NEAR PURPLE SAGE GOLF COURSE ON EL PASO ROAD, CALDWELL, HAS BEEN DECLARED BY THE CALDWELL CITY COUNCIL ON JUNE 239 2015 AS SURPLUS PROPERTY AND IS BEING PROPOSED FOR SALE IMMEDIATELY AFTER SAID HEARING AT THE OPENING BID PRICE OF $109000 PER ACRE OR$1,680,000 BASED ON COMPARABLE PROPERTY EVALUATIONS) The Mayor declared the public hearing and auction open. He stated that the property had been declared as surplus property several years ago,but in order to be transparent in such dealings,it was determined to again bring the item before City Council to clarify the intent of selling the parcel. He noted that part of the property is currently under contract and therefore that portion cannot be sold until the contract has been completed. THE REQUEST IS MADE TO CORRECT AN EASEMENT ENCROACHMENT OF THE HOME AT 13667 SLATE STONE WAY) BOOK 56 PAGE 92 The Mayor declared the public hearing open and explained the legislative hearing process. Brent Orton provided the staff report noting that there is a platted easement and the home was built was built over the easement. The proper notices have been made under Idaho Code Title 50,Chapter 13,to vacate the easement. After approval of the request,the subdivision plat will be amended and re-recorded. Staff recommends approval of the request. Scott Noriyuki,6810 Feirhill,Boise,testified in favor of the request. MOVED by Callsen,SECONDED by Biggers to close the public hearing. MOTION CARRIED (CONSIDER BILL NO. 24 (ORDINANCE NO. 3009) FOR VACATION OF THE GENERAL UTILITY EASEMENT TO CORRECT AN EASEMENT ENCROACHMENT AT 13667 SLATE STONE WAY WITH A REQUEST TO WAIVE AND RULES AND PASS ON THE FIRST READING) The Mayor read the ordinance by title only: AN ORDINANCE RECITING PETITION FOR VACATION OF GENERAL UTILITY EASEMENT AND RECITING APPROPRIATE NOTICE WAS GIVEN; DETERMINING THAT VACATION OF SAID GENERAL UTILITY EASEMENTS IN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO,DESCRIBED AS BELOW,SHALL BE MADE;AND DETERMINING THAT VACATION OF SAID FOLLOWING EASEMENTS ARE IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL,CANYON COUNTY,IDAHO. MOVED by Pollard,SECONDED by Feucht to waive the three reading process and consider Bill No. 24 (Ordinance No.3009)on its first reading by title only. MOTION CARRIED (FINANCE AND HUMAN RESOURCE REPORTS) Councilman Feucht reported that the Finance Committee has reviewed current accounts payable in the amount of$1,132,128.31 for the period ending July 8,2015 and net payroll in the amount of$296,712.41 for the pay period ended June 27,2015. MOVED by Feucht,SECONDED by Callsen that accounts payable in the amount of$1,132,128.31 represented by check numbers 110118 through 110358 and payroll for the total amount of$296,712.41, represented by check numbers 28516 through 28565 and payroll direct deposits,be accepted,payment approved,and vouchers filed in the office of the City Clerk. MOTION CARRIED (COUNCIL COMMENTS) Councilman Pollard reported that the "Blues on the Banks" event will be organized this year by The Boise Blues Society and will take place on August 14 at Stewarts Bar&Grill in Caldwell. On Saturday,August 29, "Sounds of Summer"(a fundraiser for Hope's Door)will take place at Stewarts Bar&Grill. Councilman Callsen and Councilwoman Ozuna expressed appreciation to Destination Caldwell for their presentation. Councilman Feucht expressed appreciation for the Destination Caldwell presentation. He also thanked the Appointed Officials and City staff for their work on the budget. Councilman Biggers reported that the Caldwell Veteran's Council sends a thank you to the City Engineer and Public Works Director for their help with the Caldwell Memorial Hall. (MAYOR'S COMMENTS) The Mayor expressed appreciation to those involved with the budget process and the extra time spent to prepare the document and attend additional public meetings for this purpose. The Mayor explained that the budget has increased this year due to a large project at the Caldwell Wastewater Treatment Plant. This project has been anticipated and will be paid for by cash rather than bonding for the improvements. The Mayor recently attended the Idaho E-911 Board meeting. Legislation will be presented this year to combine the E-911 Board and the Inoperability Board into one task force. BOOK 56 PAGE 93 The final report released from the Idaho State Police indicates that the crime rate for Caldwell is down again. Congratulations to the police department and our community for this accomplishment. TVCC Caldwell Campus Director Kathleen Robinson will be retiring this October. The recent Chamber of Commerce Noon-Break Luncheon was held at Memorial Park. This luncheon is sponsored by the City of Caldwell and used as a platform to present information about the budget. The Mayor attended the ground breaking for the new Terry Reilly Medical Center. The funeral for Marilyn Shaw(spouse of Pastor Dick Shaw of Caldwell First Baptist Church)was held on July 15th The Mayor will be attending the Annual ICRMP Executive Summit on July 22-24.
