May 12, 2015
11 Call to Order-- Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at
7:08 p.m.
Il. Review of Proceedings---F Mr.Jerome Mapp outlined the procedures for the public hearing.
Members Present: Jarom Wagoner (Senior Planner/Development Teary Leader); Brian Billingsley
(Planning Director);April Cabello (Planning Technician); and Robb MacDonald (City Engineer).
Members Absent: None.
III. Old Business:
A. Mr. Mapp approved the Minutes of the March 10, 2015 meeting as previously signed by
Hearing Examiner Mapp.
IV. New Business:
A. Case Number N-1 - 2 a request by akim t Properties, LLC to rezone 0.52 acres, more
or less, from R-3 (High Density Residential) to -1 (Neighborhood Commercial). The subject
property is located at 3611 S. 10"Avenue in Caldwell, Idaho.
Testimony:
1. Jar rn Wagoner,, Senior Planner/Development Team Leader, 621 Cleveland
Blvd., Caldwell, ID 83605, presented the staff report.
2. Mr. Wagoner stated that the applicant is seeking approval for a rezone from R-
(High Density Residential)to -1 (Neighborhood Commercial).
3. Mr. Wagoner stated that the subject property was part of a special-use permit
in 2001 to allow for the construction of a medical office building within are R-3
zone. The applicant hopes to have the zoning of the property reflect what the
actual use of the property is.
4. Tom C. Morris,, Applicant Representative, 12550 W. Explorer Drive, Suite 100,
Boise, 1D, 83713 gage supporting testimony and stated that the applicant is in
agreement with staff and the staff report. Mr. Morris wondered about
condition 8.4
5. Mr. Wagoner reviewed condition 8.4.
6. Mr. Mapp asked Mr. Morris if they accept condition 8.4.
7. Mr. Morris stated condition 8.4 is acceptable.

comprehensive plan analysis as listed in the staff report.
Findings of Fact for ON-15-0 (Rezone): The Hearing Examiner accepted the general facts as
utifned in the staff report, public testimony, and the evidence list.
Conclusions of Law for o1 -15- 2 (Rezone):The Hearing Examiner accepted the Conclusions of Lair
as outlined in the staff report.
RECOMMENDATION OMMEI DATIOf FOR ON-1 -o (Rezone):The Hearing Examiner RECOMMENDED OMMENDED than Case
Number ZON-15-02 BE APPROVED with conditions 8.2 through 8.4 as written.
B. Case Number ANN-15-03 SUB-I -P 1: A request by Mike Gregory/Hayden Homes to
annex 24.9 acres, more or less, with an R-2 (Medium Density Residential) zoning
designation, a Comprehensive Plan Map Change from Commercial to Medium Density
Residential, ar development agreement, and Preliminary Plat approval of voyage Crossing
Subdivision consisting of 24.9 acres, more or less, to be subdivided into 94 residential lots
and 10 common lots. The subject property is located on the east side of Aviation Way,, at
the intersection of Aviation Way and Vista Park Drive.
Testimony:
1. Jarom Wagoner, Senior Planner Development Team Leader, 621
Cleveland Blvd., Caldwell, ID 83605, presented the staff report.
2. Corinne Haase, Applicant Representative..832 Broadmore Way,
Nampa, 1D 83687,, gage supporting testimony and gave a P werPoint
presentation explaining the layout of subdivision and the history of the
builder. Ms. Haase requested to strike condition 12.19
3. John Carpenter, Applicant Representative, 332 N. Broady ore Way,
Nampa, ID 83687, provided supporting testimony.
4. M 1ke G rego ry,Applicant, 2636 S. Bla ckspur Way, Meridian, ID 88642
signed in favor of the application but did not wish to speak.
5. Dayana Gerdes, Po BOX 1356, Caldwell,, ID 83605, signed in neutral of
the application but stated after hearing the representative testimony
she is in support of the subdivision.
6. Nadine Ri h reek, 123 Middlepark Way, Caldwell, 11D 83605 signed in
neutral of the application but did not wish to speak.
7. Kellen Ri h reek, 123 Middlepark Way, Caldwell, ID 83605 signed in
neutral of the application but did not wish to speak.
8. Mr. Mapp expressed his concern regarding lots 8 and 9 needing to be
redesigned to meet setback and lot size requirement,and that a sign
shall be planed to identify the future Bight of Way on lot 32 block 2,
there should be pedestrian access to block 1 lot 11,the roadway needs
to be narrowed and temporary access.
9. Mr. Mapp further discussed with staff the current street side setback
code.

Comprehensive Plan Analysis for ANN-15-03 (Annexation): The Hearing Examiner accepted the
comprehensive plan analysis as listed in the staff report.
Findings of Fact for ANN-I5-03 (Annexation): The Hearing Examiner accepted the general facts as
outlined in the staff report, public testimony,and the evidence list.
Conclusions of Law for ANN-15- (Annexation): The Hearing Examiner accepted the Conclusions of Laver
as u'tlined in the.staff report.
RECOMMENDATION FOR ANN-15-03 (Annexation) AND COMPREHENSIVE PLAN MAP CHANGE: The
Hearing Examiner RECOMMENDED ELI IMENDED that Case Number r ANf -15- BE APPROVED with conditions: 8.
through 8.3.
Comprehensive Plan Analysis for SUB-15-P 1 (Subdivision): The Hearing Examiner iner accepted the
comprehensive plan analysis as listed in the staff report.
Findings of Fact for SUB-15-P 1 (Subdivision); The Hearing Examiner accepted the general facts as
outlined in the staff report, public testimony,, and the evidence list.
Conclusions of Law for SUB-15-POI (Subdivision): The Hearing Examiner accepted the Conclusions of
Law as outlined in the staff report.
RECOMMENDATION FOR SUB-15-POI (Subdivision): The Hearing Examiner RECOMMENDED DED that Case
Number r SUB-15-POI BE APPROVED with conditions: 12.2 through 12.20 as written and adding
conditions:
12.21 lots B and 9 need to be redesigned to meet the current setback requirement
12.22 block 2 lot 32 a signed shall be placed on site to identify future Fight of Way
12.28 provided pedestrian access to block 1 It 11
12.24 landscape plan
C. Case Number ZON-15-03 a request by Greg trikwerda/All Parts Broker's to rezone
2.5 acres, more or less,from - (Service Commercial) to -1 (Light Industrial) and a
Comprehensive Plan Map Change from mmer ial to industrial. The subject
property is located at the southwest rner of Blaine Street and 36 1n Avenue ire
Caldwell, Idaho.
Testimony:

2. Mr.wagoner stated that the applicant hopes to cpand his
wrecking/salvage yard located at 3607 Cleveland Boulevard onto the
site. A wrecking/salvage yard does require special-use permit approval
within the -1 (Light Industrial) zone.The subject property is floated
at 0 Cleveland Boulevard, located adjacent to the west of 8607
Cleveland Boulevard.
3. Mr. Mapp suggested adding a condition to comply with Pioneer
Irrigation.
4. Greg Strikwerda, Applicant, All Parts Brokers; 2818 S. Indiana Avenue,
Caldwell, ID 836 05 gage supporting testimony and explained that there
will be less entrances into the lot, only access will be from within.
5. Mr.Strikwerda stated that he spoke with Pioneer Irrigation and they
do not have easements as water has not been turned on at that
location since 1989.
6. Mr. Strikwerda further testified that he does not have funds to meet
the landscape conditions .6, 8.6 and 8.7.
7. Mr. Mapp suggest to Mr. Strikwerda to have an alternate landscape
plan reader to present at the City Council hearing.

comprehensive plan analysis as listed in the staff report.
Findings of Fart for ,1 -0 (Rezone): The Hearing Examiner accepted the general facts as
outlined in the staff report, public testimony,, and the evidence list.
Conclusions of Law for I -15-03 (Rezone): The Hearing Examiner accepted the Conclusions of Law
as outlined in the staff report.
RECOMMENDATION FOR -15- (Rezone):The Hearing Examiner iner RE MMES DED that Case
Number ZON-15-03 BE APPROVED with condition: 8.2 through 8.7 as written and add condition: 8.8
meet requirements of Pioneer Irrigation.
D. Case Number SUP-15-05 a request by Juan G a rcia/Los Po rta les N fight Club for a
special-use permit to operate a night club/event center within the C-3.(Se rvi e
Commercial) Zone. The subject property is located at 301 S. 'h Avenue in
Caldwell, Idaho.
Testimony:
1. Jarorn wagoner, Senior Planner/Development Team Leader, 621
Cleveland Blvd., Caldwell, ID 83605, presented the staff report.
2. Mr. Wagoner stated that the business will be open Thursday-Sunday,
and plans to rent the facility for special events as well.

3. Mr. Wagoner gave background on the subject property explaining that
the site is urrently a vacant building. In the past it was used as a
nightclub and a fitness club/gym.
4. Juan P. Garcia,Applicant, 4416 S. Idaho Avenue, Caldwell, Idaho,
83607, gave supporting testimony.
5. Mr. Clapp expressed his concern about egress, ingress and the Fire
Department not being able to get to the building.
6. Mr. Clapp was concerned that the applicant cannot meet the parking
requirement and should have had the parking requirement met and
mitten agreements from the property miners for off street parking on
the neighboring properties.
7. Mr. Klapp stated the applicant was required to have obtained these
requirements prior to the hearing.
B. Mr. Mapp continued Case Number SUP-15-05 to June 9,2015 at 7pm.
