AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 07, ARTICLE 11, SEC'T'ION 07-11-05, Y SETTING THE PENALTY FOR
FAILURE To ABATE A NUISANCE AS A MISDEMEANOR; PROVIDING FOR AN
EFFEC'T`IVE DATE; PROVIDING FOR SEVERAILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS,, ORDERS AND PAR'T'S THEREOF, IN CONFLICT
HEREWITH.
E IT ORDAINED by the Mayor and Council of the City of Caldwell, County of
Canyon, State of Idaho:
Section I. That Chapter 7, Article 11, Section 07-11-05, of the Caldwell City Code,
containing the penalty for failure to abate a nuisance, be amended to charge the failure as
misdemeanor as follows:
07-11-05: ABATEMENT of NUISANCES; PROCEDU S,
PENALTIES AND APPEALS:
(5) Criminal Penalties:
A �A"WVIA�; If, following notice of violation and order to abate,
any person allows the existence of a nuisance to continue, such person
shall be guilty of aft ;ffi ,. -,d *' a misdemeanor. Each and every day in
which any such violation continues may be deemed a separate offense.
Peace officers and code enforcement officers shall have the authofity to
issue 4.und,fmpki citations to violators of this section,

Section : This ordinance shall he in full force and effect fiom and after its passage,
approval, and publication, according to law.
Section 3: This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in fall force and effect and shall be read to carry out the purposes of the ordinance
before the declaration of partial invalidity.
Section : All ordinances, resolutions, orders and parts thereof in conflict herewith
are repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.3002
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER
07, ARTICLE 11, SECTION 07-11-05, BY SETTING THE PENALTY FOR FAILURE TO
ABATE A NUISANCE AS A MISDEMEANOR; PROVIDING IN FOR AN EFFECTIVE DATE;
PROVIDING FOR SEVERAIIILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH.
Section 1: Amends Chapter 7, Article 11, Section 7-11,05, by setting the criminal penalty for failure to
abate a nuisance as a rmsdcmean r.
Sections 2 through : Provides that this ordinance shall be in full force and effect from m rid after its
passage, approval, and publication, according to law; provides for severability; repeals conflicting
ordinances,resolutions, and orders.
Ordinance No. 3002 provides an effective elate, which shall be on the 22 d day of June, 2015. Ordinance
No. 3002 was passed by the Council and approved by the Mayor on the 15"'day of June, 2015. The full
tent of the Ordinance is available at Caldwell City Hail, 411 Blaine Street, Caldwell, Idaho 83605. The
Mayor and City Council approved the foregoing sumimary on the 15" day of June, 2015, for publication
on the 22nd day of June, 2015,pursuant to Idaho Code§ 50-901A.
