AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
CHAPTER 89 ARTICLE 39 SECTION 08-03-23, 1 PROHIBITING N OWNER OF AN
ANIMAL FROM DISTURBING THE PLACE of HIS NEIGHBORS; PROVIDING FOR

L IT ORDAINFD by the Mayor and Council of the City of Caldwell, County f
Canyon, State of Idaho
Section 1, That Chapter 8, Article 3, Section 08-03-23, of the Caldwell City Code,
relating to the prohibition of animals disturbing the peace, be amended as follows:
08-03-20 3.4 PROHIBITED ACTS:

(2) The Peace: It is unlawful for any owner of an animal to fall
to exercise reasonably necessary control of the animal to prevent it from
disturbing the peace aid quiet f thmew, , , .a any neighborhood, family or
person � Ong, � ir�in �� rr�a xng load �� unusu l noises, or by running on,
defecating in, Gigging in or otherwise damaging cultivated gardens or lawns that
are not the property of the owner, r causing unreasonable odor off the property
of the own r.
Section 2: This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section : This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared Invalid by a court of competent Jurisdiction, the remaining provisions shall
continue in fill force and effect and slral l be react to carry out the purposes of the ordinance
before the declaration of partial invalidity,
Section : All ordinances, resolutions, orders and parts thereof in conflict herewith
are repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE N .3001
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER
89 ARTICLE 31 SECTION - - , BY PROHIBITING AN OWNER of AN ANIMAL FROM
DISTURBING THE PEACE of HIS NEIGHBORS; PROVIDING FOR AN EFFECTIVE DA'I'S;
PROVIDING ]FOR SEFADILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PAR'E'S TIJEREOF9 IN CONFLICT HEREWITH.
Section 1: Ameiids Chapter 8, Article 3, Section 08-03-23, by prohibiting an owner of an animal from
disturbing the peace of Ills or tier neighbors.
Sections 2 through ; Provides that this ordinance shall be in full force and effect from and after its
passage, approval, and publieation, according to law; provides for several ility; repeals conflicting
ordinances, resolutions, and orders.
Ordinance No. Soo 1 Provides aii effective date, which shall be on the 15'h day of June, 2015. Ordinance
No. 3 001 was passed by the Counci t and approved by the Mayor-on the 15 1h day of, 2015. The full text of

and City Council approved the foregoing summary on the 15"' day of June, 2015, for publication on the
22,d day of June,201 , pursu ant to Idaho Code § 5 0-9 01 A.
