HomeMy WebLinkAboutORD 2994 BILL No, 9 ORDINANCE NO. 2994 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 07, ARTICLE 13, SECTION 07-13-04, BY PROHIBITING THE USE OF AIR COMPRESSION BRAKES (ALSO KNOWN AS "JAKE BRAKES"} WITHIN CITY LIMITS; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 7, Article 13, Section 07-13-04, of the Caldwell City Code, containing a prohibition against the use of loud amplification devices, be amended so as to also prohibit the use of air compression brakes, commonly known as jake brakes," as follows: 07-13-04: LOUD AMPLIFICATION DEVICES UPON OR WITHIN MOTOR VEHICLES PROHIBITED• AIR COMPRESSION BRAKES PROHIBITED: It shall be unlawful for any person to operate or permit the operation of any loud amplification device upon or within a motor vehicle in such a manner that the sound therefrom is plainly audible upon a public right of way or street at a distance of fifty feet(50') or more from the source of the sound. (2) AIR COMPRESSION BRAKES PROHIBITED. A. Prohibited: The use of air compression brakes(also commonly_ known as fake brakes") by motor vehicles within the city limits of the city of Caldwell is hereby prohibited-and shall be unlawful except under emergency circumstances where the use of air compression brakes is necessary to prevent an accident or injury to_persons or property B. Exemption: Motor vehicles owned and oyerated by fire department are specifically exempted from the prohibitions of this section. C. Penalty: Any who violates any y y on of this section shall be deemed guilty of an infraction and upon jud ment thereof shall be_subiect to the fixed penalty for moving_._traffic infractions set by the Idaho infractions rules 9(b)(5).
