AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (MEDIUM
DENSITY RESIDENTIAL) AND C-2 (COMMUNITY COMMERCIAL) ZONE; DECLARING SAID LANDS
BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND
ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL
TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED
WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION,
PURSUANT TO IDAHO CODE, SECTION 53-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell bearing Examiner, and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No.
1451, approved Case No. ANN-02-14 (Rodriguez Annexation) at a public hearing held January 13, 2015.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-2 (Medium Density
Residential) and C-2 (Community Commercial):
R-2 PARCEL
This parcel is a portion of Lot 2 and the adjacent east half of Lake Avenue right-of-way as shown on the
official plat of Deide Acres Subdivision in Book 18 of Plats at Page 33 on file in the office of the Recorder
for Canyon County, Idaho; said parcel lies in the SW % SW r4 of Section 1, Township 3 North, Range 3
West of the Boise Meridian and is more particularly described as follows:
COMMENCING at the NW corner of said Lot 2; thence South 00 002'22" East, 147.19 feet along the
westerly boundary of said Lot 2 to the POINT OF BEGINNING; thence North 88 054'52" East, 105 feet
parallel with the northerly boundary of said Lot 2; thence South 00 002'22" East 45.00 feet parallel with the
westerly boundary of said Lot 2; thence North 88054'52" East, 90.00 feet parallel with the northerly
boundary of said Lot 2; thence North 00°02'22" West 45.00 feet parallel with the westerly boundary of
said Lot 2; thence North 88°54'52" East 463.05 feet parallel with the northerly boundary of said Lot 2 to
the centerline of the Caldwell Lowline Canal (said centerline is also the easterly boundary of said Lot 2);
thence following said centerline southeasterly 157.69 feet along the arc of a curve to the right having a
central angle of 45°44'12", a radius of 193.32 feet, and a long chord which bears South 17°26'13" East,
153.36 feet to the SE corner of said Lot 2; thence South 88 054'52" West, 703.91 feet along the southerly
boundary of said Lot 2 to the SW corner of said Lot 2; thence continuing South 88 054'52" West, 40.01
feet to the centerline of Lake Avenue; thence North 00 002'22" West, 147.18 feet along said centerline of
Lake Avenue; thence North 88 054'52" East 40.01 feet to the POINT OF BEGINNING.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 2985
REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for annexation of a parcel of land to be annexed into the City of Caldwell
as R-2 (Medium Density Residential)and C-2 (Community Commercial) Zoning.
R-2 PARCEL
This parcel is a portion of Lot 2 and the adjacent east half of Lake Avenue right-of-way as shown
on the official plat of Deide Acres Subdivision in Book 18 of Plats at Page 33 on file in the Office
of the Recorder for Canyon County, Idaho; said parcel lies in the SW Y4 SW Y4 of Section 1,
Township 3 North, Range 3 West of the Boise Meridian and is more particularly described as
follows:
COMMENCING at the NW corner of said Lot 2; thence South 00°02'22" East, 147.19 feet along
the westerly boundary of said Lot 2 to the POINT OF BEGINNING; thence North 88 054'52" East,
105 feet parallel with the northerly boundary of said Lot 2; thence South 00°02'22" East 45.00
feet parallel with the westerly boundary of said Lot 2; thence North 88°54'52" East, 90.00 feet
parallel with the northerly boundary of said Lot 2; thence North 00'02'22" West 45.00 feet parallel
with the westerly boundary of said Lot 2; thence North 88°54'52" East 463.05 feet parallel with

C-2 PARCEL
This parcel is a portion of Lot 2 and the adjacent east half of Lake Avenue right-of-way as shown
on the official plat of Deide Acres Subdivision in Book 18 of Plats at Page 33 on file in the Office
of the Recorder for Canyon County, Idaho; said parcel lies in the SW % SW % of Section 1,
Township 3 North, Range 3 West of the Boise Meridian and is more particularly described as
follows:
BEGINNING at the NW corner of said Lot 2; thence North 88°54'52" East, 520.54 feet along the
northerly boundary of said Lot 2 to the NE corner of said Lot 2 and the centerline of the Caldwell
Lowline Canal (said centerline is also the easterly boundary of said Lot 2); thence following said
centerline as follows: South 43 038'54" East 190.00 feet; thence southeasterly 9.60 feet along the
arc of a curve to the right having a central angle of 2 050'35", a radius of 193.32 feet, and a long
chord which bears South 42 013'36" East, 9.60 feet; thence leaving said centerline of the Caldwell
Lowline Canal South 88 054'52" Vilest, 463.05 feet parallel with the northerly boundary of said Lot
2; thence South 00°02'22" East 45.00 feet parallel with the westerly boundary of said Lot 2;
thence South 88°54'52"West, 90.00 feet parallel with the northerly boundary of said Lot 2; thence
North 00°02'22" West 45.00 feet parallel with the westerly boundary of said Lot 2; thence South
88 054'52" West, 105 feet parallel with the northerly boundary of said Lot 2 to said westerly
boundary of Lot 2; thence continuing South 88°54'52" West, 40.01 feet to a point on the
centerline of Lake Avenue; thence North 00 002'22" West, 147.19 feet along said centerline of
Lake Avenue; thence North 88 054'52" East 40.01 feet to the POINT OF BEGINNING.
The above described parcels contain a total of 4.60 acres, more or less.
The ordinance includes a provision to amend the official maps of the City by designating the
above-described property as R-2 and C-2 and providing an effective date, which shall be when
published in the Idaho Press Tribune on the Stn of March 2015. Ordinance No. 2985 was passed
by the Council and approved by the Mayor on the 2nd day of March 2015. The full text of the
Ordinance is available at Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and
City Council approved the foregoing summary for publication pursuant to Idaho Code 50-901A on
the 2 nd day of March 2015.
