AN ORDINANCE ENACTED BY THE CALD FELL CITY COUNCIL AMENDING
CHAPTER 12, ARTICLE 1, SECTION 12-01-01 of THE C LDWELL CITY CODE,
RELATING To THE ADOPTION of THE 2012 INTERNATIONAL RE, L
AND ENERGY CONSERVATION CODES, REPEALING THE ADOPTION of
APPENDICES "A" THROUGH "G" To THE INTERNATIONAL RESIDENTIAL
CODE, FINDING GOOD CAUSE, RE,ADOPTING APPENDIX "G" To SAID
INTERNATIONAL RESIDENTIAL CODE, AND ADDING AN EXCEPTION To THE
REQUIREMENT EMENT of OBTAINING A BUILDING .PERMIT; PROVIDING FOR N
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES,' RESOLUTIONS, ORDERS AND PANTS THEREOF, IN CONFLICT
HEREWITH.

DE IT ORDAINED by the-Mayor -and Council of the City of Caldwell, County of }
Canyon, State of Idaho:
Section 1. That based on the report of the Consumer Product Safety Commission CPSC
and the world Health Organization, rational drowning statistics indicate that an average of 5,200
pool or spa-related submersion injuries occurred involving children younger than 15 years old
between 2009 and 2011, 45108 of those Being children under the age of 5 years old; that
approximately 1 of said injuries and % of similar fatalities between 2007 and 2009
involving children under the age of 15 occurred at a residence; that residential locations similarly
dominated incidents involving'victims of 5 years- of age or younger % for injuries and %
for fatalities); that approximately % of fatalities (averaging 226 annually) occurred in in-
grourid,pools, while poi-table pools accounted for only 10% of fatalities (averaging 40 annually)
to children younger than 15 years of age; that in 2011, an estimated 3 5 9,000 people died from
drowning, making it the second leading cause of unintentional injury death in children between
the ages of I and 14 years old; and, based on similar information available from the Center of
Disease Control and Prevention (CDC); and in an effort reduce risks to children living in the
vicinity of such pools, the City Council of the City of Caldwell does hereby find that good cause
exists, in accordance with Idaho Code § 3 9-4116(4)(b)5-for the adoption of Appendix G to the
International Residential Code, in that it,Nthrou h.its regulation of safety and barriers for above

f and below ground swimming pools, and through the enforcement and verification tion it requires for t
closure systems around pools, will aid in the prevention of said injuries and fatalities.
Section 2. That Chapter t2, Article 1, Sections 12-01-01 and 12-01-15, of the Caldwell
City Code, relating to the adoption of the International Building Code, International Residential
Code and the International Energy Conservation Code, and to permitting requirements
thereunder, be amended as follows:
1 - 1- 1. CODE ADOP'T`ION,
All the rules, regulations and ordinances of a general and permanent character
relating and applying to and regulating the erection, construction, enlargement,

alteration, repair, __moving, removal, conversion, demolition, occupancy,
equipment, use, height, area of buildings or structures as said rules, regulations
and ordinances are printed and contained in code book form designated and
entitled "2012 international building code" with amendments (IBC) as published
by the International Code Council; the " 2012 international residential ode"
parts I through VI and IX, including ppendi ee '', �, , r,, � LP AG, With
amendments II C as published by the' International Code Council; and the
r 11- 2012 international energy conservation code" with amendments IECC as
published by the International Code Council; be and the same hereby ratified and
adopted as the building cede and energy code of Caldwell city and as ratified and
adopted shall be the rules and regulations and ordinances governing the-erection,
construction, enlargement, alteration, repair, moving, removal, conversion,
demolition, occupancy, e quipment, height, and area of buildings or structures
within the city of Caldwell.
12-01-15: P RMIT REQUIREMENTS:
(1) Permit Required: The construction, alteration, repair, removal or
occupancy of any structure of lard, or any park thereof as provided or as restricted x
} in the,zoning regulations, shall not be commenced until after the issuance of
written permit by the building officiate, unless said construction, alteration, repair,
removal or occupancy, fad X completely within-one or more of the f l l
exceptions:
(a)F
No permit is required for a residential re-roof, where the new

layer of roof covering is not being applied over are existing layer or
multiple layers of roof covering. However, this exception shall not relieve
any such project from and other requirements of the law, including, but
not limited to, obtaining a certificate of appropriateness for projects
located within a local historic district, per the requirements of Section
02-17-09.

Section 3. This ordinance shall be in full force and effect from and after January 1, 2015.
,Section 4. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisioDs shall
continue in full force and effect and shall be read to carry out the purposes of the ordinance
before the declaration of partial invalidity.

Section 5. All 'ordinances, resolutions, orders and parts thereof in conflict herewith are
repealed.

AN ORDINANCE ENACTED Y THE CALDWE L CITY COUNCIL AMENDING

Sections'1 through : Finds good cause for the adoption of Appendix 6 to the International residential
Code ("'IRC"), repeals the adoption of Appendices A through G to the IRC, readopts Appendix G to the
IRC, pertaining to swimming pools, and sets forth an exception to the requirement to obtain a building
permit in -eases involving a residential re-goof T here the new roof will not he applied over an existing
layer or multiple layers of roof covering, while noting that other requiretxrents of the law, such.as the
obtaining of a certificate of appropriateness in a local historic district, still apply.

13 2015, provides for severabiIity, and repeals conflicting ordinances,resolutions and orders.
