BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL of THE CITY OF C LD IIELL, COUNTY of CANYON, STATE of IDAHO: Section 1, That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case N . N-04 � HG Lease Holdco at a public hearing held, September 1 , 2014. Section 2.The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to C=1 (Neighborhood ommercial) zone: A tract of land bring within the west %of the SW ' of Section 6, Township 3 North, Range 2 West,t, Boise Meridian, Canyon County, Idaho, more particularly described as follows: COMMENCING at the SW corner of said S ; thence North 017'18" East, 995.6 feet along the west line of said SW 1 to the POINT of BEGINNING; thence continuing North 0°17'18" East, 173.69 foot along said west line of the SW ' ; thence South 89°42'00" East, 1 26.24 feet; thence North 9 018'30" East, 126.00 feet; thence North 89'42'00" west, 125.26 feet to a point on said West line of the SW ' : thence North 00 17'18" East, 28.43 feet along said West line of the SW Y4 to the NW corner of Government Lot 7; thence North 9 018'41" East, 43.66 feet along the vest line of the NW it of said SW 1/4 of Section ; thence South 89063'00" East, 83.61 feet to a point on the southwesterly right-of-war of the ( loses Drain; thence along said southwesterly right-of-way as follows: South °00'00" East, 268.92 feet; thence southeasterly 97.98 feet along the arc of a curve to the right, said curve having a radius of 138.20 feet, a central angle of 40°36'00'x, and a chord bearing South 4 °42'rOO" East, 98.89 feet; theme South 26°24'00" East, 224.51 feet; thence leaving said southwesterly right-of-war North 89°85'00"vilest, 491.66 feet to the POINT of BEGINNING. Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
