Acting Chairperson Randolph called the meeting to order at approximately 6:10 p.m. 11. Roll Call Members Present. Chuck Randolph, Elaine Carpenter, Gina Lujack, Megan Dixon and Lorene Oates. Members Absent. De Etta L. Ewing and Steve Maughan. Others Present. Jarom Wagoner, Senior Planner; April Cabello, Planning Technician; and Rob Hopper, City Council Liaison. Others Absent. Brian Billingsley, Planning & Zoning Director. III. Approval of Minutes. MOTION TO APPROVE THE MINUTES OF SEPTEMBER 23, 2013. MOTION: Elaine C., SECOND: Megan D. MOTION PASSED. IV. Certificate of Appropriateness Interviews. A. Case Number CA- 183 -13 a request by Jack Verdine for a Certificate of Appropriateness to place a shed on his property. Testimony: April Cabello, Planning Technician, 621 Cleveland Blvd., Caldwell, ID 83605, explained that the applicant placed a shed on his property without first obtaining a Certificate of Appropriateness. The applicant has stated that he did not know or have any knowledge of city code and felt he could put a storage shed on his own property without malice. The applicant has agreed to move the shed out of the street side setback. He will paint the shed to help it blend in. The applicant wants to keep the shed and is willing to do whatever the commission requires of him to keep the shed. Jack Verdine, applicant, 1201 Cleveland Blvd., Caldwell, testified in favor of the application and stated the reason he purchased the shed is that he can no longer use his detached garage for storage. He needed a place to store his lawn mower, weed eater and yard supplies and when he purchased the shed, he did not realize his property was in the historical district. Gerard Shoults, applicant's representative, formally 1201 Cleveland Blvd., testified in favor of the application and explained that Mr. Verdine did not know or understand the laws and for Mr. Verdine to try to build the garage back, it would cost him as much or more than to buy the shed. He further shared that Mr. Verdine is willing to move the shed. Mr. Shoults further stated that Mr. Verdine asked the neighbor who shares half of the garage to help with the cost and Mr. Verdine will get the materials and do the work but the neighbor did not want to put in any money to fix the garage. CHPC Meeting, November 25, 2013 Page 1 Horatio Tellez, 1222 Blaine Street, Caldwell, testified in favor of the application and stated for the record that he does not have any problem with Mr. Verdine keeping the shed. Mr. Tennison, 2205 Linden St # 63, Caldwell, testified in favor of the application and stated he did not understand what the problem was, if it was the shed itself or a question of putting in an application. He also stated he was at the meeting to understand if a shed would be okay and what the rules and regulations were. Acting Chair Randolph stated for the record that no one signed up in opposition or neutral of this case. Acting Chair Randolph asked the commission if they had any questions of the applicant. Commissioner Lujack wondered how the shed would be moved. Mr. Verdine responded the company he bought the shed from would move the shed for a fee of $50.00. Commissioner Lujack wondered what the shed sat on. Mr. Verdine explained the shed sits on fence posts on each side. Commissioner Dixon wondered about the coloring of the shed. Mr. Verdine explained that he would paint the shed the same color as his house and paint the trim the same color as his house trim. Commissioner Carpenter wondered about the placement of the shed. Jarom Wagoner, Senior Planner, 621 Cleveland Blvd., stated the shed is under the 200 square feet requirement so the shed could go up to the fence line. Acting Chair Randolph confirmed with Mr. Verdine that he would move the further toward the alley and to the interior side yard. Mr. Verdine confirmed. Acting Chair Randolph closed the public hearing. Order of Decision for Case Number CA- 183 -13 MOTION: Commissioner Lujack SECOND: Commissioner Carpenter. The motion for APPROVAL was approved with unanimous roll call vote with the following conditions: 7.2 Applicant has until December 25, 2013 to move -the shed from the street side setback to the interior rear yard setback. 7.3 Applicant has until May 1, 2014 to paint the shed to match the color of his home. V. Audience Participation. None. VI. Actions Since Last Meeting. A. April C. reported on Case Number CA- 182 -13. Applicant: Randy & Elizabeth Lyons. Address: 1909 Fillmore Street, C of A was issued for re -roof. VII. Old Business. A. Chuck R. shared that the only action taken by the Historical Society was an open -ended grant with a remaining balance of $2,000.00. They had a deadline to use the funds by November 1, 2013. The Historical Society determined one of the things that needed done with the cabins and the railcars was a wiring upgrade. AME Electric, Jamie Winters the bidder on the prcject�came out and looked at what needed work. The caboose now has power feed and the refrigerator car received a power upgrade. SHPO suggested installing track lighting down the center log in the cabins, which is what is being done statewide. Work was grant paperwork was completed. B. Chuck R. stated for the record that item B. under old business discussion on CHPC Ordinance amendment be continued to January 13, 2014 meeting. C. Chuck R. stated for the record that item C. under old business discussion on Honorarium to Elaine Leppert be continued to January 13, 2014 meeting. VIII. New Business. A. Railroad Depot. Jarom Wagoner, Senior Planner reported that there are some issues with the rear outside stairwell of the Depot being used as a restroom. Because the structure is historical and before City Council makes a decision on what to do and how to enclose the opening, they wanted feedback or ideas from the Caldwell Historic Preservation Commission. The discussion continued on the location of the opening, what could be done and the fact that there are no restrooms downtown. Rob Hopper, City Council Liaison, stated that the bathrooms at TVCC that face the creek are supposed to be open but sometimes they are locked. The commission suggested removing the stairs and placing a manhole cover as well as having staff contact the State Historical Preservation Office for suggestions and ideas. IX. Commission & Staff Reports. A. April C. reported that the homeowner wanted to let the commission know that the work at 1716 Everett was complete. CHPC Meeting, November 25, 2013 Page 3 B. Acting Chair Randolph stated he wanted two concerns about the neighborhood on record. One concern is the fact that Jack Verdine had to apply for the C of A to keep his shed but other things and structures are built in the neighborhood, go unnoticed, and are only acted upon if the city receives a complaint. He stated his concerned that they are setting the commission up for a lawsuit. X. Meeting adjourned at approximately 7:35 p.m. For detailed minutes, please request a copy of the digital recording.
