HomeMy WebLinkAboutORD 2946-ABILL NO. 25 ORDINANCE NO. 2946 -A AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL., COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE R -2 (MEDIUM DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY_ OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and following the public notice and hearing procedures as required in Section 10- 03 -03, Caldwell Municipal Code, approved Case No. ZON -92 -13 (Castle Peak No 3 Prelim Plat and Rezone) at a public hearing held, December 16 ", 2013. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to R -2 (Medium Density Residential) zone: A parcel of land lying in the West'/ of the NE % of Section 32, Township 4 North, Range 2 West, Boise Meridian, Canyon County, Idaho, more particularly described as follows: Commencing at the Northwest corner of the NE '/ (North % Corner) of Section 32, Township 4 North, Range 2 West, Boise Meridian, Canyon County, Idaho; Thence South 00' 11'36" East, 1368.42 feet along the west line of said NE '/ to the Southwest corner of Castle Peak Subdivision No.2, the REAL POINT OF BEGINNING of this description; Along the boundary of Castle Peak Subdivision No. 2 the following: Thence North 89 °48'24" East 52.94 feet to a point; Thence North 89 °48'32" East 110.00 feet to a point; Thence North 00 0 11'28" West 6.73 feet to a point of curvature; Thence along a curve to the left 12.61 feet, said curve having a radius of 22.00 feet, a central angle of 32 0 49'51 ", a tangent of 6.48 feet and a chord which bears North 16 0 36'24" West, 12.43 feet to a point of reversed curvature; Thence along a curve to the right 125.07 feet, said curve having a radius of 50.00 feet, a central angle of 143 °19'07 ", a tangent of 150.83 feet and a chord which bears North 38 0 38'14" East, 94.92 feet to a point on a curve; Thence North 00 °11'28" West 25.97 feet to a point; Thence North 43 0 22'48" East 110.00 feet to a point; Thence South 46 0 37'12" East 1419.20 feet to a point; Leaving said boundary of Castle Peak Subdivision No. 2: Thence South 00 °16'36" East 505.40 feet along the East line of the West Y2 of the NE '/a to the Center - East 1116 Corner of said Section 32; Thence South 89 °47'22" West 1323.70 feet to the Center'/ Corner of said Section 32; Thence North 00 0 11'36" West 1285.78 feet along the West line of said NE % of Section 32 to the REAL POINT OF BEGINNING of this description, containing 32.59 acres, more or less. This description was compiled from data of record (plats of Castle Peak Subdivision No.1, Book 38, Page 9 and Castle Peak Subdivision No.2, Book 41, Page 14, Canyon County Records) and does not reflect a field survey by Westbound Surveying. Section 3, That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R -2 (Medium Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. This description contains 32.59 acres, more or less. The Ordinance includes a provision to amend the official maps of the City by designating the above - described property as R -2 and providing an effective date, which shall be when published in the Idaho Press Tribune on the 28 day of January 2014. Ordinance No. 2946 was passed by the Council and approved by the Mayor on the 16 day of December 2013.
