ORDINANCE NO. 2936
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD
BE REZONED TO THE R -2 (MEDIUM DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID
CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY,
IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND
SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures as required in Section 10- 03 -03,
Caldwell Municipal Code, approved Case No. ZON -88 -13 (Aspens #5 Rezone) at public hearings held
September 16, 2013, October 7, 2013 and October 21, 2013,
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be rezoned to R -2 (Medium Density Residential) zone:
A parcel of land situated in the S '/Z SW % of Section 2, Township 3 North, Range 3 West, Boise
Meridian, Canyon County, Idaho, being more particularly described as follows: BEGINNING at the South
% corner of Section 2; thence S89 °42'14 "W, 372.49 feet along the south line of the SW % of said Section
2; thence N42 °05'38 "E, 107.44 feet; thence N28 °17'36 "W, 92.97 feet; thence S89 0 42'53 "W, 664.93 feet;
thence N38 °26'51 "W, 82.14 feet; thence S68 °49'02 "W, 187.62 feet to the centerline of the Dixie Drain;
thence N20 0 25'39 "W, 400.73 feet along said centerline of the Dixie Drain to the SW corner of Aspen
Subdivision No. 4 (Book 39 of Plats at Page 4, records of Canyon County, Idaho); thence along the south
boundary of said Aspen Subdivision No. 4 as follows: N68 °30'01 "E, 162.69 feet; thence S73 0 51'27 "E,
70.62 feet; thence N68 °36'29 "E, 100.00 feet; thence S21 °23'31 "E, 28.47 feet; thence N54 °21'08 "E,
343.93 feet; thence S35 0 32'11 "E, 193.00 feet; thence N88 °16'55 "E, 120.28 feet; thence N54 0 07'00 "E,
162.06 feet; thence S89 0 28'42 "E, 106.97 feet; thence N00 °31'18 "E, 63.00 feet; thence S89 °28'42 "E,
100.02 feet; thence N45 0 56'56 "E, 78.61 feet; thence S89 °28'42 "E, 152.96 feet to the East line of said SW
% of Section 2; thence leaving said south boundary of Aspen Subdivision No. 4 S00 °31'07 "W, 834.77 feet
to the POINT OF BEGINNING.
The above - described parcel contains 17.10 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as R -2 (Medium Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
