ORDINANCE NO. 2941
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD
BE REZONED TO THE M -1 (LIGHT INDUSTRIAL) ZONE; DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10- 03 -03, Caldwell Municipal
Code, approved Case No. ZON -91 -13 (Dillon Caldwell Rezone & Special Use) at a public hearing held,
September 16, 2013.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be rezoned to M -1 (Light Industrial) zone:
COMMENCING at the West Quarter corner of Section 6, Township 3 North, Range 2 West of the Boise
Meridian, Canyon County, Idaho, and bearing
South 276 feet along the West boundary line of the aforesaid Section 6 to the intersection of the
Northeast boundary line of the Nampa - Caldwell Boulevard; thence
South 46 0 49'00" East 438.50 feet along the Northeast boundary line of the aforesaid
Boulevard to the REAL POINT OF BEGINNING; thence continuing
South 46 °49'00" East 292 feet along the Northeast boundary line of the Nampa - Caldwell
Boulevard; thence
North 43 0 11'00" East 500.70 feet; thence
North 66 0 49'00" West 310.70 feet; thence
South 43 0 11'00" West 394.40 feet to the REAL POINT OF BEGINNING.
EXCEPTING THEREFROM THE FOLLOWING:
A parcel of land being on the Northeasterly (Left) side of the centerline of Interstate 84, Business Loop,
(Nampa - Caldwell Boulevard), Project No. NH- F- M- 7963(021), Highway Survey, as shown on the plans
thereof now on rile in the office of the Idaho Transportation Department, and situated in Lot 6 of Section 6,
Township 3 North, Range 2 West, Boise Meridian, Canyon County, Idaho. Said parcel is a portion of that
certain tract described in Instrument No. 945449 dated April 1, 1982 and recorded April 27, 1982, and is
more particularly described as follows to wit:
Commencing at the West Quarter corner of said Section 6; thence
South 0 °26'26" West a distance of 322.33 feet on the West line of said Section 6 to a point on the
centerline of said project NH- F- M- 7963(021) at Station 206 +97.13; thence
South 46 °15'35" East a distance of 406.91 feet on said centerline to Station 211 +04.04 of said
Highway Survey:

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 2941
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for the rezone of a parcel of land in the City of Caldwell as M -1 (Light Industrial).

The Ordinance Includes a provision to amend the official maps of the City by designating the above -
described property as M -1 and providing an effective date, which shall be when published in the Idaho
Press Tribune on the 14 day of October 2013. Ordinance No. 2941 was passed by the Council and
approved by the Mayor on the 7th day of October 2013. The full text of the Ordinance is available at
Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the
foregoing summary for publication pursuant to Idaho Code 50 -901A on the 7 day of October 2013.
