July 9, 2013
I. Call to Order — Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at
7:00 p.m.
II. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for tonight's hearing.
Members Present: Brian Billingsley (Planning Director); April Cabello (Planning Technician)
Members Absent: Robb MacDonald (Assistant City Engineer)
III. Old Business:
A. Mr. Mapp approved the Minutes of the May 14, 2013 meeting as previously signed by
Hearing Examiner Mapp.
IV. New Business:
A. Case No. SUP - 359 -13 a request by Vision Charter School and Superior Signs for special use
permit approval to install a 48 electric sign with an electronic message center at property
addressed as 19231 Ward Road. (Con't from June 11, 2013 P & Z Public Hearing)
Testimony:
I. Brian Billingsley, Planning Director, 621 Cleveland Blvd., Caldwell, ID 83605,
presented the staff report as written and further noted the reason the reader
board requires a special use permit is to give the neighboring property owners
who might live near the school an opportunity to comment on how the reader
board could impact them. The applicant held a neighborhood meeting and has
alleviated any concerns that the neighboring property owners have and staff
recommends approval.
2. Erin Lair, applicant's representative, 19291 Ward Road, Caldwell, ID 83605,
testified in favor of the application and explained that the applicant, Wendy
OldenKamp had her annual board meeting tonight. Wendy shared with her
that one of the founding goals was to have involved and engaged
conversations with the community around the school. The reader board is a
way of bridging that gap of community communication.
3. Mr. Mapp confirmed with Erin Lair that she was the applicant's representative.
4. Mr. Mapp wondered about the neighborhood meeting and feedback.
5. Ms. Lair stated that a couple of concerns were brought up about whether or
not the reader board would be a distraction on Ward Road and the applicant
felt they alleviated that concern by explaining what would be put on the sign.
6. Mr. Mapp confirmed the location of the sign.
7. Dana Vance, Superior Signs, 812 Main Street, Caldwell, ID 83605, testified in
favor and stated she attended the neighborhood meeting to answer concerns.

Comprehensive Plan Analysis for SUP - 359 -13 (Special Use for an electronic reader board): Mr.
Mapp accepted the comprehensive plan analysis as listed in the staff report.
Findings of Fact for SUP- 359 -13 (Special Use for electronic reader board): The Hearing Examiner
accepted the general facts as outlined in the staff report, public testimony, and the evidence list.
Conclusions of Law for SUP - 359 -13 (Special Use for electronic reader board): The Hearing Examiner
accepted the Conclusions of Law as outlined in the staff report.
ORDER OF DECISION FOR SUP- 359 -13 (Special Use Permit for electronic reader board): The Hearing
Examiner ORDERED that Case Number SUP - 359 -13 IS APPROVED.
B. Case No. SUP- 360 -13 a request by J.R. Flores for special use permit approval for a tattoo
parlor in a C -2 Community Commercial zone located at 2408 Cleveland.
Testimony:
1. Brian Billingsley, Planning Director, 621 Cleveland Blvd., Caldwell, ID 83605,
presented the staff report as written and further noted the reason a tattoo
parlor is a special use in a C -2 Zone is to give surrounding business owners an
opportunity to comment, the applicant held a neighborhood meeting and
nobody attended.
2. J.R. Flores, applicant, 24282 Stateline Road, Parma, ID 83660, testified in favor
of the application and explained he would like to open his tattoo studio, a
professional, clean and safe establishment, Mr. Flores also stated that the
location has an amazing street front and felt his business will do well at that
location.
3. Mr. Mapp wondered if this was his first tattoo parlor or if he had owned
another shop.
4. Mr. Flores responded this is his first shop but has worked with other studios
and wants to start his own business at this location.
5. Mr. Mapp stated for the record that he noticed there are no requirements for
parking or landscaping.
6. Dana Vance, 812 Main Street, Caldwell, ID 83605, signed in favor of the
application but did not wish to speak.

the comprehensive plan analysis as listed in the staff report.
