May 28, 2013
1. Call to Order — Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at
7:04 p.m.
II. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for tonight's continued hearing
from May 14, 2013 noting that public testimony was closed and tonight's hearing was for Mr. Mapp
to deliver the findings of fact, conclusions of law, and recommendations on Case Number SUB- 02(P)-
13 ZON -86 -13 SUP - 358 -13.

Members Absent: Robb MacDonald (Assistant City Engineer); Brian Billingsley (Planning Director); April
Cabello (Planning Technician)
Ill. Old Business:
A. Mr. Mapp approved the Minutes of the May 14, 2013 meeting.
B. (continued) Case Number SUB- 02(P) -13 ZON -86 -13 SUP- 3S8 -13 a request by Caldwell 260
LLC, 2006 Investment Fund LLC, Mutual Benefit Investments LLC (MBI), Knife River, Dave
Turner, Tall Timber Consulting, and Dave Yorgason for the following: Comprehensive Plan
Map change from Low Density Residential to Residential Estates; Rezone from R -1 Low
Density Residential to R -S -1 Semi -Rural Residential 1 with temporary rezoning to M -2 Heavy
Industrial; Special Use Permit approval for an asphalt batch plant in an M -2 Heavy Industrial
zone; and preliminary plat approval of Waterstone Subdivision consisting of 72 residential
lots. The subject property is located at the northeast corner of Midland Road and Lincoln
Road with the Boise River being its northerly boundary.
1. Mr. Mapp began by reminding everyone that tonight's hearing was a continuation of the
May 14, 2013 hearing solely for delivery of the findings of fact, conclusions of law,
recommendations, and order of decision.
2. Mr. Mapp read the request into the record.
4. Mr. Mapp read highlights from the written findings of fact, conclusions of law,
recommendations, and order of decision that he had prepared for tonight's hearing and
labeled it as Exhibit A to become part of the official Recommendation /Order of Decision
document.
5. Mr. Mapp read into the record the conditions /concerns he was forwarding to City
Council for consideration which was also included as part of said Exhibit A.
Comprehensive Plan Analysis for ZON -86 -13 (Map Change and Rezone): Mr. Mapp accepted the
comprehensive plan analysis as listed in the staff report and included Exhibit A.
Findings of Fact for ZON -86 -13 (Map Change and Rezone): The Hearing Examiner accepted the
findings of fact. Exhibit A was included in the Findings of Fact.

Conclusions of Law for ZON -86 -13 (Map Change and Rezone): The Hearing Examiner accepted the
Conclusions of Law as outlined in the staff report.
RECOMMENDATION FOR ZON -86 -13 (Map Change and Rezone): The Hearing Examiner
RECOMMENDED that Case Number ZON -86 -13 BE DENIED and included Exhibit A as part of the
recommendation.
Comprehensive Plan Analysis for SUB- 02(P) -13 (Waterstone Preliminary Plat): Mr. Mapp accepted
the comprehensive plan analysis as listed in the staff report and included Exhibit A.
Findings of Fact for SUB- 02(P) -13 (Waterstone Preliminary Plat): The Hearing Examiner accepted
findings of fact. Exhibit A was included in the Findings of Fact.
Conclusions of Law for SUB -02(P) -13 (Waterstone Preliminary Plat): The Hearing Ua miner accepted
the Conclusions of Law as outlined in the staff report and included Exhibit A.
RECOMMENDATION FOR SUB- 02(P) -13 (Waterston Preliminary Plat): The Hearing Examiner
RECOMMENDED that Case Number SUB -02 P -13 BE DENIED and included Exhibit A as part of the
recommendation.
Comprehensive Plan Analysis for SUP- 358 -13 (Asphalt Batch Plant): Mr. Mapp accepted the
comprehensive plan analysis as listed in the staff report and included Exhibit A.
Findings of Fact for SUP - 358 -13 (Asphalt Batch Plant): The Hearing Examiner accepted findings of
fact. Exhibit A was included in the Findings of Fact.
Conclusions of Law for SUP- 358 -13 (Asphalt Batch Plant): The Hearing Examiner accepted the
Conclusions of Law as outlined in the staff report and included Exhibit A.
ORDER OF DECISION FOR SUP- 358 -13 (Asphalt Batch Plant): The Hearing Examiner ORDERED that
Case Number SUP- 358 -13 IS DENIED and included Exhibit A as part of the order of decision.
IV. Planning Issues —None.
V. Adjournment
The Hearing Examiner adjourned the meeting at approximately 7:58 p.m.
