AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL,COUNTY OF CANYON,STATE OF IDAHO,AND THAT SAID LANDS SHOULD
BE REZONED TO THE M-1 (LIGHT INDUSTRIAL)ZONE;DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,CANYON COUNTY,IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL,IDAHO;AND REPEALING ALL
ORDINANCES,RESOLUTIONS,ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED,BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,COUNTY OF
CANYON,STATE OF IDAHO:
Section 1.That the Caldwell City Council,upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10-03-03,Caldwell Municipal
Code,approved Case No.ZON-82-13 (Caldwell Project Rezone)at a public hearing held March 18,
2013.
Section 2.The parcel is contiguous to the City of Caldwell,Idaho and the applicant has requested that
said following described property should be rezoned to M-1 (Light Industrial)zone:
A part of the SW %NE %and the NW 1/4 SE V*of Section 25,T4N,R3W,BM being more particularly
described as follows:
COMMENCING at the SW corner of the SE V*(S V*corner)of Section 25;thence North 00°40'13"East,
1324.90 feet along the West line of the SW %SE 1/4 of Section 25 to the NW corner of the SW 1/4 SE %;
thence North 89°36'14"East,80.00 feet along the South line of the NW %SE %of Section 25 to the
POINT OF BEGINNING;thence continuing North 89°36'14"East,1242.46 feet along said South line of
the NW Va SE %to the SE corner of said NW %SE %;thence North 00°39'14"East,1284.73 feet along
the East line of said NW V*SE 1/4;thence South 89°36'38"West,322.03 feet to the beginning of a non-
tangent curve;thence 815.67 feet along the arc of said curve to the right,having a radius of 515.00 feet,a
central angle of 90°44l48<1,subtended by a chord bearing North 45801'00"West,733.05 feet;thence
North 00°21'05"East,27.55 feet to the beginning of a tangent curve;thence 640.03 feet along the arc of
said curve to the left,having a radius of 435.00 feet,a central angle of 84°18'04",subtended by a chord
bearing North 41°47*39"West,583.84 feet to a point on the easterly right-of-way line of S.Smeed
Parkway;thence South 00°41'2211 West,947.35 feet parallel with and 80.00 feet east of the West line of
the SW %NE %of Section 25 to a point on the North line of said NW %SE %; thence South 00°42'09"
West,1324.89 feet parallel with and 80.00 feet east of the West line of said NW 1/4 SE %to the POINT OF
BEGINNING.The above described property contains 45.98 acres,more or less.
Section 3.That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell,Idaho as M-1 (Light Industrial).
Section 4.All ordinances,resolutions,orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5.This ordinance shall be in full force and in effect from and after its passage,approval and
publication,according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO.2925
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for the rezone of a parcel of land in the City of Caldwell as M-1 (Light Industrial).
A part of the SW %NE Va and the NW %SE %of Section 25,T4N,R3W,BM being more particularly
described as follows:
COMMENCING at the SW corner of the SE Va <S %corner)of Section 25;thence North 00°40'13"East,
1324.90 feet along the West line of the SW V,SE Va of Section 25 to the NW corner of the SW %SE Vi;
thence North 89°36'14"East,80.00 feet along the South line of the NW V*SE Va of Section 25 to the
POINT OF BEGINNING;thence continuing North 89°36'14"East,1242.46 feet along said South line of
the NW Va SE Va to the SE corner of said NW Va SE Vi;thence North 00°39'14"East,1284.73 feet along
the East line of said NW Va SE V*\thence South 89°36'38"West,322.03 feet to the beginning of a non-
tangent curve;thence 815.67 feet along the arc of said curve to the right,having a radius of 515.00 feet,a
central angle of 90°44'48",subtended by a chord bearing North 45°01'00"West,733.05 feet;thence
North 00°21'05"East,27.55 feet to the beginning of a tangent curve;thence 640.03 feet along the arc of
said curve to the left,having a radius of 435.00 feet,a central angle of 84°18'0411,subtended by a chord
bearing North 41°47'39"West,583.84 feet to a point on the easterly right-of-way line of S.Smeed
Parkway;thence South 00°41'22"West,947.35 feet parallel with and 80.00 feet east of the West line of
the SW Va NE %of Section 25 to a point on the North line of said NW %SE %;thence South 00°42'09"
West,1324.89 feet parallel with and 80.00 feet east of the West line of said NW Y*SE Va to the POINT OF
BEGINNING.The above described property contains 45.98 acres,more or less.
The Ordinance includes a provision to amend the official maps of the City by designating the above-
described property as M-1 (Light Industrial)and providing an effective date,which shall be when
published in the Idaho Press Tribune on the 8m day of April 2013.Ordinance No.2925 was passed by
the Council and approved by the Mayor on the 181 day of April 2013.The full text of the Ordinance is

the foregoing summary for publication pursuant to Idaho Code 50-901Aon the 1st day of April 2013.
