The Mayor asked that everyone stand for the Pledge of Allegiance to the Flag, which was led by Cameron Preston, 17766 Mountain Springs Avenue, of Boy Scout Troop #177. The Roll of the City Council was called by the City Clerk with the following members present: Blacker, Ozuna, Hopper (via phone), Callsen, and Pollard. CONFLICT OF INTEREST DECLARATION None. SPECIAL PRESENTATIONS The Mayor acknowledged Ms. Jackson, American Government teacher from Caldwell High School. She asked the students in attendance to stand and introduce themselves. ADDITIONS OR DELETIONS TO THE AGENDA MOVED by Callsen, SECONDED by Blacker to amend the agenda by adding Item #5 to the Consent Calendar equest for a Taxicab License from 2C Cab effective MOTION CARRIED AUDIENCE PARTICIPATION None. CONSENT CALENDAR: 1.Approve acceptance of the minutes from the corrected City Council Meeting held on February 4, 2013, the City Council Meeting held on February 19, 2013; the Caldwell Golf Board Meeting held on November 14, 2012; the Senior Center Board Meeting held on February 11, 2013; the Caldwell Employee Benefit Plan Trustee Committee Meeting held on February 14, 2013; the Caldwell Youth Meeting held on February 6, 2013; the Pathways and Bike Routes Committee Meeting held on January 15, 2010; and the Caldwell Planning and Zoning Commission Meeting held on February 12, 2013; 2.Approve Resolution No. 21-13 accepting House Project to Richard L. Brent Orton, 621 Cleveland Blvd., presented the staff report and distributed a map of the site. In response to questions from Councilman Callsen, Mr. Orton confirmed that the property is located within the City Limits. The Mayor read the ordinance by title only: AN ORDINANCE OF THE CITY OF CALDWELL, IDAHO, ANNEXING A PORTION OF PROPERTY MOVED by Pollard, SECONDED by Callsen to waive the three reading process and consider Bill No. 6 (Ordinance No. 2927) on its first reading by title only. Roll call vote: Those voting yes: Pollard, Blacker, Ozuna, Hopper, and Callsen. Those voting no: none. Absent and/or not voting: none. Anne Marie Skinner, 621 Cleveland Boulevard, acknowledged that she had been sworn in and presented the staff report. She reported that the Order of Decision for Whitney Springs Subdivision #3 was signed by City Council on February 7, 2011. It consists of approximately 32.20 acres, has 140 residential buildable lots to be built out over a total of six (6) phases. Per the City Code, the preliminary plat is valid for a period of 24 months. If no plans are submitted, a onetime extension request may be submitted prior to the expiration date of the preliminary plat approval. The time extension request was submitted on January 25, 2013. No comments were received from other public agencies. Ms. Skinner explained that there are four criteria that must Ms. Skinner reported that staff feels that the criteria have been met and recommended approval of this time extension request. Shawn Brownlee, 2358 S. Titanium Place, Meridian, acknowledged that he had been sworn in and stated that he was in agreement with the staff report. He noted development within the subdivision has been delayed due to the economy; however, they are planning to submit a set of plans to the City in June 2013. The first phase would then be constructed in the 2013 July/August timeframe. MOVED by Pollard, SECONDED by Ozuna to close the public testimony portion of the hearing. MOTION CARRIED EVIDENCE LIST FOR CASE NO. SUBPUD-205E-10: The Mayor presented the Evidence List: staff report, sign-up sheets, and the preliminary plat. MOVED by Callsen, SECONDED by Pollard to accept the Evidence List as presented. MOTION CARRIED FINDINGS OF FACT ON CASE NO. SUBPUD-205E-10: MOVED by Callsen, SECONDED by Blacker to accept the general facts as outlined in the staff report, the public testimony that was given in this matter, the evidence list that was presented, to include the four criteria points as outlined the staff report as follows: A. B.The preliminary plat, as previously approved, is still in the best interest of the safety, health, and general welfare of the city. C.There have been no significant changes to city code between the date of preliminary plat approval and the application date of the time extension request that would require substantial modifications to the lot layout. D.The request for the time extension request is not based upon financial reasons or current market conditions. MOTION CARRIED CONCLUSIONS OF LAW ON CASE NO. SUBPUD-205E-10: MOVED by Ozuna, SECONDED by Blacker that the Caldwell City Council has the authority to hear this case and to make the decision to approve or deny; and the public hearing was noticed and heard within the guidelines of applicable state codes and local ordinances. MOTION CARRIED (FINANCE AND HUMAN RESOURCE REPORTS) Councilman Callsen reported that the Finance Committee has reviewed current accounts payable in the amount of $1,581,839.48 for the period ending February 21, 2013 and net payroll in the amount of $264,042.47 for the pay period ended February9, 2013. MOVED by Callsen, SECONDED by Blacker that accounts payable in the amount of $1,581,839.48 represented by check numbers 91831 through 92193 and the total payroll in the amount of $264,042.47 represented by check numbers 24903 through 24932 payroll direct deposits be accepted, payment approved, and vouchers filed in the office of the City Clerk. MOTION CARRIED (COUNCIL COMMENTS) Councilman Pollard reported that the Caldwell Chamber of Commerce and the City of Caldwell will be hosting thth a Tourism Conference on March 12 and 13 er will be Roger Brooks, who is a renowned motivational speaker. He will be addressing topics as to how to improve our city and bring tourism dollars to our community. Registration is still available. last week. It was very interesting and a beneficial time for the youth to experience the legislature and its processes. Councilman Ozuna attended a mandatory three-hour library training session for members of the board. This training will be held on a yearly basis. Councilman Blacker reported that Council recently met with members of the Caldwell Economic Development Council in a workshop to discuss funding issues. From information presented at the workshop, it has been recommended that CEDC remain as a private entity due to confidentiality factors. Further action is pending additional research. Councilman Hopper reported that the Caldwell Historic Preservation Commission is working with staff in developing and training commission members concerning implementation of Idaho State Statute procedures in connection with the issuance of Certificates of Appropriateness for home owners within the Steunenberg Historic District. Some members are more comfortable with an advisory role rather than this active role with public hearings. Councilman Hopper stated that he will keep Council informed concerning this process. The process to fill the City Council Member position is still underway. Twelve candidates were interviewed. The two finalists Terrence Biggers and Carlos Soriano were both in attendance and were introduced by Mayor Nancolas. The candidates greeted the Council and members of the audience. The Mayor updated Council Members concerning the Idaho Transportation Agreement with the City of Caldwell concerning the Hwy. 20/26 Widening Project. The project is pending with Idaho Transportation Department until a determination has been made regarding state and federal funding issues. which will feature guest speakers and historical presentations throughout the year on a quarterly basis. The first event for the year is scheduled for Thursday, March 14, 2013 at 7:00 p.m. The Caldwell Pathways and Bike Committee will be having a clean-up day for the Rotary Park and the th Caldwell Centennial Greenbelt area.
