Roll Call — Members Present: Ed Doty- Pomoransky, Dana Vance, Roger Page, Arvid Salisbury [Disclosures and Conflicts of Interest: None Members Absent: Ken Scholz Staff Present: Anne Marie Skinner (Senior Planner /Development Team Leader); April Cabello (Planning Technician) Staff Absent: Brian Billingsley (Planning and Zoning Director); Robb MacDonald (Assistant City Engineer) Review of Proceeding — Vice - Chairperson Doty- Pomoransky announced the procedures for the public hearing. 111. Old Business A. Approve minutes of August 14, 2012 regular meeting, MOTION: Commissioner Page SECOND: Commissioner Vance Passed: Unanimous roll call vote. IV. New Business A. Case Number SUB- 208(PF) -12 a request by The Church of Jesus Christ of Latter -Day Saints and The Land Group for short plat approval of Linden Stake Subdivision, consisting of 9.06 acres to be subdivided into two lots in a R -1 Low Density Residential zone located on the north side of Linden Street approximately 813 feet east of KCID Road. Testimony: 1) Anne Marie Skinner, 621 Cleveland Blvd., Caldwell, ID 83505, Senior Planner/Development Team Leader, presented the written staff report as written and submitted an aerial map of the site labeled as PZ -1000. 2) Ms. Skinner noted the request, the property owner, developer /applicant, engineer, and architect. 3) Ms. Skinner noted the subject property is located on the north side of Linden Street approximately 813 feet east of KCID Road, 4) Ms. Skinner explained that to the north and east of the subject property is Pheasant Run Subdivision, to the west of the subject property is in the county and is being used for agricultural purposes, and south of the subject property is zoned M -1 Light Industrial but is currently being used for agriculture, P &Z Minutes 10/9/2012 5) Ms. Skinner stated the subject property is largely developed with the bulk of the property being an existing church with accompanying landscaping and parking. There is about one acre that is bare ground that will be split off and be sold for a residential single- family building lot, 6) Ms. Skinner noted all public agencies were notified of the request and the only agency to reply was Pioneer Irrigation District. 7) Ms. Skinner stated there are no parking, landscaping, infrastructure, or right -of -way requirements because all of those items were completed when the church was constructed. 8) Ms. Skinner stated that the application meets all of the requirements of the subdivision ordinance and recommended approval of the request. 9) Commissioner Salisbury wondered about the notation on the application of the two lots being commercial. 10) Ms, Skinner explained that was just a mistake on the application, that the property is zoned residential, so the lots will be residential. 11) Commissioner Salisbury wondered about the use of the property. 12) Ms. Skinner explained again that the bulk of the property contains an existing church building with accompanying landscaping and parking. The remaining one acre will be split off and sold to someone who will build a single- family dwelling, as that is the only use allowed on the property since the zoning is R -I Low Density Residential. 13) Dion Zimmerman, applicant's representative, 400 S. Main, Payette, ID 83661, stated he was the architect who did the original church five or six years ago. He further stated that part of the reason for the application was to split off and sell the bare one acre lot and the other reason was to change the pathway access from the west side of property to the east side of the property, thereby moving the pathway away from the canal but still providing connectivity to the adjacent subdivisions. 14) Commissioner Vance questioned the access. 15) Mr. Zimmerman stated the pathway access was moving to the east side of the church rather than the northwest corner. Vehicular access would remain as is off of Linden. MOTION TO CLOSE TESTIMONY: Commissioner Vance SECOND: Commissioner Salisbury Passed: Unanimous roll call vote. Conclusions of Law for Case Number SUB- 208(PF) -12 — MOTION: Commissioner Salisbury SECOND: Commissioner Vance Passed: Unanimous roll call vote, Recommendation on Case Number SUB- 208(PF) -12 — MOTION: Commissioner Page SECOND: Commissioner Salisbury. The Commission voted unanimously to Recommend Approval. V. Planning Issues — A. The next regularly scheduled Planning and Zoning Commission hearing is December 11, 2012. B. Commissioner Vance stated she would not be in attendance at December hearing. VI.
