September 11, 2012
1. Call to Order — Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at
7:02 p.m.
Il. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for the public hearing.
Members Present: Anne Marie Skinner (Senior Planner /Development Team Leader); April Cabello
(Planning Technician); Robb MacDonald (Assistant City Engineer); Brian Billingsley (Planning Director)
Members Absent: None.
III. Old Business:
A. Mr. Mapp approved the Minutes of the July 10, 2012 meeting as previously signed Hearing
Examiner Mapp.
IV. New Business:
A. Case Number SUP - 354 -12 a request by Caldwell MOB LLC, Gardner Company, and Laren
Bailey for a special use permit to exceed the maximum height allowance and to reduce the
north Hazel Street side setback on new construction to be located at the southwest corner
of Elm Street and Fairview Avenue.
Testimony:
1. Anne Marie Skinner, Senior Planner /Development Team Leader, 621 Cleveland
Blvd., Caldwell, ID 83605, presented the staff report and stated that this is a
special use permit request for a height deviation and a street side setback
deviation. The property owner is listed Caldwell MOB LLC and the
applicant /developer is Gardner Company and the engineer /planner is LEI
Engineers, Laren Bailey. An extension of the maximum height is being
requested. The maximum height allowed is 75 feet in this zone which is the
Hospital District. The applicant is requesting an additional 6 feet in height for a
total height of 81 feet. Further requested is a four -foot reduction in the street
side setback on the north side of Hazel Street only, from the required minimum
of 20 feet to 16 feet. The south side of Hazel Street will be the parking lot for
the new office building and will not have any structures on it.

2. Ms. Skinner explained that the subject property, referring to the aerial photo
labeled Exhibit PZ -1000 is located at the southwest corner of Elm Street and
Fairview and is addressed as 1906 Fairview. The remainder of the site will be
parking. The subject property is zoned H -D Hospital District with an
Institutional classification on the Comprehensive Plan Map. The property is
completely surrounded by H -D Hospital District zoning as well as an
Institutional classification on the Comprehensive Plan Map. To the north of the
property is a medical office building and the hospital, south of the subject
property is bare ground which will become a parking lot for the new structure,
east of the subject property consists of medical offices, and west of the subject
property also consists of medical offices.
3. Ms. Skinner stated that the subject property utilizes an existing street system
and all of the applicable public services had been notified of the request with
no responses being received.
4. Ms. Skinner stated this request does not generate any landscaping or parking
requirements. All of the landscaping and parking requirements will have to be
met through the building permit process and will have to be constructed and
pass inspection prior to issuance of a certificate of occupancy.
5. Mr. Mapp clarified that, as of this date, all landscaping and parking
requirements would be met, just that they would be met through the building
process.
6. Ms. Skinner responded that was correct.
7. Ms. Skinner stated that Staff has reviewed the special use permit request
against the ordinance and further stated that special use permit requests are
subject to conditions of approval, they can be approved provided they don't
cause any harm or detriment to the vicinity, and that they are not in conflict
with the comprehensive plan. Staff has determined that the request is not in
conflict with the comprehensive plan and does not feel there would not be any
damage or detriment to property in the vicinity largely due to the existence of
the multi -story medical office building and hospital to the north. No negative
feedback was received in conjunction with the request.
8. Mr. Mapp wondered about the height of the existing hospital and medical
office building to the north.
9. Ms. Skinner stated she did not know the height of either of those buildings.
10. Staff recommends approval of the request and the conditions of approval are
listed in the staff report.
11. Craig Driver, applicant, 850 W. Main St., Boise, ID 83702, stated he had nothing
to add to Ms. Skinner's presentation other than he is excited about the project.
There is an extreme demand for these medical office spaces and they have
been overwhelmed with requests. Mr. Driver feels the building will be a
tremendous asset to the community and the hospital.

12. Mr. Driver stated they are basically accommodating the mechanical penthouse
on the top of the building and that is what is necessitating the additional 6 feet
in height. The actual building itself is within the allowed height. The setback
reduction will allow the bay depths to be more efficient for space - planning
purposes.
13. Mr. Driver reviewed the site plan Case File Exhibit A -3 with Mr. Mapp and
pointed out the setback area on the south side of the property, which is the
north side of Hazel Street. Mr. Driver also pointed out the mechanical
penthouse.
MR. MAPP CLOSED THE PUBLIC TESTIMONY.
Comprehensive Plan Analysis for SUP- 354 -12: Mr. Mapp accepted the comprehensive plan analysis
as listed in the staff report.
Findings of Fact for SUP - 354 -12: The Hearing Examiner accepted the general facts as outlined in the
staff report, public testimony, and the evidence list consisting of the written and verbal staff reports,
the case file including Case File Exhibit A -3, PZ -1000 (aerial photo), and the sign -up sheet. All
adopted city ordinances, standards, and codes were used in evaluating the application. The
proposed deviations are conditionally permitted by the terms of the ordinance and are subject to
conditions of approval.
Conclusions of Law for SUP - 354 -12: The Hearing Examiner accepted the Conclusions of Law as
outlined in the staff report.
ORDER OF DECISION: The Hearing Examiner ORDERED that Case Number SUP - 35442 IS APPROVED
with conditions as outlined in the staff report.
V. Planning Issues —None.
VI. Adjournment
The Hearing Examiner adjourned the meeting at approximately 7:20 p.m.
