HomeMy WebLinkAboutORD 2910BILL NO.9 ORDINANCE NO. 2910 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 12, ARTICLES 5 (PLUMBING REGULATIONS), 7 (ELECTRICAL REGULATIONS), 11 (SIGN REGULATIONS), AND 13 (MECHANICAL CODE AND FUEL GAS CODE), OF THE CALDWELL CITY CODE, PERTAINING TO FEES FOR THE ISSUANCES OF PERMITS AND THE POSSIBLE REFUND OF SAID FEES UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1: That Chapter 12, Article 5, Section 12 -05 -05 of the Caldwell City Code, is amended as follows: 12- 05 -05: PERMIT FEES: (1) Payment 9of Fees: , �plicants for permits issued pursuant to this Article shall pay to the building official fees established by the building official by rule and regulations subject to the approval of the city council. (2 R) efunds: Before commencement of any activity regulated under the issuance of a valid permit, the building official may authorize the refunding of no more than eighty. p ercent 80% of permit fees paid, when requested in writing by letter or form and all rights granted by the permits are terminated. Plan review fees and deposits, if any, shall not be refundable. Section 2: That Chapter 12, Article 7, Section 12 -07 -07 of the Caldwell City Code is amended as follows: 12- 07 -07: PERMIT FEES: (1) Payment of Fees Freni and after January 1, 199-6, @A pplicants for eleetfieal- permits issued pursuant to this Article shall pay to the building official fees established by the building official by rule and regulations subject to the approval of the city council. 2 Refunds: Before commencement of any activity regulated under the issuance of a valid permit, the building official may authorize the refunding of no more than eighty PAGE - I percent (80 %permit fees paid, when requested in writing by letter or form, and all rights granted by the permits are terminated. Section 3: That Chapter 12, Article 11, Section 12 -11 -15 of the Caldwell City Code is amended as follows: 12- 11 -15: PERMIT FEES: (1) Payment of Fees: Applicants for permits issued pursuant to this article shall pqy to the building official fees established by the building official by rule and regulations subject to the approval of the city council._ A pefmit fee and plan review fee shall be assessed as per- adopted fesolution by eity 081ineil using the prejeet Valuation. (2) Refunds: Before commencement of any activity regulated under the issuance of a valid permit, the building official may authorize the refunding of n more than eighty p ercent 80% of permit fees paid, when re nested in writing by letter or form and all rights granted by the permits are terminated. Plan review fees and deposits, if any_, shall not be refundable. Section 4: That a new section 12- 13 -06, composed of two subsections, be added to Chapter 12, Article 13 of the Caldwell City Code, as follows: 12- 13 -06: PERMIT FEES: (1) Payment of Fees: Applicants for permits issued pursuant to this Article shall pay to the building official fees established by the building official by _rule and regulations subject to the approval of the city council. 2 Refunds: Before commencement of any activity regulated under the issuance of a valid permit, the building official may authorize the refunding of no more than eight percent (80 %) of permit fees paid, when requested in writing by letter or form, and all rights granted by the permits are terminated. Plan review fees and deposits, if any, shall not be refundable. Section 4: This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 5: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. PAGE - 2 Section 6: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Nancolas ATTEST: City Clerk PAGE -3 e *46 Goo@ U % �b ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 2910 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 12, ARTICLES 5 (PLUMBING REGULATIONS), 7 (ELECTRICAL REGULATIONS), 11 (SIGN REGULATIONS), AND 13 (MECHANICAL CODE AND FUEL GAS CODE), OF THE CALDWELL CITY CODE, PERTAINING TO FEES FOR THE ISSUANCES OF PERMITS AND THE POSSIBLE REFUND OF SAID FEES UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. Sections 1 through 4: Amends Chapter 12, Articles 5 (Plumbing Regulations), 7 (Electrical Regulations), I 1 (Sign Regulations), and 13 (Mechanical Code and Fuel Gas Code), of the Caldwell City Code, by clarifying that the Building Official may, prior to commencement of work. issue refunds for no more than eighty - percent (80 %) of certain permit fees paid, when requested in writing, and by making other minor changes for internal consistency. Sections 5-7: provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law; provides for severability; and, repeals conflicting ordinances, resolutions and orders. Ordinance No. 2910 provides an effective date, which shall be when published in the Idaho Press Tribune on the 28th day of May, 2012. Ordinance No. 2910 was passed by the Council and approved by the Mayor on the 21st day of May, 2012.
