I. Cali to order: Meeting was called to order by Co-Chair Chuck Randolph at 6:05 P.M.
II. Roll Call: Present: Commissioner Jan Boles, Elaine Carpenter, Elaine Leppert, Gina Lujack,
Co-chair Chuck Randolph, Anita Shore, and City Staff Brian Billingsley and
April Cabello.
Absent: Ron Blakley, Eileen Davidson, Co-chair Lorene Oates, Co-chair Steve
Maughan, and City Council Liaison, Rob Hopper
III. Approval of Agenda: Amended to add Continuation of 823 Albany under VI. Audience Participation, add Mark Hilty
update and Interurban Track under New Business. Motion to approve, Commissioner Shore.
Second Commissioner Lujack. Motion passed
N. Approval of Minutes
• June 23, 2008 — revised - Motion to approve, Commissioner Carpenter. Second Commissioner Lujack.
Motion passed.
• July 28, 2008 - Corrections: On page one Caballo should be spelled Cabello. Page 4 bottom paragraph should
read Co-Chair Randolph said that (instead of tat) and on Page 5 the second paragraph under For the Good of the
Commission next to last line should say "also spoken to Arvid Salisbury" Motion to approve as amended,
Commissioner Carpenter. Second Commissioner Lujack. Motion passed
V. Certificate of Appropriateness Interviews: City Staff, April Cabello swore the people giving testimony.
• CA-120-08 — 1304 Cleveland Blvd. — application submitted by Dennis & Deb Balmer for approval to enlarge
garage. Continued from meeting on 7/28/08. The Balmers have written a letter to authorize their contractor, to speak
for them. He said he believed all setbacks were taken into consideration when the plans were drawn. City Staff
Billingsley explained that a structure over 600 sq. ft. requires meeting all setbacks. The addition would be attached
to the existing garage; therefore, it would be able to have a 5 ft. setback. City Staff Billingsley suggested we approve
it with the requirement that the City Engineer approves the setback. City Staff Cabello said the City Engineer has
already approved the curb cuts. The concern last month was the size of the concrete pad. It would give it a
commercial appearance. The new plan calls for less concrete and more grass. The city's main concern was that
they not alter the curb. Commissioner Carpenter asked about the windows. They will face the existing house and he
will duplicate the windows in the existing garage. Commissioner Lujack asked about the curb height.
Commissioner Carpenter moved for approval with the understanding that they will comply with the setback
requirements. Commissioner Shore seconded. Motion passed.
• CA-119-08 — 823 Albany Street — Continued from last month. Nick Voth and Nancy Roberts were sworn by City
Staff Cabello. This is part two of their application. Mr. Voth would have to meet the 15 foot setback requirement.
The Roberts would rather have a 24'�c25' garage to meet the 600 sq. ft. or less, so they can have a 5 foot setback.
They want to use siding etc to match the house, to maintain a historic appearance. They would like to use Hardy
Plank. They were in hopes to get a tentative approval tonight. The roof line was questioned. The garage would be
smaller than the house, but the roof would appear the same. They would use an overhead garage door with the
carriage door appearance. The proposed porch would have steps on 9�` and on Albany to compliment the house.
The Roberts were asked to bring in elevations. Motion to accept the concept with the understanding the Roberts will
resubmit with plans, Commissioner Boles. Second Commissioner Lujack. Motion passed. There followed a
discussion of photos of exterior and interior. Commissioner Randolph suggested they check old newspapers
archives. There is a possibility there were photos from when it went on the Historic Registry or when it was
originatIy built.

VI. Audience Participation: .
Mark Hilty, the City Attorney was here to discuss the Greenspring Baptist Church plans for 1208 Blaine. Mr. Rice
appeared before this Commission in the past and was denied his Certificate of Appropriateness. He appealed this to
the City Council, who backed us on the denial. The issue is now in the hands of Judge Hof£ The records indicate
the decision was made on use. The State Statutes addresses "When considering Appropriateness, You shall consider
exterior features. Interior features cannot be considered." Next the Statutes says to change use; the applicant must
obtain a Certificate of Appropriateness. Mr. Hilty said the applicant was aware of the District rules when he
purchased the property. Mr. Rice says he is willing to do all the things we request. If we were to grant a Certificate
of Appropriateness, Mr. Rice would have to go to Planning and Zoning for a Special Use Permit. Mr. Hilty does not
want to see it come to the point that the court orders us to do something we do not want. The City Gouncil has asked
Mr. Hilty to speak to us. Maybe, have one or two of the Commissioners meet with Mr. Rice to see if we could work
out an agreeable level of comfort to reach an agreeable arrangement. Commissioner Boles said this would not be a
home occupation. No one would reside there. Commissioner Carpenter explained our position to Mr. Hilty. The
Special Use Permit goes with the property. If Mr. Rice should sell the properiy, the new owner could run a
commercial business. Commissioner Lujack asked if he would be required to meet all the requirements of any other
commercial property, such as Handicap Accessibility, Parking etc. The answer was yes. Mr. Rice asserts that we
reached our decision based on land use only. City Staff Billingsley would be willing to represent us, knowing our
feelings on this issue. Commissioner Boles ask if we could approve with the stipulation that nothing would be done
to the interior that would limit future use as a residence. Commissioner Randolph suggested we have City Staff
Billingsley represent us in a meeting with Mr. Rice to resolve this issue. The question arose that off-street parking
not be installed in such a manner as to limit future residential use.
VII. Actions Since Last Meeting
• CA-113-08 - 1204 Dearborn Street — application submitted by Osman Rivas for approval to remove a window, door,
set of steps and replace a window with double hung window and reside with like siding. Certificate of
Appropriateness was issued on 7/29/08. Commissioner Randolph rep�rted that this has been signed. The house is
for sale ar rent.
• CA-119-08 — 823 Albany Street — application submitted by Rob & Nancy Roberts and Nick Voth for approval to
restore home to near original condition excluding approval of steps. Certificate of Appropriateness was issued on
7/29/08. Aside from the garage & steps, this has been approved.
• CA-121-08 — I510 Dearborn Street— application submitted by Monte Munn for re-roof. Certificate of
Appropriateness was issued on 8/5/08. Co-Chair Randolph reported that this is a beautiful first class roof.
• CA-122-08 — 1518 Everett Street — application submitted by Margaret Adams for a re-roof. Certificate of
Appropriateness was issued on 8/25/08. Co-Chair Randolph reported that this is an architectural shingle re-roof and
has been approved.
• Last Year the Commission approved a certificate for residing a house owned by Carl Christensen in the 1600 block
of Fillmore. The Building Permit has expired. City Staff Cabello asked about a time limit on Certificates. The
Commission was sure there is a one year time limit. Brian volunteered to check our Ordinance. The City will put a
"Stop Work" on this project. We will probably need to renew the C of A.
VIIL Old Business
• The Hat — Commissioner Boles is requesting the ba(ance on our account. His first mason has disappeared. He has
contacted another, but needs to know what we can afford. City Staff Billingsley will email him the balance.
• Historic Preservation Ordinance Amendment — City Staff Billingsiey took the new ordinance to the City Council on
August 4, 2008 at 7 P.M. It was approved with the changes we made. Commissioner Carpenter asked about having
a work shop to review the new ordinance and procedures that we will need change.
• CLG Grant for 2008 — update — City Staff Cabello has spoken to Ann Swanson. She doesn't want the money back
that we had intended to use for a brochure. She has approved memberships in some historic preservation
organizations for our Commissioners.

• CLG Grant for 2009 - Application must be submitted to SHPO no later than September 30, 2008. At the last
meeting, we discussed doing a survey on Dave Dorsey Homes and The Walking Tour brochure. Commissioner
Randolph. City Staff Cabello has not submitted the application. City Staff Cabello passed out a rough draft of the
application she has prepared. She is open to suggestions. City Staff Cabello explained this was just a proposal.
Commissioner Carpenter suggested that sometime we should do something on the Boone Church. Commissioner
Randolph asked that we approve the two suggestions. There were no objections. Commissioner Boles ask if it
could be tied to the City Web Site. There was some discussion on the "Mid Century Modern Conference. There are
some good examples in Caldwell that have not been tampered with. Several houses were mentioned. Commissioner
Lujack suggested we get a bus and go on a tour.
• Auxiliary Committee Reports
1) Streetscape Committee — Commissioner Davidson Absent.
2) School District Committee Representative - Co-Chair Randolph stated they have not met. City Staff
Billingsley said their big project at this time is getting the schools built
3) Downtown Committee — Co-Chair Maughan was absent.
4) Design Review Committee — Commissioner Randolph stated they have not met.
IX. New Business
• Revised Application to match the revised ordinance - City Staff Cabello has posted on this on the City web site. She
said if there is anything we want changed to let her know.
• Oregon Trail on Canyon Hill — Commissioner Boles reported that the Oregon California Trail Association met in
Nampa last month. One of the attendees was Al Steunenberg, a cousin of Bill Crookham. A1 and two fellow OCTA
members were very interested when they heard that part of the Trail was on Canyon Hill. OCTA has purchase funds
available for suitable portions of the Trail remaining in private hands. Gina Lujack reported that the Preliminary Plat
of the Gay Simplot subdivision has been approved, but no further action has transpired. Thus, there is a chance that
OCTA would be interested in helping CHPC preserve that segment of the Trail. Jan will follow up on this.
• Anniversary of Deer Flat Refuge — Commissioner Boles reported that next year will be the 100�' Anniversary of the
Deer Flat Refuge. They are inquiring about the Sebree Pavilion. Commissioner Boles will send a jpeg of pictures to
the Commissioners
X. For the Good of the Commission
• Interurban Rail — The Canyon County Historical Society would like to have a section of the
Interurban Rail, which was removed from Cleveland Blvd when it was repaved. Commissioner
Carpenter will hang on to the section we have for now.
XI. Adjournment: Motion to adjourn, Commissioner Boles. Second, Commissioner Lujack. Motion passed.
Next meeting will be held on September 22, 2008
