Call to Order— Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at 7:00 p.m. II. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for the public hearing. Members Present: Anne Marie Skinner (Senior Planner/Community Development Coordinator), Brent Orton (Public Works Director), Brian Billingsley (Planning Director) and April Cabello (Planning Technician). i III. Old Business: A. Mr. Mapp approved the Minutes of the lanuary 26, 2010 meeting as signed on February 3, 2010 by Hearing Examiner Mapp. IV. New Business: A. Case Number SUB/PUD-169E-07 a request by Caldwell 260 LLC and Mutual Benefit Investments, Inc. for a time extension request for the preliminary plat of Lakemont Subdivision located at the northeast corner of the intersection of Midland Boulevard and Lincoln Road. Testimony: 1. Anne Marie Skinner, Senior Planner/Community Development Coordinator, presented the staff report and submitted an aerial map of the site labeled as PZ-1000. 2. Cheryl Moriarty, applicant's representative, signed in favor of the application and provided supporting testimony. 3. Pam Ickes Peterson signed as neutral but did not wish to speak. 4. Roger Rosdahl signed in opposition of the application and stated his concerns regarding piles of rubble and broken chunks of cement. S. Ms. Skinner responded that the Police Code Enforcement stated the site has no code violations. 6. Ms. Moriarty rebutted stating the reason for the piles of concrete and how the concrete will be used in the development of the subdivision. 7. Findings of Fact for SUB/PUD-169E-07: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented. Conclusions of Law for SUB/PUD-169E-07: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Order of Decision: The Hearing Examiner ordered that Case Number SUB/PUD-169E-07 is approved with conditions 6.1 through 6.3. B. Case Number SUB-106E-04 a request by Freehold Development and LEI Engineers + Surveyors for a one year time extension for the preliminary plat of Sky Ranch Business Center # 1 located east of Smeed Parkway and approximately 1,000 feet south of HWY 20/26. Testimony: 1. Anne Marie Skinner, Senior Planner/Community Development Coordinator, presented the staff report and submitted an aerial map of the site labeled as PZ-1000. 2. laren Bailey, applicant's representative, signed in favor of the application and provided supporting testimony. Mr. Bailey stated that page 2, section 2.3 of the staff report listed the remaining lots yet to be recorded as 6 industrial and 6 commercial lots and it should read remaining lots left to be recorded are 7 commercial and 0 industrial. 3. Ms. Skinner responded that she would double check the records. MR. MAPP CLOSED THE PUBLIC TESTIMONY. Findings of Fact for SUB-106E-04: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented. Conclusions of Law for SUB-106E-04: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Order of Decision: The Hearing Examiner ordered that Case Number SUB-106E-04 is approved with conditions 6.1 through 6.3 and staff to verify the number of lots yet to be recorded. Anne Marie Skinner, Senior Planner/Community Development Coordinator, informed Hearing Examiner Mapp that the representatives for the last two cases SUB/PUD-167E-07 and SUP-330-10 were not in attendance and asked how he would like to proceed.
