1. Call to Order — Acting Cl�airperson Jakobson called the meeting to order for the public
hearing at 7:04 p.m.

Review of Proceeding — Acting Chairperson Jakobson announced tlie procedures for tl}e public

A. Approve minutes of December 8, 2009 meeting as signed by Chairperson Jakobson on
December 22, 2009.

C. Case Number OA-124-09 a request by the Planning and Zoning Department, Police
Department, Fire Department, Streets Department, Engineering Department, Parks and
Recreation and the City Clerk for an addition to Caldwell City Code to add Section 10-
02-13 concerning special events permitting process.
Testimony:
1) Anne Marie Skinner, Senior Planner/Community Development Coordinator,
presented the proposed draft ordinance regarding the new special event
permit process.
2) The Commission held discussion regarding events held on private property
and whether or not they were exempt, surety bonds for out-of-town event
sponsors, provisions for amending conditions once a permit has been issued
and flexibility with application deadlines.

Comprehensive Ptan Analysis OA-124-09 — Accepted MOTION: Commissioner Shaffer

Recommendation on Case No. OA-124-09 - MOTION: Commissioner T'ollman SECOND:
Commissioner Clark. The Commission voted una»imously to recommencl APproval witl� the
following modifications to the proposed ordinance.
• Add flexibility to the forly-five day deadline for application submittal for those applicants
who may not be aware of such a deadline or who are unfamiliar with the process.
• Add provision for adjustments to the conditions of approval of the special event permit
should the parameters of the event change after issuance of said permit.
• Add provision for requiring a surety bond for out-of-town event sponsors.
D. Case Number OA-125-09 a request by Caldwel] Planning and Zonin� Department to
a►nend the City of Caldwell Sign Ordinance, section 10-02-06 and the City of C'aldwell
Dayczre Ordinance, Section 10-02-10.
Testimony:
1) Anne Marie Skinner, Senior Planner/Community Development Coordinator,
presented the amended Sign and Daycare ordinance.
2) The Commissioners discussed at length their concerns with the proposed
changes to the Sign and Daycare Ordinance. The Commission discussed why
schools should or should not be allowed to have internally illuminated signs,
or signs greater than 32 square feet, without having special use permit
approval. They further discussed the need for drug screening and random

drug testing for all daycare providers as well as for all residents within family
group daycare homes.

Recommendation on Case No. OA-125-09 — MOTION: Commissioner Tol(ma�i SECOND:
Commissioner Clark. The Commission voted unauimously to recommend Ap�roval with the
following modifications to the proposed ordinance:
• Strike proposed changes to the sign ordinance Section 10-02-06(2)(N) and leave the
requirement for a special use permit for internally illuminated signs a.nd for signs larger
than thirty-t«�o square feet for schools.
• Add language to the ordinance to provide for required drug screening a1 the initial
application for all daycare providers and for al1 residents within the home of family group
home daycares. Additionally add language to provide for random dcug screening
throughout the year for all daycare providers and for all residents withiu the home of
family group home daycares.
E. Case Number OA-126-10 a request by Caldwell Planning & Zoning to Amend the
current Zoning Map.
Testimony:
1) Anne Marie Skinner, Senior Planner/Community Development Coordinator,
presented the staff report and submitted the amended Zoning map labeled as
e�ibit PZ-1000.

F. Case Number OA-119-09 a request by the Planning and Zoning Department to amend �` `
the City of Caldwell Comprehensive Plan and the City of Caldwell Comprehensive Plan
Map.
Testimony:
1) Brian Billingsley, Planning Director, presented the amended Comprehensive
Plan, Comprehensive Map ordinance and a draft Comprehensive Plan Map
labeled as PZ-1001. He also submitted a copy of the PowerPoint presentation
labeled as PZ-1002.
2) The Commissioners discussed at length the industrial zone along gravel pit
areas and why these areas are not zoned for residential. They also discussed
connecting pathways.
3) Mr. Billingsley submitted a Comprehensive Plan with a Special Planning
Study Area labeled as PZ-1003.
4) Becky McKay signed in favor of the application and gave her testimony and
submitted an Engineering Solutions handout labeled as PZ-1004.
5) Marty Goldsmith signed in favor of the application but did not wish to speak.

Recommendation on Case No. OA-119-09 — MOTION: Commissioner Tollman SECOND:
Commissioner Clark. The Commission voted unanimously to recommend Approval with the
following modifications to the proposed ordinance:
• Gravel pits to be looked at as future residential zone.
• Highway 20/26 Commercial Area to be looked at for future residential zone.
• Add the Special Planning Study Area to the Comprehensive Plan Map.
V. I'lanning Issues
• Mr. Billingsley suggested the new commission �nembers should attend a Trainin� Session
that will be held on Saturday, April l0, 2010 in Mountain Home. y
