MINUTES
January 12, 2010
I. Call to Order — Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at
7:00 p.m.
II. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for the public hearing.
Members Present: Anne Marie Skinner (Senior Planner/Community Development Coordinator},
Brent Orton (Public Works Director), Brian Billingsiey (Planning Director) and April Cabello
(Planning Technician)
III. Old Business:
A. Mr. Mapp approved the Minutes of the November 10, 2009 meeting as signed on November
20, 2009 by Hearing Examiner Mapp
IV. New Business:
A. Case Number SUP-329-09 a request by Grand Slam LLC and T-O Engineers for a special
use permit for an assisted living apartment complex located in a C-3 Service Commercial zone
at the northwest corner of Cleveland Boulevard and Homedale Road.
Testimony:
1. Anne Marie Skinner, Senior Planner/Community Development Coordinator, presented the
staff report.
2. Pat Colwell, applicanYs representative, signed in favor of the application and provided
testimony.
3. Preston Nicholes, applicant, signed in favor of the application and provided testimony.
4. Mr. Mapp stated his concerns regarding the layout of the plat and asked the application to
revise the site plan to show less parking, more green space and a centrally located
community center and maintenance building along with reducing the number of apartment
buildings from five to four.
5. Mr. Mapp stated he would like to have the case continued to allow the applicant time to
revise the site layout.
MR. MAPP CONTINUED THIS CASE TO A SPECIAL HEARING ON JANUARY 26, 2010.
B. Case Number ANN-177-09/SUP-327-09 a request made by the Bureau of Land Management
and City of Caldwell for annexation of approximately 29.57 acres with R-S-2 (Semi-Rural
Residential 2) zone classification and a Comprehensive Plan Map designation of Residential
Estates. Also requested is approval of a special use permit ap�lication for a City Park. The
site is located on the northeast corner of Grchard Avenue and 10' Avenue.

Testimony:
1. Anne Marie Skinner, Senior Planner/Community Development Coordinator, presented
the staff report.
2. Bil� Trask signed in neutral of the application and asked about the future utilities and
stated placement of a fire hydrant at the park may be useful for the neighborhood across
the street from the park.
3. David Jerome signed in neutral of the application and stated he had not reviewed the site
plan but stated his concern for the grading and drainage.
4. Ms. Skinner responded that a topographic survey had been completed for the site and
the proposed layout for the park takes into account the current elevations. Additionally, a
full grading and drainage plan will need to be approved by the Engineering Department
prior to the onset of any on-site grading.
MR. MAPP CLOSED THE PUBLIC TESTIMONY.
Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed.
Findings of Fact for ANN-177-09: The Hearing Examiner accepted the general facts as outlined
in the staff report, public testimony, and the evidence list as presented.
Conclusions of Law for ANN-177-09: The Hearing Examiner accepted the Conclusions of Law as
outlined in the staff report.
Recommendation; The Hearing Examiner recommended that Case Number ANN-177-09 be
approved with condition 8.2.
Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed.
Findings of Fact for SUP-327-09: The Hearing Examiner accepted the general facts as outlined in
the staff report, public testimony, and the evidence list as presented.
Conclusions of Law for SUP-327-09: The Hearing Examiner accepted the Conclusions of Law as
outlined in the staff report.
Order of Decision: The Hearing Examiner ordered that Case Number SUP-327-09 is approved
with conditions 11.2 through 11

VI. Adjournment
The Hearing Examiner adjourned the meeting at approximately 8:30 p.m.
