Call to Order — Hearing Examiner, Mr. Jerome Mapp, opened the meeting for the public hearing at 7:00 p.m. Ii. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for the public hearing. III. Members Present: Anne Marie Skinner (Senior Planner), Brian Billingsley (Planning Director), Brent �rton (City Engineer) and Savanna Davis (Administrative Secretary) IV. Old Business: A. Mr. Mapp approved the Minutes of the March 10, 2009 meeting as signed on March 19, 2009 by Hearing Examiner Mapp V. New Business: A. Case Number PUD-199-09 a request by IOOF Grand Lodge of Idaho, New Beginnings Housing LLC and Advocates Against Family Violence Inc. for a planned unit development to construct three apartment buildings for a total of 48 units. Testimony: 1. Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial map labeled as exhibit PZ-1000. 2. Gregg Urrutia, applicant, signed in favor of the application and provided supporting testimony. Mr. Urrutia also submitted a large site plan labeled as PZ-1001 elevations of 3 buildings labeled as PZ-1002 and 4 views of apartments labeled as PZ-1003. 3. Mr. Mapp expressed his concerns for the distance apart that the trash receptacles (dumpsters) are located. MR. MAPP CLOSED THE PUBLIC TESTIMONY. i i Comprehensive Plan Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed. �' Findings of Fact for PUD-199-09: The Hearing Examiner accepted the general facts as outlined �i in the staff report, public testimony, and the evidence list as presented. I Conclusions of Law for PUD-199-09: The Hearing Examiner accepted the Conclusions of Law as I outlined in the staff report. Order of Decision: The Fiearing Examiner ordered that Case Number PUD-199-09 is approved with conditions as outlined in the staff report with the addition of: • 8.13 Applicant shall revise the site plan and landscaping plan to clearly define the number of units in each building, provide more details on the community center, and work with the contracted trash company on placement of the trash enclosures and the post office on placement of the mailbox cluster. Case Number SUB-193PF-09 a request by Twenty 06 LLC, Michael Ustick, Tracy Harcourt, James Townsend, 6909 Enoch Drive Trust, Tap Chung, KGLM Investment, Jeremy Newberry, Patricia Mittry Ward Revocable Trust, Shawnee Development and RMR Consulting for short plaUcondo plat approval of Faith Landing Condominiums #2 consisting of 10 buildings with 4 units in each building for a total of 40 units. Testimony: 1. Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial map labeled as exhibit PZ-1000. 2. Matt Schultr, applicanYs representative, signed in favor of the application and provided supporting testimony. MR. MAPP CLOSED THE PUBLIC TESTIMONY. Comprehensive Pian Analysis: Mr. Mapp accepted the comprehensive plan analysis as listed. Findings of Fact for SUB-193PF-09: The Hearing Examiner accepted the general facts as outlined in the staff report, public testimony, and the evidence list as presented. Conclusions of Law for SUB-193PF-09: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Recommendation: The Hearing Examiner recommended that Case Number SUB-193PF-09 be approved with conditions as outlined in the staff repart with the addition: • 8.6 All requirements from Idaho Code, Title 55, Chapter 15 shall be adhered to. C. Case Number SUP-325-09 a request by Ron Bitner and Martin Fujishin to obtain special use permit approval for a wine tasting restaurant and sales establishment in the City Center District. The site is addressed as 217 S. Kimball. Testimony: 1. Anne Marie Skinner, Senior Planner, presented the staff report and submitted an aerial photo labeled as PZ-1000. 2. Ron Bitner, applicant, signed in favor of this application and provided supporting testimony and provided a letter of support from Rick Wells which was laheled as PZ-1001. 3. Mark Fujishin signed in favor of the application and provided supporting testimony. MR. MAPP CLOSED THE PUBLIC TESTINfONY. Order of Decision: The Hearing Examiner ordered that Case Number SUP-325-09 is approved with conditions as outlined in the staff report. VII. Planning Issues - None Vlil.
