V. NEW BUSINESS
A. Case Number SUB-190PF-08 a request by Charles Cornforth and Toothman-
Orton Engineering for condominium/short plat approval of Chaparro Condos
consisting of two existing residential units and one common lot. The site is
located at 2920 S. 10 Avenue.

l. Anne Marie Skinner, Senior Planner, presented the staff report and
submitted exhibit PZ-1000, an aerial photo of the site.
2. Pat Colwell, applicant's representative, signed in favor of the application
and gave supporting testimony. Mr. Colwell stated that all necessary
improvements required by the building department are complete, but
there are some minor improvements that still need to be completed
specifically a small portion of sidewalk along the lO Avenue frontage.
This will be completed or bonded prior to signing of the final plat.

C. (Continued from April 8, 2008) Case Number OA-96-08 a request by Caldwell's
Planning and Zoning Director for an ordinance amendment to create a new
section 10-02-04 concerning accessory buildings, structures, and uses and to
amend section 10-02-07 concerning accessory uses.
'Testimony:
l. Brian Billings(ey, Planni�ig llirector, presented the staff report. He testified tht �
t11e regu(ations for secondaiy dwelling units have been dcleted from the
proposed ordina»ce ameildment.
2. Discussion was held amongst the Commission rebarding "permanent" versus
"temporaiy" accessory uses and it was determined tllat it would be best if tlie
word "permanent" was deleted from Section l 0-02-04(B)
3. Discussion then ensued regarding the setback requirements to the ponds.

Camprehgnsive Plan Analysis Case No. OA-96-08 — Accepted MOTION: Commissioner
Shaffer SECOND: Commissioner Wallace . Passed: Unanimous roll call vote.
Recommendation on Case No. OA-96-08 - MOTION: Commissioner Shaffer SECOND:
Commissioner OldenKamp. The Commission voted to recommend Approval with the following
modifications:
• 6.2 Change Section 10-02-04(B) that States: "Except as otherwise regulated herein, a
permanent accessory..." to "Except as otherwise regulated herein, an accessory...' which
deletes the word "permanenY'.
• Delete setback requirements for any ponds and/or water features.
VI. NEW BUSINESS
B. Case Number OA-100-08 a request by Caldwell's Planning and Zoning
Director for an ordinance amendment to sections 10-03-07 regarding the
planned unit development ordinance, 10-03-02 regarding duties of the Planning
and Zoning director, and 10-03-03 regarding amendment reclassification.
Testimony:

report.
Comprehensive Plan Analysis OA-100-08 — Accepted MOTION: Commissioner Runsvold
SECOND: Commissioner Wallace . Passed: Unanimous roll call vote.
Recommendation on Case No. OA-100-08 - MOTION: Commissioner Runsvold SECOND:
Commissioner Wallace. The Commission voted to recommend Approval.
C. Case Number OA-101-08 a request by Caldwell's Planning and Zoning Director
for an ordinance amendment to sections 10-02-08 regarding nonconforming
uses, 10-03-04 regarding special uses, 10-03-05 regarding variances, 10-02-01
regarding general regulations, 10-03-01 regarding duties of the commission and
to create a new section 10-03-12 regarding neighborhood meetings.
1. Anne Marie Skinner, Senior Planner, presented the staff report and
explained the changes to the ordinance.
2. The Commission addressed their concems with Ms. Skinner.

SECOND: Commissioner Wallace . Passed: Unanimous roll call vote.
Recommendation on Case No. OA-101-08 - MOTION: Commissioner Wallace SECOND:
Commissioner OldenKamp. The Commission voted to recommend Approvai with the following
modification:
• Under Section 10-02-�8(3)(D}(3) regarding the length of time allowed for the
absence of a farm animal the words "one day" shall be changed to "one month"
for horses and other usual farm animals.
