Review of Proceeding — Commissioner Jakobson annaunced the procedures for the public hearing. III. Oicl Business A. Approve m.inutes of December 1 l, 2007. MOTION: Commissioner Runsvold SECOND: Commissioner Shaffer. Passed: Unanimous roll call vote. NEW BU5INESS B. Case Number OA-94-08, a request by Caldwell's Planning and Zoning Director for an Ordinance Amendment for adoption of an amended zoning map. Testimany: � 1. flnne 1Vlarie Skinner, Senior Plznner, presented the staff report. Findings of Fact on Case Number OA-94-08 — Accepted MOTION: Commissioner Jakobson SECOND: Commissioner Wallace. Passed: Unanimous roll call vote. � 1 Conclusions of Law on Case No. OA-94-08—The conclusions of law were read and accepted. MOTION: Commissioner Shaffer SECOND: Commissioner Runsvold Passed: Unanimous roll call vote. Recommendation on Case No. OA-94-08- MOTION: Gommissioner Runsvold SECOND: Commissioner Waliace. The Commission voted to recommend Approval. C. Case Number OA-93-07/ZON-53-07, a request by Caldwell's Pianning and Zoning Director to amend City Code Section 10-01-03 regarding zoning district purpose statements; Section 10-02-02 regarding the land use table; Section 10- 02-08 regarding nonconforming uses; creating two new zoning classifications — the Airport District (A-D) and the Hospital District (H-D); and, amending the official zonir�g map to identify the location of the new zones. Testimony: l. Brian Bill.ingsley presented the staff report and explained the reason behind the proposed Hospital and Airport Districts. Mr. Bi.11ingsley th.en read through a portion of the proposed ordinance. 2. Con�miss.ioiler Shaf.fer asked why the word "Lake" was used for tl�e Lake Zone. 3. Mr. I3illingsley stated that the Lake Zone is used far properties near Lake Lowell. and the Boise River. Mr. I3illingsley then stated that any suggested chan�es should be expressed when the commission makes their recommendation. 4. Anne Marie Skimier stated that the airport zo»e aerial photo will be labeled as P7-1000 and tlae Hospital .7_,one aerial photo will be labeled as PZ-1001. 5. Commissioner Runsvold then asked if tl�e heliport is a Special Use. 9. Ms. Taylor stated that St. I�uke's would I.ike for it to be a permitted use ratlier than a s}�ecial use. ] 0. Ms. Skinner then labeled Mr. Kerrick's list of suggestioils as PZ-1002. 12. Dave McFaddon, representing V4'est Va.11ey M:edical Cet�ter, signed in favor of the application and sta�ted that he also tlacaught that the helipad should. be a pennitted use rather than a special use. 13. Commissioi�er Runsvold asked how tl�e city would l�ave i�?put in how the helipad was installed and operated. 14. Mr. McFaddon stated thal there wouldn't be any input required fi•om the city. l5. Mr. Runsvold then asked what ail impact the helipad would. l�ave on any su.rroundv�g single family resid.ences in that area. l6. M:r. McFaddon stated that there wou.ld only be about 3 or 4 helicopter flights per year. 17. Robert McGee signed in favor of tl�e application and provided supporting testimony regarding the project and the l�el'rpad. 18. Bobbi Jo Brown signed in neutra.l to tlle application as well as tlie helipad.. 1VIs. Brown then agreed ��ith all of David Kerrick's concerns. Ms. Brown then stated that she would like to hear some e�amples of the pros and cons that the hospital district may have effect on the surroundina nei�hborhood. 19. Mr. McFaddon then stated that the }-3ospit�l District will help to speed tlie process up to be able to help the medical field �raw wiih the city. � Z0. Jol�n Blaisdell si.gned in neutral to the application and then stated that he did not agree with Mr. Kerrick's request. Mr. Bla:isdell then stated that the hospitat district is well overdue and a wonderful idea. Mr. Blaisdell then stated that the four properties on 10'�' a.venue should. remain R-1 and that a helipad sl�ould be a permitted use. 21. Jose Rodriguez signed in opposition but declia�ed to speak. 22. 1lndrea Pratt signed in opposition but declined to speak. 23. Brian Billingsley stated t11at.�llen the recomuiendation is �n�de on the rezone tl�e commission should recommend whether or not the 4 properties on 10 Ave. should remain R-1 or be included in the Hospital District. Mr. Billingsley then. stated that th.e items that were suggested to be either made a special or permitted use should be included into tlle Commission recommendation also. 24. Commissioner Shaffer stated that it wauld be a good idea to hatve public input at the time the d�ecision is mad.e regarding tl�e locat�ion of any helipads. 25. Mr. Biilingsley stated tl�at in his opinion the heliporl cou.ld be disruptive to nearby rzsidents. Skimler stated tllat Multi-family dwelliiigs are a permitted use in the Hospital District. Commissioner Wallace asked staff if a convalescent dwelling would be a non-conforming use i.f multi-family dwellings were to be made non-conform.i.ng. Mr. Billingsley then stated that the City of Boise permits multi family dwellings, convalescent homes, duplexes and parking garages in their district that is similar to our proposed Hospital District. Ms. Skinner stated that the Hospital District may expand in years to come as a result of the surrounding property owners applyin.g for a rezone into the district. Comprehensive Plan Analysis ZON-53-07 — MOTION: Commissioner Runsvold SECOND: Commissioner Shaffer . Passed: Unanimous roll call vote. Tollman Abstained Findings of Fact on Case Number ZON-53-07 — Accepted MOTION: Commissioner Shaffer SECOND: Commissioner Wallace. Passed: Unanimous roil call vote. The Commission voted to recommend Approval with the following conditions: Tollman Abstained • No modifications Comprehensive Plan Analysis OA-93-07 — MOTION: Cammissioner Runsvold SECOND: Commissioner Wallace . Passed: Unanimous roll call vote. Recommendation on Case No. OA-93-07 - MOTION: Commissioner Runsvold SECOND: Commissioner Wallace. The Commission voted to recommend Approval with the following conditions: • HD-Parking garages made a special use • HD-Multi-family dwellingsmade a special use • HD-Barber/ beauty shops, photographic studio, catering service made a permitted use • HD-Hotel made a special use D. Case Number ZON-55-07 & OA-95-08 a request by Caldwell's Planning and Zoning Director to rezone a portion of the Steunenberg Residential Histaric District from R-2 (Medium Density Residential) to R-1 (Low Density Residential) and to amend City Code Section 10-02-08 regarding nonconforming uses. 1. Brian Billingsley, Planning Director, presented the staff report and read off 5 reasons that the rezone should be approved. Mr. Billingsiey stated that anyone that currently has a multi family dwelling would be exempt from obtaining a variance to rebuild their multi family dwelling should it be destroyed. Mr. Billingsley then read into the record 2 letters that were submitted in opposition to the application, Exhibit PR-2 (Jim Rice) and Exhibit PR-3 (William Walsh). 2. Commissioner Shaffer asked if an inventory of the praperties and their historic value was taken. 3. Mr. Billingsley stated that there was an inventory taken before the historic district was assigned. 4. Commissioner Wallace asked about existing businesses on Cleveland Bivd and whether or not those businesses would be a conforming use. 5. Mr. Billingsley stated that those businesses would be grandfathered in. 6. Connie King signed in favor of the application, provided supporting testimony and inquired about rehabbing the home that she owns. 7. Sharon Huffman signed in opposition but passed on speaking. 8. Brian Billingsley stated that maybe the homes that are in the area of the historical district that don't appear historic need to be rehabilitated.
