CALDWELL PLANNING & ZONING COMMISSION
MINUTES
September 13, 2005
I. Call to Order — Chairman Alldredge called the meeting to order for the public
hearing at 7:07 p.m.
II. Roll Call —
Members Present: Paul Alidredge, Gene Shaffer, Jack Teraberry, and Joyce
G riffith.
Members Absent: Michael Jakobson and Dennis Callsen.
Staff Present: Gian Paolo Mammone, (Community Development Director),
Melodie Halstead, (Planner), Debbie Geyer (Specialist), Mark Hility, (City
Attorney) and Ben Weymouth (City Assistant Engineer).
III. Review of Proceeding — Chairman Paul Alldredge reviewed the procedures
for public hearing.
IV. Old business
A. Case No. SUB-120P-05, a request by Mitch Frank for preliminary plat
approval of Michala Subdivision, that consists of 10 residential Iots and 2
common lots on 2.38 acres in an R-2 (Combined Medium Density
Residential) zone. The site is generally located on the east side of Georgia
Avenue, approximately 327.94 feet south of Beech Street.
Melodie Halstead, Planner, presented the staff report.
Curt Smith, Applicant Representative, testified in favor.
Jim Hawkins, Applicant Representative, testified in favor.
Mitch Frank, Applicant, signed in favor, but chose not to speak.

Comprehensive Plan Analysis - MOTION: Commissioner Shaffer,
SECOND: Commissioner Teraberry. The request was applicable to the
following Comprehensive Plan Components as outlined in the staff report:
Property Rights — Goal, Objective B and Policy 1; School Facilities and
Transportation — Goal and Policy 1; Economic Development — Goal; Land
Use — Goal, Objectives A and C; Natural Resources — Goal, Objectives A, C
and Policy 1; Public Services, Utilities and Facilities — Goal, Objectives A, B,

C, D, Policy 1, 2, 3, 5 and 7; Transportation — Goal, Objectives A, B, C,
Policies 2 and 5; Hazardous Areas Component — Goal, Objectives A, B and

Findings of Fact on Case No. SUB-120P-05 - MOTION: Commissioner
Griffith SECOND: Commissioner Teraberry. Accepted the general facts
outlined in the staff report, public testimony and Exhibit PZ-1000 (Letter from
JUB, Gary Lee) and Exhibit PZ-1001 (Letter from Evelyn Wise) as part of the
Findings of Fact. Passed: Unanimous roll call vote.
Conclusions of Law on Case No. SUB-120P-05 - MOTION: Commissioner
Teraberry SECOND: Commissioner Griffith. The Planning & Zoning
Commission has the authority to hear this case and to approve or deny it.
The public notice requirements were met and the hearing was conducted
within the guidelines of applicable Idaho Code and City ordinances. Passed:
Unanimous roll call vote.
Recommendation on Case No. SUB-120P-05 - MOTION: Commissioner
Shaffer SECOND: Commissioner Teraberry. The Commission approved
Case No. SUB-120P-05 with the conditions outlined in the staff report.
Passed: Unanimous roll call vote.

V. New Business
A. Case No. ACI-02-05, a request by the Planning & Zoning Commission to
adopt an ordinance regarding the Caldwell Area of City Impact to include a
Savings Clause, establishing Rules for Annexation; establishing applicable
Comprehensive Plans and Ordinances; provide for Zoning and Subdivision
Ordinance Amendment Proposals, establishing Application Procedures;
providing for Amendment; Severability and Effective Date.
Debbie Geyer, Planner, presented the staff report.
Mark Hilty, City Attorney, outlined the facts concerning the application.
Jeanne King, testified in favor.

Conclusions of Law on Case No. ACI-02-05- MOTION: Commissioner

Commission has the authority to hear this case and to approve or deny it.
The public notice requirements were met and the hearing was conducted
within the guidelines of applicable Idaho Code and City ordinances. Passed:
Unanimous roll call vote.
Recommendation on Case No. ACI-02-05- MOTION: Commissioner Griffith
SECOND: Commissioner Teraberry. The Commission approved Case No.
ACI-02-05 with the conditions outlined in the staff report. Passed: Unanimous
roll call vote.

hearing.

B. Case No. OA-67-05, a request by the Caldwell Community Development
Department to update the Comprehensive Plan Text (Part I) concerning the
City of Caldwell and its impact area. The proposed amendments speak to
growth within the City of Caldwell by addressing the following components: 1)
Creating livable, affordable and ecologically sustainable communities; 2)
Developing walkable neighborhoods with the local centers where people can
live, work, and play throughout their lifetime; 3) Respecting viable agricultural
uses and maintain the integrity of groundwater resources, air quality and
streams; 4) Planning for adequate public infrastructure and services including
school, utilities, roads, transit, open space and recreation and 5) Providing
effective public safety services. The Comprehensive Plan proposal envisions
a city with a range of housing opportunties and a balance mix of land uses.

C. Case No. OA-69-05, a request by the Caldwell City Center Steering
Committee to amend the Caldwell Zoning Ordinance to include the City
Center Zoning District to address revitalization of the downtown by 1)
Creating a livable, sustainable City Center; 2) Encouraging mixed use
development in the Downtown; 3) Redeveloping the City Center into the
western hub of the Treasure Valley; 4) Creating green areas and improving
quality of life; and 5) Preserving historic buildings.
Debbie Geyer, Planner, presented the staff report. She presented the ,
following exhibits: �

source.
