CALDWELL PUBLIC HEARING BEFORE HEARING EXAMINER
MINUTES I
June 28, 2005
I. Call to Order — Hearing Examiner, M. Jerome Mapp, opened the meeting for the
public hearing at 7:00 p.m.
II. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for the
public hearing.
Members Present: Debbie Geyer (Specialist), Wendy Kirkpatrick (Senior
Planner), and Gordon Law (City Engineer).
III. Old Business
IV. Hearings —
A. To hear concurrently Case Nos. SUB-119P-05, SUP-247-05 and OA-68-05,
requests by Land Group, Inc., for preliminary plat approval of 83 residential lots
and 4 common tots on 30.86 acres in a C-3 (Service Commercial) zone, and
special use permit to allow four-plex apartments within a commercial zone, and a
zoning ordinance text amendment for the purpose of requesting reduced frontage
requirements for multi-family residential development. The site fronts Cleveland
Boulevard, west of Hoffman Lane at the northeast corner of the Homedale and
Cleveland Boulevard intersection.
Wendy Kirkpatrick, Planner, announced Matt Schultz, Applicant's
Representative, request for continuance of Public Hearing on July 12, 2005
before the Caldwell Planning 8� Zoning Commission.

B. To hear concurrently Case Nos. SUP-248-05 and VAR-29-05 requests by the
City of Caldwell for special use permit approval and variance for an emergency
cell tower within an R-1 (Single-Family Residential) zone to be placed on public
property located at 302 Maple.
The Hearing Examiner, Jerome Mapp, had a conflict of interest. Mr. Mapp
requested continuance of the Public Hearing on July 12, 2005 before the
Caldwell Planning & Zoning Commission.
Public testimony closed — Mr. Mapp closed public testimony.

C. Case No. SUP-245-05, a request from Houston-Bugatsch Architects for special
use permit approval for a public education facility (Thomas Jefferson Charter
School) within a C-2 (Community Commercial) zone located at 4112 Skyway
Street.
Testimony:
Wendy Kirkpatrick, Planner, presented the staff report.
Rick Bugatsch, Applicant's Representative, testified in favor.
Ben Weymouth, City Assistant Engineer, presented facts concerning the
application.

Comprehensive Plan Analysis: Mr. Mapp found that the request was applicable
to the following Comprehensive Plan components: Property Rights - Goal,
Objectives B and Policy 1; School Facilities and Transportation — Goal and Policy
1; Economic Development — Goal; Land Use — Goal, Objectives Applicable to All
Land Uses — Objective A and C; Natural Resources — Objectives A, C and Policy
1; Public Services, Utilities and Facilities — Goal and Objective B; Transportation
— Goal and Objectives A.
Findings of Fact on Case No. SUP-245-05: The Hearing Examiner accepted
the general facts as outlined in the staff report, public testimony and Exhibit PZ-
1000.
Conclusions of Law on Case No. SUP-245-05: The Hearing Examiner
accepted the Conclusions of Law as outlined in the staff report.
Order of Decision on Case No. SUP-245-05: The Hearing Examiner approved
Case No. SUP-245-05 with the conditions outlined in the staff report.
Public Hearing Closed - Mr. Mapp closed the public hearing.

D. Case No. SUP-246-05, a request by Roland Johnson for special use approval for
a Group Daycare within a R-1 (Single-Family Residential) zone located at 3205
Regent Place.
Testimony:
