Call to Order — Chairman Alldredge calied the meeting to order for the public hearing at 7:05 p.m. II. Roll Cali — Members Present: Paul Alidredge, Jack Teraberry, Joyce Griffith, Gene Shaffer, Michael Jakobson and Dennis Cailsen. Members Absent: Christina Marroquin. Staff Present: Wendy Kirkpatrick (Planner) Debbie Geyer (Specialist), and Ben Weymouth (City Assistant Engineer). III. Review of Proceeding — Chairman Paul Alldredge reviewed the procedures for public hearing. IV. Old business A. MOTION/Approve minutes of March 15, 2005, April 12, 2005 and April 26, � 2005. Unanimous roll call vote. -- V. New Business A. Case No. SUP-242-05, a request by Leslie Dean for a special use permit approval to construct a childcare center facility in a C-2 (Community Commercial) zone. This site is located at 1011 Main Street. Debbie Geyer, Specialist, presented the staff report. Wendy Kirkpatrick, Planner, presented facts concerning the staff report. Ben Weymouth, Assistant City Engineer, presented facts concerning the staff �eport. Leslie Dean, Applicant, testified in favor. Joyce L. Ketter, testified as neutral. Testimony closed. Note: See Order of Decision for complete testimony or contact Community Development Department for audio tapes of the hearing. Comprehensive Plan Analysis - MOTION: Commissioner Callsen, SECOND: Commissioner Teraberry. The request was applicable to the following Comprehensive Plan Components as outlined in the staff report: Property Rights — Goal, Objective B and Policy 1; School Facilities and Transportation — Goal and Policy 1; Land Use — Goals I, II, III and IV; � Objectives Applicable to Ail Land Uses — Objective A; Policies for Residential Use — Policy 1; Public Services, Utilities and Facilities — Goals I, II, Objective B, Policies 1 and 5; Transportation — Goals Applicable to Circulation I, II and Objective A. Findings of Fact on Case No SUP-242-05 - MOTION: Commissioner Griffith SECOND: Commissioner Shaffer. Accepted the general facts outlined in the staff report, public testimony and Exhibits PZ-1000 (Letter from Philip Braun); PZ-1001 — 1003 Elevation & Site Plans from the Applicant as part of the Findings of Fact. Passed: Unanimous roll call vote. Conclusions of Law on Case No. SUP-242-05 - MOTION: Commissioner Shaffer SECOND: Commissioner Griffith. The Planning & Zoning Commission has the authority to hear this case and to approve or deny it. The public notice requirements were met and the hearing was conducted within the guidelines of applicable Idaho Code and City ordinances. Passed: Unanimous roll call vote. Order of Decision on Case No. SUP-242-05 — MOTION/ Commissioner Shaffer; SECOND/ Approve the special use permit with the following conditions: 8.2 — 8.12 with the addition of the following; 8.13 The Applicant's architect provide a study to be presented to city staff for review and approval that it will utilize elements from the design guidelines from the Steunenberg Historic District thus allowing the elevation to be more congruent with historic elements. Such elements could include brick fenestration at the eves, trim at the windows, etc. 8.14 The City and the TrafFc Commission to review the possibility of implementation of diagonal parking at the site within a period of four weeks. The motion died due to the lack of a second. MOTION/ Commissioner Shaffer; SECOND/ Motion restated to exclude condition 8.14 and let the motion stand. The motion died due to the lack of a second. MOTION/ Commissioner Griffith; SECOND/ Commissioner Teraberry. Reopen discussion on the issue. Discussion was held as to the Applicant possibly voluntarily adding the historic elements to the design without making such a condition of approval. MOTION/ Commissioner Griffith; SECOND/ Commissioner Teraberry. Discussion closed. Order of Decision on Case No. SUP-242-05 — MOTION: Commissioner Callsen SECOND: Commissioner Griffith. The Commission approved Case No. SUP-242-05 with the conditions outlined in the staff report. Passed: Unanimous roll call vote. ................................................................
