Call to Order — Vice-Chairperson, Joyce Griffith, called the meeting to order for the public hearing at 7:10 p.m. I1. Roll Call — Members Present: Joyce Griffith, Gene Shaffer, Michael Jakobson and Dennis Callsen. Members Absent: Paul Alldredge and Jack Teraberry Staff Present: Wendy Kirkpatrick (Planner) Debbie Geyer (Specialist), Gian Paolo Mammone (Director) and Ben Weymouth (City Assistant Engineer). III. Review of Proceeding — Vice-Chairperson, Joyce Griffith, reviewed the procedures for public hearing. IV. Old business A. Case No. SUP-237-05, a request by Canyon County Commissioners for a special use permit approval to construct a public work release center for inmates. The location is known as 304 N. 12th Ave. Wendy Kirkpatrick, Senior Planner, presented the staff report and outlined the facts as written. � Rita Earl, ApplicanYs Representative, testified in favor of the application. lan Shewring, ApplicanYs Architect, testified in favor of the application. Paul Shriver, Representative from Sprung Instant Structures, testified in favor of the application. Andrew Eveland, Canyon County Building Superintendent, testified in favor of the application. Chris Smith, Canyon County Sheriff, testified in favor of the application. Robert Munsey, Canyon County Staff, testified in favor of the application. Chad Sarmento, Canyon County Staff, testified in favor of the application. Matt Beebe, Canyon County Commissioner, testified in favor of the application. Robert Sobba, Caldwell Police Chief, testified in favor of the application. Bob Carpenter, testified as neutral to the application. Elaine Carpenter, testified in opposition to the application. Anita Shore, signed in opposition to the application but chose not to speak. Lorene Oates, testified in opposition to the application. Gian Paolo Mammone, Community Development Director, gave comments concerning the application. Matt Beebe, spoke in rebuttal to testimony. Testimony closed. Comprehensive Plan Analysis - MOTION: Commissioner Callsen, SECOND: Commissioner Shaffer. The request was applicable to the following Comprehensive Plan Components as outlined in the staff report: Property Rights — Goal, Objective B and Policy 1; School Facilities and Transportation — Goal and Policy 1; Economic Development — Goal; Land Use — Goal; Objectives Applicable to All Land Uses — A and C; Natural Resources — Objective C and Policy 1; Public Services, Utilities and Facilities — Goal and Objective B; Transportation — Goal and Objective A. Findings of Fact on Case No SUP-237-05 - MOTION: Commissioner Shaffer SECOND: Commissioner Jakobson. Accept the general facts outlined in the staff report, public testimony, and Exhibit PZ-1000 (Work Release Center Elevation Drawings) as part of the Findings of Fact. Passed: Unanimous roll call vote. Conclusions of Law on Case No. SUP-237-05 - MOTION: Commissioner Jakobson; SECOND: Commissioner Shaffer. The Planning & Zoning Commission has the authority to hear this case and to approve or deny it. The public notice requirements were met and the hearing was conducted within the guidelines of applicable Idaho Code and City ordinances. Passed: Unanimous roll call vote. � Order of Decision on Case No. SUP-237-05 - MOTION: Commissioner Callsen; SECOND: Commissioner Shaffer. The Commission approved Case No. SUP-237-05 with the conditions outlined in the staff report. Passed: Unanimous roll calt vote. ................................................................ V. New Business B. Case No. SUB-94P(E)-03, a request by IFI Partners, for a one-year extension of the preliminary plat of Newbury Estates on approximately 19 acres, which consists of 50 single-family residential lots and 6 common lots in an R-1 (Single-Family Residential) zone. The site is located on the east side of Airport Avenue and approximately 200 feet north of Ustick Road. Debbie Geyer, Community Development Specialist, presented the staff report and outlined the facts as written. Accept the general facts outlined in the staff report and public testimony as part of the Findings of Fact. Passed: Unanimous roll call vote.
