Call to Order — Chairman Alidredge called the meeting to order for the public hearing at 7:05 p.m. II. Roll Call — Members Present: Paul Alldredge, Jack Teraberry, Joyce Griffith and Dennis Callsen. Members Absent: Michael Jakobson, Gene Shaffer and Christina Marroquin. Staff Present: Joan Johnson (Planner), Debbie Geyer (Specialist) and Ben Weymouth (City Assistant Engineer). III. Review of Proceeding — Chairman Paul Alldredge reviewed the procedures for public hearing. IV. Old business A. MOTION/Approve minutes of February 8 and February 17, 2005. Passed: Unanimous roll call vote. V. New Business A. To hear concurrently Case Nos. ANN-101-05 and SUB-116P-05, requests by Providence Development LLC for annexation of approximately 39.57 acres as an R-1 (Single Family Residential) zone (to include a development agreement) and preliminary plat approval of Kingsview Estates consisting of 146 residential and 12 common area lots. The site abuts the west side of S. Indiana Avenue and is located approximately 1320 feet north of Karcher Road/ Hwy 55. Joan Johnson, Associate Planner, presented the staff report. Ben Weymouth, Assistant City Engineer, presented facts concerning the staff report. Matt Schultz, Applicant, testified in favor, presented landscape conceptuals plans Exhibit PZ-1000. Comprehensive Plan Analysis - MOTION: Commissioner Callsen, SECOND: Commissioner Teraberry. The request was applicable to the following Comprehensive Plan Components as outlined in the staff report: . , Property Rights — Goal, Objectives A and B and Policy 1; School Facilities and Transportation — Goal; Natural Resources — Policy 1; Public Services, Utilities and Facilities — Goal, Objectives A, B and C; Public Safety Component — Goals I, II, Objectives A and B. Findings of Fact on Case No ANN-101-05 - MOTION: Commissioner Griffith SECOND: Commissioner Teraberry. Accepted the general facts outlined in the staff report, and public testimony as part of the Findings of Fact. Passed: Unanimous roll call vote. Conclusions of Law on Case No. ANN-101-05 - MOTION: Commissioner Callsen SECOND: Commissioner Teraberry. The Planning & Zoning Commission has the authority to hear this case and to approve or deny it. The public notice requirements were met and the hearing was conducted within the guidelines of applicable Idaho Code and City ordinances. Passed: Unanimous roll call vote. Recommendation on Case No. ANN-101-05 (TO INCLUDE A DEVELOPMENT AGREEMENT) - MOTION: Commissioner Callsen SECOND: Commissioner Griffith. The Commission approved Case No. ANN- 101-05 with the conditions outlined in the staff report. Passed: Unanimous roll call vote. Comprehensive Plan Analysis - MOTION: Commissioner Callsen, SECOND: Commissioner Teraberry. Case No. ACI-01-05, a request by the Planning and Zoning Commission to expand the CaldwelUCanyon County Area of City Impact boundary. The proposed areas to be expanded are generally as follows: Beginning on the existing boundary at Middleton Road and Lincoln Road, then east to Midland Rd, north to the Boise River and east to Madison Road. Then south on Madison Road to 1/2 mile south of Linden Street, west to Midland Road, south to Laster Street, west to Middleton Road. In addition, the area between Lincoln Road and KCID north to the Boise River and west to the existing northern boundary. � I Joan Johnson, Associate Planner, presented the staff report. , Testimony closed.
