CALDWELL HEARING EXAMINER -

I. Call to Order — Hearing Examiner, Mr. Jerome Mapp, opened the meeting for
the public hearing at 7:00 p.m.
11. Review of Proceedings — Mr. Jerome Mapp outlined the procedures for the
public hearing. I
Members Present: Brian Billingsley (Planning Director), Anne Marie Skinner I
(Senior Planner), Savanna Davis (Secretary), Brent Orton (Engineering
Department).
III. Old Business '

A. Mr. Mapp approved the minutes of the December 27, 2006 meeting. I�
B. Case Number ANN-138-06 I SUP-285-06 & Case Number ANN-137-06 are all ,
continued to February 27, 2007. ',
� IV. New Business
A. Case Number SUB-165PF-06, a request by Treasure Valley Engineers for short ,
plat approval of Holman Industrial Park with 2 building lots. This site is located on
Industrial Way, southwest of I-84.
Testimony:
1. Anne Marie Skinner, Senior Planner, presented the staff report.
2. Penelope Riley, applicant's representative, signed in favor of the
application and provided supporting testimony.
3. Lance Warrick signed in favor of the application and clarified that an
agreement will be put into place regarding parking spaces.
Public testimony closed — Mr. Mapp closed public testimony.
Comprehensive Plan Analysis: Mr. Mapp found that the request was applicable
to the Comprehensive Plan components listed in Sections 5.1 through 5.3 in the
staff report.
Findings of Fact: The Hearing Examiner accepted the general facts as outlined
in the staff report, public testimony, and the evidence list as a part of the
� Findings.
Conclusions of Law: The Hearing Examiner accepted the Conclusions of Law
• as outlined in the staff report.
Order of Decision: The Hearing Examiner recommended that Case Number
ANN-136-06 & SUB/PUD-161 P-06 be approved with the following conditions:
• 8.2 - 8.8
• 9.1- cross access agreement
• 9.2- road users agreement
B. Case Number SUB-165PF-06, a request by Treasure Valley Engineers for short
plat approval of HTH Subdivision with 3 building lots. This site is located east of
Farmway at the end of Holman Ct.
Testimony:
1. Anne Marie Skinner, Senior Planner, presented the staff report.
2. Penelope Riley, applicant's representative, stated that she concurred with
staff's comments and recognized that there would be a cross access
agreement and a road users agreement in place.
Public testimony closed — Mr. Mapp closed public testimony. '
� Public testimony re-opened- Mr. Mapp re-opened the public testimony.
1. Larry Questad signed as neutral to the application and provided
testimony stating his concerns for noise, dirt and the buildings that are
proposed without a specified use. He also stated that he was notified
of this project through the mail and was instructed by Caldwell
Planning and Zoning Department to attend this meeting to obtain
more information.
2. Mr. Mapp clarified to Mr. Questad that the buildings built would have
to be an industrial use.
3. Ms. Riley stated that the site would be industrial and there would be
no specific uses designated at this time.
4. Mr. Mapp suggested that Mr. Questad speak with the applicant after
the meeting to obtain more information.
Public testimony closed — Mr. Mapp closed public testimony.

C. Case N�amber ANN-142-06 & SUB-167P-06 a request by Dyver Development for
the annexation of 46.33 acres into the city with R-1 (Single-Family Residential)
Zoning and preliminary plat approval of Klamath Falls Subdivision with 170
residential lots and 10 commons lots. This site is located between Lake Ave. &
the Wilson Drain on the south side of Moss Ln.
Testimony: I
1. Anne Marie Skinner, Senior Planner, presented the staff report. I
2. Kent Brown, applicant's representative, provided supporting testimony !
• and submitted a letter labeled as exhibit pz-1000. �
3. Mr. Mapp spoke with staff.
4. Mr. Brown stated that the irrigation is located off the Thinton Lateral.
5. Mr. Brown stated that staff asked them to build half of the Wilson drain
bridge. He also stated that he thought that Dakota Crossing should have ,
to pay for a portion of the bridge.
6. Mk. Mapp stated that he has required other subdivision's to pay up also.
7. Brent Orton, City engineer, stated that the City of Caldwell is asking
Klamath Falls to construct the south side underside of the bridge and the
middle portion.
8. Mr. Brown stated that he doesn't feel he should be responsible for the
cost of the sewer being put in because this development does not
connect to that sewer, it would serve the west properties.
9. Mr. Orton stated that developments are required to install some master
plan trunk lines because everyone benefits from everyone else's sewer
installation.
10. Mr. Brown referred to item number 11.28 in the staff report and stated
that they would work with the Brown Bus Company to meet all of their
requirements.
11. Mr. Mapp stated his concerns for proper lighting and landscaping around
the bus stops. He also stated that he does not want any driveways within
the vision triangle. Mr. Mapp asked if phase 2 block 7 lots 18-20 was a
roadway.
12. Mr. Brown stated that it was a micro-path connection for the drain.

� 13. Mr. Mapp asked how many years it would take to complete the
subdivision.
14. Anne Marie Skinner started that the applicant would have 24 months for
completion of the first phase and 12 months for every phase�after that.
15. Mr. Mapp asked Mr. Brown if he had any problem with the phasing time
frames.
16. Mr. Brown stated that he did not at this time. �
17. Scott Woods, applicant's representative, signed in favor of the application
and stated that they had already paid for the trunk line thaf crosses their
property along the Wilson drain.

18. Mr. Mapp stated that he would like Brent Orton to clarify condition 12.1
verbally and in a written statement.
Public testimony closed — Mr. Mapp closed public testimony.

staff report.
Findings of Fact: The Hearing Examiner accepted the general facts as outlined
in the staff report, public testimony, and the evidence list as a part of the

Conclusions of Law: The Hearing Examiner accepted the Conclusions of Law
as outlined in the staff report.
Order of Decision: The Hearing Examiner recommended that Case Number
ANN-142-06 & SUB167P-06 be approved with conditions 11.2-11.30 with
clarifications made by Mr. Orton concerning the bridge.
Mr. Orton stated that the applicant shall be responsible for the south half of the
bridge culvert understructure over the Caldwell Feeder Canal and surface street
improvements to the center line of said canal. Mr. Orton also clarified that there
will be no improvements required by this development on the Wilson Drain only
on the Caldwell Feeder CanaL
