� CALDWELL HEARING EXAMINER

I. Call to Order - Hearing Examiner, Mr. Jerome Mapp, opened the meeting for
the public hearing at 7:15 p.m.
II. Review of Proceedings - Mr. Jerome Mapp outlined the procedures for the
public hearing.
Members Present: Anne Marie Skinner (Senior Planner), Savanna Davis
(Secretary), Brent Orton (Engineering Department).
III. Old Business
A. Mr. Mapp approved the minutes of the November 28, 2006 meeting on 12/7/06.

IV. New Business
Case Number ANN-138-06/ SUP-285-06 & ANN-137-06 are continued until
• January 23, 2007.
A. Case Number ANN-136-06 & SUB/PUD-161 P-06, a request by Landmark
Engineering and Planning for the annexation of 11.20 acres of land with R-3
(Multi-Family High �Density Residential) zoning, and for preliminary plat and
planned unit development approval of Dakota Crossing Subdivision #3 with 57
building lots and 6 common lots. The site is located at the intersection of Celeste
Ave. & Moss Lane. ( continued from 11-28-06).
Testimony:
1. Anne Marie Skinner, Senior Planner, presented the staff report and stated
that Mr. Mapp needed to specify whether the variances in items 11.31-
11.39 shall or shall not be granted.
2. Mr. Mapp suggested that the apartment complexes be in front of the
parking lot instead of behind it. Mr. Mapp also suggested that the
apartment buildings face the interior of the subdivision instead of the
exterior.
3. Jed Wyatt, applicant's representative, signed in favor of the application
and provided supporting testimony speaking of the proposed layout of the
apartment buildings and the use of the existing buildings.
4. Further discussion followed regarding items 11.33-11.39 and 11.37 shall
be eliminated.
• 5. Steve Lynn signed in favor of the application and provided supporting
testimony regarding the quality of structures to be built.

Public testimony closed — Mr. Mapp closed public testimony.
Comprehensive Plan Analysis: Mr. Mapp found that the request was applicable
to the Comprehensive Plan components listed in Sections 5.1 through 5.10 in the
staff report.
Findings of Fact: The Hearing Examiner accepted the general facts as outlined
in the staff report, public testimony, and the evidence list as a part of the
Findings.
Conclusions of Law: The Hearing Examiner accepted the Conclusions of Law
as outlined in the staff report. :
Order of Decision: The Hearing Examiner recommended that Case Number
ANN-136-06 & SUB/PUD-161 P-06 be approved with the following conditions:
• 11.2 -11.39
• delete 11.37
• add 11.40 placement of buildings on Block 3
• add 11.41 placement at Block 3 of play ground equipment
• 11.43 lot 2, block 2 approval — daycare center and lot 4 block 3
professional offices
• 11.42 No concern for access off Moss Ln. for existing buildings on Block I
• 2&3. I

The Hearing Examiner adjourned the meeting at approximately 8:05pm.
