Call to Order — Chairman Alldredge called the meeting to order for the public hearing at 7:10 p.m. II. Roll Call — Members Present: Paul Alldredge, Jack Teraberry, Gene Shaffer, Dennis Callsen, Michael Jakobson and Christina Marroquin. Members Absent: Joyce Griffith Staff Present: Wendy Kirkpatrick (Senior Planner), Jacqueline Hernandez (Planning Technician) and Ben Weymouth (City Assistant Engineer). III. Review of Proceeding — Chairman Paul Alldredge reviewed the procedures for public hearing. IV. Old business V. New Business A. CASE NUMBER ANN-98-04, a request by Combs Land Development, Inc. for approval to annex approximately 420 acres into the City as an R-1 (Single • Family Residential) zone to include a development agreement. Parcels 1, 2, and 3 are bounded by Orchard Avenue to the south, Tenth Avenue to the west, and Indiana Avenue to the east. Parcel 4 is located at the northeast intersection of Karcher Road and Indiana Avenue. Parcel 5 abuts Indiana Avenue to the east and approximately'/e mile south of the Karcher Road and Indiana Avenue intersection. Parcel 6 abuts Karcher Road to the south and approximately '/4 mile east of the Karcher Road and Indiana Avenue intersection. As a part of the annexation request, the Comprehensive Plan Land Use Map would be amended to designate this parcel as residential/commercial; the amendment would be included in the next available update of the Comprehensive Land Use Map. Wendy Kirkpatrick, Community Development Senior Planner, presented the staff report. Toni Elordi, Applicant Representative, testified in favor. Reese Leavit, Applicant Representative, testified in favor. Chuck Stadick, signed in favor, but did not to speak. Mike Berett, signed in neutral, but did not to speak. Buzz Beaucamp, signed in opposition, but did not speak, presented Exhibit • PZ-1000, Chairman Alldredge read letter into the record. • Deborah J Overton, signed in opposition, presented Exhibit PZ-1001. Scott Spencer, signed in opposition, presented Exhibit PZ-1002. Daniel Myers, signed in opposition. Joe Cox, signed in opposition. Steve Franklin, signed in opposition, presented Exhibit PZ-1003. Butch Myers, signed in opposition, but chose not to speak. Mike Huskey, signed in opposition, but chose not to speak. Debra Shultz, signed in opposition, but chose not to speak. Comprehensive Plan Analysis - MOTION: Commissioner Callsen, SECOND: Commissioner Jakobson. Findings of Fact on Case No ANN-98-04 - MOTION: Commissioner Shaffer SECOND: Commissioner Callsen. Accepted the general facts outlined in the staff report, public testimony and Exhibits PZ-1000 - PZ-1003 as part of the • Findings of Fact. Passed: Unanimous roll call vote. Planning & Zoning Commission Minutes - February 17, 2005 Page 2 of 3 r ,� 1 Conclusions of Law on Case No. ANN-98-04 - MOTION: Commissioner • Jakobson SECOND: Commissioner Callsen. The Planning & Zoning Commission has the authority to hear this case and to approve or deny it. The public notice requirements were met and the hearing was conducted within the guidelines of applicable Idaho Code and City ordinances. Passed: Unanimous roll call vote. Recommendation on Case No. ANN-98-04 - MOTION: Commissioner Callsen SECOND: Commissioner Jakobson. The Commission approved Case No. ANN-98-04 with the conditions outlined in the staff report. Passed: Unanimous roll call vote. Public Hearing Closed — Chairman Paul Alldredge closed the public hearing. ................................................................ VI. Planning Issues: A.
