CALDWELL PLANNING & ZONING COMMISSION
• MINUTES
November 16, 2004
I. Call to Order — Chairman Alidredge called the meeting to order for the public
hearing at 7:08 p.m.
II. Roll Call —
Members Present: Paul Alldredge, Michael Jakobson, Jack Teraberry,
Joyce Griffith, Christy Marroquin, and Gene Shaffer.
Members Absent: Dennis Callsen
Staff Present: Mark Hilty (City Attorney), Wendy Kirkpatrick (Senior Planner),
and Debbie Geyer (Community Development Specialist). ,
III. Review of Proceeding — Chairman Alldredge reviewed the procedures for
public hearing.

A. CASE NUMBER OA-64-04; Continuation of Public Hearing (legislative) IN
• COMPLIANCE With Idaho Code 67-6511 and 67-6509, the Planning and
Zoning Commission of the City of Caldwell will a public hearing an�i�rrake a
recommendation to the Caldwell City Council regarding the re-zoning of
property in the vicinity of the Caldwell industrial Airport as well as associated
amendments, additions and deletions to its zoning ordinance. The proposed
legislation is intended to protect the long-term viability and potential for growth
of the Caldwell Industrial Airport. The legislation proposes to regulate the use
and development of land within approximately one (1) mile of the airport
runway.
Mark Hilty, City Attorney, presented exhibits PZ-1000 (information from Frank
Babb), PZ-1001 (appendix A from Mark Hilty), & PZ-1002 (exhibit from Mark
Hilty).

Comprehensive Plan Analysis - MOTION: Commissioner Griffith SECOND:
Commissioner Jakobson. The request was applicable to the following
Comprehensive Plan Components as outlined in the staff report: Property
Rights — Goal, Objectives A, B, and C, and Policy 1; School Facilities and
Transportation — Goal, and Objective A; Economic Development — Goals 1, 3,
and 4, Objectives A, B, C, D, G, H, and Policies 1 thru 5; Land Use — Goals 1
thru 6, Objectives applicable to all land uses A, B, C, and F, Objectives
applicable to commercial and industrial land use A and B, Policy 1 for the
area of impact, Policies 1, 4, and 5 for commercial and industrial use;
Hazardous Areas Component — Goal, Objectives A and B; Public Services,
Utilities and Facilities — Goals 1 and 2, Objectives A, B, C, and F, Policies 2,
5, and 7; Transportation — Goals applicable to circulation 1, 2, and 4, Goal 1
applicable to transportation, Objectives C, D, and E, Policies 2 and 6; Parks,
Recreation, and Open Space — Goal and Objective G; Housing — Goal,
• Objective A and B; Community Design — Goal, Objectives A, C, and D; Public
Safety Component — Goals 1 and 2, Objective A, and Policy 4.
Findings of Fact on Case No OA-64-04 - MOTION: Commissioner Shaffer
SECOND: Commissioner Griffith. Passed: Unanimous roll call vote. Accept
the course proceedings and general facts outlined in the staff report with the
following components as part of the findings of fact:
1. The Planning and Zoning Commission finds that this matter was properly
noticed
2. The Planning and Zoning Commission finds that the City of Caldwell has an
obligation to the FAA to protect the viability of the Caldwell Industrial Airport
from incompatible land uses and that the proposed ordinance will fulfill that
obligation.
3. The Planning and Zoning Commission finds that adoption of the proposed
legislation is in the best interests and welfare of the City of Caldwell.
4. The Planning and Zoning Commission finds that protection of the Airport
afforded by the draft legislation will:
(a) Protect and enhance the long-term economic viability of the Airport
and the
City of Caldwell generally;
(b) Serve to further trade and commerce;
(c) Benefit the health, welfare and well being of persons in the vicinity of
the
� Airport; and
(d) Facilitate the safety of aircraft operations in and around the Airport.

5. The Airport is an integral and irreplaceable part of the economic health and
• potential of Caldwell and, if appropriatelx protected and enhanced, will attract
important private development and job creation to Caldwell. i
6. Many airports across the country must shut down, relocate and/or greatly
restrict operations due to uncontrolled Noise Sensitive development that
creates land use conflict between airports and neighboring uses.
Conclusions of Law on Case No. OA-64-04 MOTION: Commissioner Griffith
SECOND: Commissioner Jakobson. The Planning & Zoning Commission has
the authority to hear this request and to recommend to City Council; the
hearing was legally noticed and conducted within guidelines of applicable
codes and ordinances. Passed: Unanimous roll call vote.
Recommendation on Case No. OA-64-04 - MOTION: Commissioner Griffith
SECOND: Commissioner Teraberry. The Commission approved Case No.
OA-64-04 with the conditions outlined in the staff report. Passed: Unanimous
roll call vote.
Public Hearing Closed — Chairman Alldredge closed the public hearing.

VI. Planning Issues:
A. Planning & Zoning Design Workshop will be held Thursday, November 18,
2004 at 6:30pm to 8:30pm in the Community Room of the Caldwell Police
• Department.
C. Next P&Z Public Hearing Date: December 14, 2004
VII. Adjournment:
Paul Alldredge adjourned the meeting at approximately 9:30 p.m.
