. CALDWELL PUBLIC HEARING BEFORE HEARING EXAMINER
MINUTES
October 29, 2004
I. Call to Order — Hearing Examiner, M. Jerome Mapp, opened the meeting for the
public hearing at 6:00 p.m.
II. Review of Proceedings — Mr. Mapp outlined the procedures for the public
hearing.
Members Present: Wendy Kirkpatrick (Senior Planner), Debbie Geyer
(Community Development Specialist).
III. Old Business
The Hearing Examiner approved and signed minutes of August 24, 2004.
IV. Hearings —
• A. CASE NUMBER SUP-222-04, a request by the Jodi Erickson for special permit
approval for a child care center for twelve or more children in a facility located at
1310 Arthur Street in an R-2 (Combine Medium Density Residential) zone.
Testimony:
Debbie Geyer, Community Development Specialist, presented the staff report.
Jodi Erickson, Applicant, testified in favor.
Public testimony closed — Mr. Mapp closed public testimony.

Comprehensive Plan Analysis: Mr. Mapp found that the request was applicable
to the following Comprehensive Plan components: Property Rights - Goal,
Objective B, and Policy 1; School Facilities and Transportation — Goal and Policy
1; Land Use — Goals I, I I, II I, and IV, Objective Applicable to All Land Uses,
objective A; Policy for Residential Use — Policy 1; Public Services, Utilities and
Facilities — Goals I and II, Objective B, Policies 1 and 5; Transportation — Goals
applicable to circulation, Goals I and II, Objectives A.
Findings of Fact on Case No. SUP-222-04: The Hearing Examiner accepted
• the general facts as outlined in the staff report, and public testimony.

Conclusions of Law on Case No. SUP-222-04: The Hearing Examiner
. accepted the Conclusions of Law as outlined in the staff report.
Order of Decision on Case No. SUP-222-04: The Hearing Examiner approved
Case No. SUP-222-04 with the conditions outlined in the staff report.
Public Hearing Closed - Mr. Mapp closed the public hearing.

B. CASE NUMBER CASE NUMBER SUP-225-04, a request by Dana Huffaker for
a Planned Unit Development to place an espresso stand in the offsite parking for
the Canyon County Courthouse. The site is located on Albany Street. The site is
located between 11 and 12 Avenue, north of the railroad tracks in a C-2
(Community Commercial) zone.
Testimony:
Wendy Kirkpatrick, Senior Planner, presented the staff report.
Dana Huffaker, Applicant, testified in favor.
Jerome Mapp, Hearing Examiner, confirmed that the commercial facility would be
operated from a portable recreation trailer.
Kathy J. Holt, signed in favor.
